An Act to confirm a Provisional Order of the A.D. 1925 Minister of Health relating to Blackpool. [27th March 1925.] 38 & 39 Vict. c. 55. TT/'HEREAS the Minister of Health has made the \ \ Provisional Order set forth in the schedule hereto under the provisions of the Public Health Act 1875: And whereas it is requisite that the said Order should be confirmed by Parliament: Be it therefore enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows: The Order as amended and set out in the Oder in schedule hereto shall be and the same is hereby con- schedule firmed and all the provisions thereof shall have full confirmed. validity and force. Blackpool Provisional Order to enable the Blackpool Corporation to (No 2) P1^ iW /orce Me Compulsory Clauses of the Lands Clauses Acts. WHEREAS the Mayor Aldermen and Burgesses of the Borough of Blackpool (hereinafter referred to as " the Corporation") acting by the Council as the local authority for that Borough for the purposes of the Public Health Act 1875 require to purchase and take the lands described in the schedule hereto for the purposes of (a) widening opening enlarging or otherwise improving certain streets (6) making certain new streets (c) providing public walks and pleasure grounds and (d) providing municipal offices : Now therefore the Minister of Health in pursuance of the 38 & 39Vict, powers given to him by Section 176 of the Public Health Act c. 55. 1875 and by any other Statutes in that behalf hereby orders that from and after the date of the Act of Parliament confirming this Order the following provisions shall have effect that is to say: Compulsory 1. The Corporation shall be empowered for the purposes powers of aforesaid to put in force with reference to the lands described purchase. in the Schedule hereto (subject to the continuance of existing public rights of highway if any) the powers of the Lands Clauses Acts as modified by the Acquisition of Land (Assessment of Compensation) Act 1919 with respect to the purchase and taking of lands otherwise than by agreement or any of them Provided that nothing herein shall empower the Corporation without the consent in writing of the Postmaster-General to enter upon or purchase or take the interest of the Postmaster-General in the properties Numbered 16 in Work No. 11 and 17 in Work No. 36 in the plans referred to in the Schedule hereto : Provided also that in relation to the interest of Thomas James Naylor in the properties numbered 53a 54 57 58 59 61 and 62 in Works Nos. 1 and 3 one year shall be the prescribed 2 [15 Geo. 5.] Ministry of Health [Ch. xii.] Provisional Order Confirmation (Blackpool Order) Act, 1925. period for the purposes of section 123 of the Lands Clauses A.D. 1925. Consolidation Act 1845. Blackpoui Order 2. Notwithstanding anything contained in this Order or (No. 2). shown on the deposited plans and sections the following pro- por pro. visions for the protection of the Fylde Water Board (in this taction of Article referred to as "the Board") shall have effect (that is Fylde Water to say):- Board- (1) The Board are hereby empowered if they deem necessary by reason of any works or improvements of the Corporation authorised by this Order to alter the situation of or re-lay any water mains valves hydrants and appliances and to provide and lay where reasonably necessary any substituted water mains in order to maintain the supply of water during the construction of such works alterations or improvements and the Corporation shall pay to the Board the cost of such alteration and re-laying or the provision and laying of substituted mains after credit shall have been given to the Corporation for the value of the mains thrown into disuse: (2) The Corporation shall give the Board fourteen days notice before the commencement of any of the works under this Order: (3) The Board shall after receipt of the said notice from the Corporation (unless otherwise agreed) serve notice upon the Corporation with a plan showing the required alteration and re-laying of water mains valves hydrants and appliances and for the laying of substituted mains and the Board shall if possible within fourteen days after the service of such notice and plan commence to execute such alteration re-laying or laying and shall complete the same with all reasonable despatch: (4) The Board are hereby empowered if they deem necessary by reason of any works or improvements of the Corporation authorised by this Order to alter or re-lay any service pipes and remove stopcocks stopcock-boxes meters and meter-boxes from their present positions to similar positions on the new line of footpath and the Corporation shall pay to the Board the cost of such alteration or re-laying : A 2 3 [Gh. (5) The Corporation shall make compensation to the Board for any damage done to the water mains valves hydrants Blackpool service pipes stopcocks stopcock-boxes meters and in I) meter-boxes and other appliances belonging to the Board by reason or in consequence of the works and improvements of the Corporation : (6) If any difference shall arise between the parties as to the meaning or intent of anything herein contained or as to anything done by either party or as to the fact of damage to any property of the Board and the compensation payable by the Corporation in respect thereof the same shall be referred to and determined by an engineer to be agreed on between the Corporation and the Board or failing agreement to be appointed by the President of the Institution of Civil Engineers on the application of either party and subject as aforesaid the provisions, of the Arbitration Act 1889 shall apply to any such reference.
