Minister of Health relating to Bradford. [20th March 1930.] W HEREAS under the provisions of the Local Gov- 51 & 52 Vict. eminent Act 1888 the Minister of Health has c-41-made a provisional order which needs confirmation by Parliament: Be it therefore enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows : The Order of the Minister of Health which as Order in amended is set out in the schedule to this Act is hereby schedule confirmed and shall have full validity and force. confirmed. Bradford Provisional Order made in 'pursuance of the Local (Extension) Government Act 1888 for the extension of a County Order. v i. Borough. WHEREAS by virtue of section 54 of the Local Government Act 1888 the Minister of Health subject to the observance of the conditions imposed by section 2 of the Local Government (County Boroughs and Adjustments) Act 1926 may make a provisional order for altering the boundary of a county borough; And whereas the city of Bradford is a county borough within the meaning of the Local Government Act 1888 and is for the purposes of that Act situate in the county of the West Riding of Yorkshire and the inhabitants are a body corporate by the name of the lord mayor aldermen and citizens of the City of Bradford and act by the council of the City and the City for the purpose of the election of councillors is divided into twenty-one wards; And whereas the City comprises the township of Bradford (for which a separate board of guardians has been constituted) and the townships of Eccleshill North Bierley Tong and Wike and the parishes of Idle and Thornton in the North Bierley union; And whereas the City has a separate court of quarter sessions recorder stipendiary magistrate commission of the peace police force and coroner; And whereas the parliamentary borough of Bradford is co-extensive with the City; And whereas the urban district of Clayton in the county of the West Riding of Yorkshire immediately adjoins the City of Bradford and is co-extensive with the parish of Clayton in the North Bierley union; And whereas the conditions imposed by section 2 of the Local Government (County Boroughs and Adjustments) Act 1926 have been complied with: 2 [2(J Geo. 5.] Ministry of Health Provisional [Ch. xiiii.] Order Confirmation (Bradford Extension) Act, 1930. Now therefore the Minister of Health in pursuance of the A.D. 1930. powers given to him by sections 54 and 59 of the Local Govern- ment Act 1888 and of all other powers enabling him in that Bradford behalf hereby orders as follows : (^oXn) Part I. Preliminary. This order may be cited as the Bradford (Extension) Short title. Order 1929. In this order unless the context otherwise requires Interpre- " Existing" means existing immediately before the first day of April nineteen hundred and thirty; "The Act of 1888" and "the Act of 1894" mean respectively the Local Government Act 1888 and the Local Government Act 1894; " The added area " means the urban district of Clayton which by this order is added to the existing city of Bradford; " The appointed day" means the first day of April nineteen hundred and thirty; " The City " means the existing city of Bradford as extended by this order; " The Clayton Council" means the urban district council of Clayton; " The Clayton District" means the urban district of Clayton; " The Corporation " means as the context requires the lord mayor aldermen and citizens of the existing City or of the City acting by the council; " The County " and " the County Council" mean respectively the administrative county of the West Riding of Yorkshire and the county council of that county; "The maps" means the duplicate maps marked "Map " showing the area added to the City of Bradford by ''the Bradford (Extension) Order 1929" and sealed with the official seal of the Minister; " The Minister " means the Minister of Health; " The Municipal Corporations Acts " means the Municipal Corporations Act 1882 and the Acts amending and extending that Act and the Borough Councillors (Alteration of Number) Act 1925. 3. Where the day on which anything by this order required Provision as to be done falls on a Sunday that thing shall be done on the to Sunday. following day. A 2 3 AD. 1930. Bradford (Extension) Order. Commencement of order. Application of Local Government Act 1929. Extension of City. County electoral division. Save as otherwise expressly provided this order shall come into operation on the first day of April nineteen hundred and thirty: Provided that for the purposes of (a) the alteration or re-arrangement of any register of electors made under the Representation of the People Acts; (6) the formation of the Clayton ward of the City and all proceedings preliminary or relating to any election to be held in nineteen hundred and thirty for any area affected by this order; and (c) the alteration of valuation lists to take effect on the appointed day or the preparation of any estimate of the produce of a penny rate or precept to be made in respect of the financial year commencing on the appointed day; this order shall operate from the date of the Act of Parliament confirming it. 5.(1) For the purposes of parts I. to III. and parts VI. to VIII. of the Local Government Act 1929 the alteration of areas made by this order shall be deemed to come into operation immediately before the date fixed by that Act as the appointed day for those purposes. (2) For the purposes of settlement and irremovability the parish of Clayton shall be deemed to be situate within the City at the appointed day referred to in paragraph 3 of part I. of the ninth schedule to the Local Government Act 1929 but except for those purposes nothing in this order shall affect the area of any poor law union. Part II. . Alterations of Boundary. 6.(1) The boundary of the existing City shall be altered so as to include within the City the urban district of Clayton which is coloured yellow on the maps. (2) The city of Bradford as extended by this order shall for the purposes of the Municipal Corporations Acts and for all other purposes be the city of Bradford and shall be the county borough of Bradford for the purposes of the Act of 1888. 7.(1) The added area shall cease to form part of the Queensbury electoral division of the County. (2) The person who immediately before the appointed day is the county councillor representing the existing Queensbury electoral division shall be deemed to have been elected to represent that division as altered by this order and shall retire [20 Geo. 5.] Ministry of Health Provisional [Ch. xliii.] Order Confirmation (Bradford Extension) Act, 1930. on the day on which he would have retired if this order had A.D. 1930. not been made. 8.(1) One of the maps shall be deposited in the office of (Extension'' the Minister and the duplicate map shall be deposited with the Order. town clerk at his office. Deposit and (2) Copies of the map deposited with the town clerk certified copies of by him to be true shall be sent by him within one month after maps' the date of the Act of Parliament confirming this order to the clerk of the County Council the Board of Inland Revenue the Commissioners of Customs and Excise the Registrar-General the Postmaster-General the Board of Trade the Minister of Transport the Electricity Commissioners and the Minister of Agriculture and Fisheries. 9.(1) Copies of or extracts from the map deposited with Copies of the town clerk certified by him to be true shall be received in maPto be all courts of justice and elsewhere as prima, facie evidence of evidence-the contents of the map so far as it relates to the boundary of the added area. The map deposited with the town clerk shall at all reasonable times be open to inspection by any person liable to any rate leviable within the City and any such person shall be entitled to a copy of or extract from the map certified by the town clerk to be true on payment of a reasonable fee to be determined by the Corporation. All fees so received shall be carried to the general rate fund of the City. paet m. Mttmcipal Wards Elections &c. 10. Borough Councils provisions of the County and Borough Councils (Qualification) (Qualification) Act 1914 the added area shall be deemed to have always formed Actl914 part of the City. 12.(1) Upon such day in the month of April or May Election of nineteen hundred and thirty as the lord mayor of the City may councillors in writing appoint there shall be held an election of three ^'r^layton councillors for the Clayton ward of the City...
