tending their Powers ; and for other Purposes.

HEREAS under and by virtue of " The Salford Improve- n G. 4.
&
ment Act, 1830," and " The Salford Improvement Act, ^*84 y^f*
1844,"
certain Commissioners thereby constituted were c. xxxiii.
empowered to improve and regulate the Township of Salford in the
County of Lancaster, and to establish Gasworks and Markets there:
And whereas by a Charter of Incorporation, dated the Sixteenth Day Charter,
of April One thousand eight hundred and forty-four, the Inhabitants ^ate^

of the Township of Salford and Part of the Township of Broughton
were incorporated by the Name or Title of " the Mayor, Aldermen,
and Burgesses of the Borough of Salford in the County of Lan-
caster" and under the Authority of the last-mentioned Act the Pro-
perties and Powers of the Commissioners were vested in the Corpora-
tion : And whereas by "The Salford Waterworks and Improvement

Act, 1850," Powers were given to the Corporation of Salford to pur- c"lxxv"
chase Water from the Corporation of Manchester, and to distribute
the same within the Borough, and to levy and receive Rates and
Rents in respect
thereof,
and to make Improvements within the

Borough: And whereas by "The Salford Extension and Improve-

the Remainder of the Township of Broughton, the
Township of Pendleton, and part of the Township of Pendkbury
were added to and now form Part of the Borough of
Salford,
and the
Borough was divided into Three Districts, called respectively " the
Salford District," " the Broughton District," and " the Pendleton
District," and the Corporation were authorized to purchase a further
Quantity of Water from the Corporation of Manchester, and to
supply Water within the Pendleton District as well as within the then
22&23Vict. Borough: And whereas by " The Salford Gasworks Act, 1859,"

X1X further Provisions were made in respect to the Supply of Gas by the
Corporation of Salford and the Profits accruing therefrom: And
whereas under the Provisions of the said Acts for the Improvement,
Government, and Regulation of the Borough of Salford the Cor-
poration of Salford have borrowed considerable Sums of Money,
and the total Amount due by them upon their various Securities
amounted, on the Thirty-first Day of August One thousand eight
hundred and sixty-one, to the Sum of One hundred and eleven
thousand seven hundred and seventy-eight Pounds: And whereas
the Powers and Provisions of the last-mentioned Acts are insufficient,
and it is expedient that the same be enlarged, and that the Corpora-
tion be empowered to raise additional Monies, and that such other
Powers and Provisions in reference to the Borough be enacted as are
by this Act provided: And whereas to avoid the Inconveniences
arising from several Acts of Parliament, relating to the same Purposes
being in force at the same Time, it is expedient that the said Acts
passed in the Years One thousand eight hundred and thirty, One
thousand eight hundred and forty-four, One thousand eight hundred
and fifty, One thousand eight hundred and fifty-three, and One
thousand eight hundred and fifty-nine, be repealed, and that some of
the Powers and Provisions thereof be amended or re-enacted and
continued by this Act: And whereas by " The Manchester Division
Stipendiary Justice Act, 1854," Provision was made for the Sittings
of the said Justice, and it is expedient to amend such Act in respect
to such Sittings: And whereas the Objects aforesaid cannot be
effected without the Authority of Parliament: May it therefore
please Your Majesty that it may be enacted; and be it enacted by
the Queen's most Excellent Majesty, by and with the Advice and
Consent of the Lords Spiritual and Temporal, and Commons, in this
present Parliament assembled, and by the Authority of the same, as
follows; (that is to say,)

Except where herein otherwise expressly provided, the Limits of Limits of
this Act shall be the Borough of
Salford,
as herein-after denned. Act"

In citing this Act for any Purpose it shall be sufficient to use Short Title.
the Expression " The Salford Improvement Act, 1862."
4.
In construing this Act the following Words and Expressions laterpreta-
shall have the several Meanings hereby assigned to them, unless there ^,on of
be something in the Subject or Context repugnant to such Construc-
tion ; (that is to say,)
The Word " Person" shall include Company, and the Heirs, Exe-
. cutors, Administrators, and Assigns of any Person, and also a
Corporation, whether aggregate or sole:
The Expression " the Borough
"
shall mean the Municipal Borough
of Salford as hereafter denned:
The Expression " the Corporation " shall mean the Mayor, Alder-
men, and Burgesses of the Borough of
Salford:
The Expression " the Town Clerk" shall mean the Town Clerk
for the Time being of the Borough of
Salford:
The Expression " the Surveyor " shall mean the Surveyor of the
Borough, and shall include any District Surveyor:
The Expression " the Corporation of Manchester
"
shall mean the
Mayor, Aldermen, and Citizens of the City of Manchester:
The Word " Month" shall mean a Calendar Month:
The Word " Oath " shall include Affirmation in case of Quakers,
or other Declaration or Solemnity lawfully substituted for an
Oath in case of any other Persons exempted by Law from the
Necessity of taking an Oath:
The Word " Justice" shall mean a Justice of the Peace for the
Borough of
Salford,
and also a Justice of the Peace for the
County of Lancaster:
The Expression " Two Justices" shall mean Two or more Justices
assembled and acting together in Petty Sessions for the Borough,
or, except where herein otherwise provided, any Stipendiary
Magistrate acting for the Borough :
The Expression " Quarter Sessions" shall mean the General or
Quarter Sessions for the County of Lancaster, holden for the
Hundred of
Salford:
The Expression " Court of competent Jurisdiction" shall include
any Court for the more easy Recovery of small Debts and
Demands: Provided that this Interpretation shall not give
Jurisdiction to any such Court in any Case in which the Sum
claimed shall exceed the Amount by Law recoverable in such
Court:
The Word " Land" shall include Messuages, Lands, Tenements,
and Hereditaments of any Tenure: The
