An Ad for inclofing Lands in the M'anor of Ovenden,
in the Parifh of -Halifax', in the County of York.

HEREAS within the Manor of Ovenden, in the Parifh of Hali-
fax, in the County of York, there are divers Commons, Moors,
and Wafte Grounds, called
Highroad
Well Moor,
Ovenden
Moor,
Ogden Maor, Skirden, Coldedge, Illingivorib Moor, Todmoor, Swillhill,
Childwife Moor, and Lee Bank, containing together One thoufand two
hundred Acres or thereabouts, and various other Parcels of Wafte, not
diftinguifhed by'any particular Names: And>whereas the Honourable and
Reverend John Lurnley Savile is Lord of the Manor of
Ovenden
aforefaid,
and the Owner of the Soil of the faid feveial Commons, Moors, and Wafte
Grounds, and the Coal Mines, Veins, and Seams of Coal, and all other
Mines and Minerals therein; and is likewife Owner of certain Lands,
Tenements, and Hereditaments within the faid Manor of Ovenden: And
whereas the King's 'molt Excellent Majefty, in Right of His Crown, is
Patron of the Vicarage of Halifax; and the Reverend Henry William
Coulthu'rft, Doftor in Divinity, is Vicar
thereof,
and as fuch entitled to
the Tithe of Agiftment, and all other Vicarial and SmallTkhes whatfo-
ever arifing within the faid Manor: And whereas an Aft was paifed in the
Forty-firfl Year of the Reign of His prefent Majefty, intituled An Aft
for
confolidating
in One Aft, certain Provifions ufually inferted. in Afts of
Indofure, and for facilitating the Mode of
proving
the feveral Fads ufually

Savile, Richard Emmott, John Lodge Batley, William Mitchell, Samuel
Dean,
Robert Ramjbottom, Thomas Sutcliffe, Charles Hud/on, and others,
assOwners and Proprietors of Lands and Tenements within the faid Manor
of ;Ovenden, are entitled to Right of Common upon the faid Commons,
Moors, and Waftes; which in their prefent State yield but little Profit,
and it would be advantageous tofuch Owners and Proprietors, if the faid
Commons, Moors, and "Waftes were divided and inclofed, and-fpecific
Shares allotted to them, -according'to their refpeftive Interefts therein:
but fuch Divifion and Inclofure cannot be effefted and eftablifhed without
the Aid and Authority of Parliament: May it therefore pleafe Your
Majefty that it may be enacled; and be it enacted by the King's moffc
Excellent Majefty, by and with the Advice and Confent of the Lords
Spiritual and Temporal, and Commons, in this prefent Parliament affem-

fioner§!nnU" -Moors, and WafteGrounds fhall, as foon as conveniently may be, be fet
out, divided, and allotted unto and amongft the faid feveral Owners and
Proprietors, and other Perfons interefted as aforefaid, according to their
feveral and refpeftive Rights and Interefts therein, by
Thomas Gee
of Little
Houghton, in the Parifh of Darfield, in the faid. County of Tork, Gentle-
man, and John Watkinfon of Halifax, in the faid County, Gentleman,
who are hereby appointed CommifTioriers for that Purpofe, and for carry-
ing the .feveral other Purpofes of this Aft, and alfo the faid recited Aft,
into Execution, and all and every the Powers and Provifions herein and
therein contained (except fuch Parts of the faid recited Aft as are hereby
varied or altered), and under and fubjeft to fuch of the Rules, Orders,
Regulations, Reftri&ions, Provifions, and Directions contained in the faid
recited Aft, as are not repugnant to the Powers and Provifions of this Aft;
and that it fhall be lawful for the faid Commiffioners,,or either of therii,
or for any Juftice of the Peace for the Weft Riding of the County of
Tork, to adminifter to the faid Commiffioners, or either of them, the
Oath .or Affirmation directed by the faid recited Aft to be taken by Com-
miffioners.
Appointment V- An& be it further enafted, That if the faid Thomas Gee, or any
of new Com- Commiffioner to. be appointed in his Stead, as herein-after mentioned, by
iniffioners in the Lord or Lords of the faid Manor for the Time being, fhall die, refufe,
fentone^8" °r become incapacitated to aft, then and in every fuch Cafe, the Lord or
dying or not Lords of the laid Manor for the Time being, mail and may thereupon
afting. appoint fome other Perfon, not interefted in the faid Inclofure, to be a
Commiffioner in the Stead of fuch Commiffioner fo dying, refufing, or
becoming incapacitated to aft; and if the faid John Watkinfon, or any
Commiffioner to be appointed by the Majority in Value of the Perfons
interefted in the faid Lands, prefent at a Meeting as herein-after mentioned,
ihall die, refufe, or become incapacitated to aft, fonfe other Perfon not
interefted in the faid Inclofure, fhall and may be thereupon appointed a
Commiffioner in the Stead of every fuch Commiffioner fo dying, refufing, or
becoming incapacitated to aft, by a Majority in Value (to be afcertained by
the Land-Tax Affefunent) of the Perfons interefted in the Lands hereby
intended to be divided and inclofed, who fhall be prefent at a Meeting to
be holden for that Purpofe in the Chapelin Ovenden, called Illingworth
Chapel, purfuant to Notice to be affixed upon the principal outer Door of the
faid Chapel of
Ovenden
aforefaid, fpeciiying the Time and Place of fuch
