CHAPTER ccxlv.
An Act to confer powers upon the Corporation of the
A.D.
1900..
county borough of West Bromwich with respect to
tramways and to their electric lighting and other under-
takings to make further provision for
the.
improvement
and good government of the borough to amend and
extend the provisions of the local Acts relating to the
borough and for other purposes. [6th August 1900.}
HEREAS the borough of West Bromwich in the county of
Stafford (herein-after referred to as " the borough") is a-
county borough under the government of the mayor aldermen and
burgesses of the borough (herein-after called " the Corporation "):
And whereas extensive powers in regard to the government
and improvement of the borough are conferred upon the Corporation
by the local Acts and Orders confirmed by Parliament specified in
Part I. of the lirst Schedule to this Act and such Acts and Orders-
are referred to in this Act as the recited Acts and each of such
Acts and Orders is separately refeired to as the Act or Order of the
year in which it was passed or confirmed as the case may be :
And whereas tramways have been constructed in the borough
in pursuance of powers conferred by the Orders confirmed by
Parliament specified in Part II. of the First Schedule to this Act
and those Orders are in this Act referred to as the Tramway-
Orders :
And whereas by section 43 of the Tramways Act 1870 which
is incorporated with the Tramway Orders the Corporation are
empowered within six months after the expiration of the period
of twenty-one years from the confirmation of such of the Tramway
Orders as authorise the construction of tramways to purchase with
the approval of the Board of Trade so much of the tramways-
thereby authorised as is within the borough:

1900. And whereas it is expedient to empower the Corporation to work
such tramways and that further provision be made in regard to the
reconstruction
thereof:
And whereas it is expedient that a fund be established for the
encouragement of thrift among certain of the officers and servants
of the Corporation and that the Corporation be empowered to
subscribe or contribute to such fund and that other provisions
should be made in reference thereto:
And whereas the Corporation are the undertakers for supplying
electrical power and energy within the borough and it is expedient
to authorise the use of electric power on the said tramways when
acquired by the Corporation and to execute such works in and
about the said tramways as may be necessary for the use thereon
of electric power and to make further provision in regard to their
electric lighting undertaking :
And whereas it is expedient that the Corporation and such other
local authorities as are herein-after mentioned should be authorised
to enter into agreements as to the supply of electricity and that
further powers should be conferred upon the Corporation with
reference to electricity as are herein-after contained :
And whereas it is expedient that better provisions should be made
with reference to streets buildings sewers and recreation grounds
within the borough and that the powers of the Corporation in
relation to the health local government and improvement of the
borough should be enlarged:
And whereas it is expedient that further borrowing and other
powers be conferred upon the Corporation:
And whereas an absolute majority of the whole number of
the council at a meeting held on the sixth day of December one
thousand eight hundred and ninety-nine after ten clear days'
notice by public advertisement of such meeting and of the purpose
thereof in the Free Press a local newspaper published and circulating
in the borough such notice being in addition to the ordinary notices
required for summoning such meeting resolved that the expense
in relation to promoting the Bill for this Act should be charged on
the borough fund :
And whereas such resolution was published twice in the said
newspaper and has received the approval of the Local Government
Board:
And whereas the propriety of the promotion of the Bill for this
Act was confirmed by an absolute majority of the whole number
of the council at a further special meeting held in pursuance of a
similar notice on the third day of January one thousand nine

hundred being not less than fourteen days after the deposit of the A.D.1900.
Bill for this Act in Parliament:
And whereas the owners and ratepayers of the borough by
resolution in the manner provided in the Third Schedule of the
Public Health Act 1875 consented to the promotion of the Bill for
this Act:
And whereas the purposes of this Act cannot be effected without
the authority of Parliament:
May it therefore please Tour Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by and
with the adyice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say):

The following Acts and parts of Acts so far as they are Incorpora-
applicable for the purposes and are not inconsistent with the

provisions of this Act are hereby incorporated with and form part
of this Act namely :
The Lands Clauses Acts (except section 127 of the Lands Clauses
Consolidation Act 1845):
Section 3 (Interpretation of terras) section 19 (Local authority
may lease or take tolls) and Parts II. and III. of the Tramways
