An
Act
to
authorise the Surrey County Council
A.D.
1936.
-
to
execute works
for
the improvement
of
Beverley
Brook
and
Pyl
Brook
and other
brooks
and streams in the county
of
Surrey
to
confer
further powers
on
the Council and
to
enact
further provisions for the good government
and administration and the preservation
of
the
amenities
of
the county
to
enact provisions
with respect
to
the control
of
wrestling enter-
tainments arid swimming baths and with respect
to
town planning and
roads
within the county
and
for
other purposes. [31st July
1936.1
HEREAS Beverley Brook (with the exception
of
w
a
portion
of
the width thereof for part
of
its
length which is situate in the metropolitan borough
of
Wandsworth in the county
of
London) and Pyl Brook
and certain other brooks and streams connected there-
with are situate in the administrative county
of
Surrey
(hereinaiter referred to
as
"
the county
")
:
And whereas the said brooks and streams
form
the
principal drainage outlet for the surface water coming
from
an
extensive area in the county:
And whereas the said brooks and streams are
narrow and tortuous and flooding is consequently
caused within the county
:
And whereas it is expedient that for the purpose
of
preventing
or
minimising the risk of flooding the

county council of the county (hereinafter referred to as
-
“the Council”) should
be
empowered to execute the
works by this Act authorised
:
And whereas
it
is expedient that provision should
be
made with respect to the making of contributions
towards the cost of the said works by the London
County Council and certain local authorities in the
county
:

And whereas
by
the Surrey County Council Acts

and
1931
powers were conferred upon the Council
with respect to the protection
of
streams and the

preservation of the amenities of the county and with
respect to town planning and roads within the county
and
it
is expedient to confer on the Council further
powers and to enact further provisions
as
in this Act
contained with respect to those matters
:
And whereas
for
the purpose of securing the good
and orderly government of the county
it
is
expedient
to
confer upon the Council further powers and to enact
further provisions
as
in this Act contained with respect
to
the powers and duties of the Council as local authority
under the Lunacy and Mental Treatment Acts
1890
to
1930
and with respect to the control of wrestling
entertainments and swimming baths
:
And whereas
it
is
expedient to make provision
with respect to the superannuation of the clerk and
deputy clerk
of
the peace for the county and the transfer
to the court
of
quarter sessions for the county of officers
appointed to assist the clerk
ol
the peace and to enact
other provisions as in this Act contained with respect
to
such officers:
And whereas
it
is expedient that the other provisions
of this Act be enacted:
And whereas the purposes of this Act cannot be
effected without the authority of Parliament
:
And whereas estimates have been prepared by the
Council for the purposes hereinafter mentioned and such
estimates are
as

And whereas the works included in such estimates
A.D.
1936.
are permanent works and
it
is expedent that the cost
-
thereof be spread over
a
term of years:
And whereas plans and sections showing the lines
and levels
of
the works authorised by this Act and plans
of the lands which may be taken
or
used compulsorily
under the powers of this Act and a book
of
reference
to those plans containing the names of the owners and
lessees
or
reputed owners and lessees and
of
the occupiers
of those lands respectively have been deposited with
the clerk of the Council and with the clerk of the London
County Council and are in this Act respectively referred
to
as
the deposited plans the deposited sections and
the deposited book of reference
:
And whereas in relation to the promotion
of
the
Bill
for
this Act the requirements
of
Part
XI11
of
the
so
far
as applicable to the
238~24
Council have been observed
:

it
therefore please
Your
Majesty that
it
may
be enacted and be
it
enacted by the King's most
Excellent Majesty by and with the 'advice and consent
of
the
Lords
Spiritual and Temporal and Commons
in this present Parliament assembled and by the authority
of the same
as
follows
