CHAPTER lxxxvi.
An Act to provide for regulating certain lands in
A.D.
1932.
the Parts of Lindsey Lincolnshire known as the
Sandhills to confer powers upon the county
council of the said Parts of Lindsey with reference
thereto and for other purposes. [12th July 1932.]
W
HEREAS the administrative county of the Parts of
Lindsey Lincolnshire is bounded on the east by
the North Sea and there are situate between the foreshore
and certain enclosed lands in that county certain other
lands which are for the most part open or waste lands
and are locally known as the Sandhills (hereinafter
referred to as " the Sandhills ") and which until recently
were and to a large extent still are open to and freely
used by the public :
And whereas in recent years parts of the Sandhills
have been enclosed or built upon but in many cases the
persons so enclosing or building are believed to have had
no sufficient right or title so to do :
And whereas the enclosing of parts of the Sandhills
deprives the public of access thereto and enjoyment
thereof and many of the buildings and structures erected
upon the Sandhills are unsightly or otherwise of an
undesirable character and many of the said buildings and
structures used for human habitation are not provided
with a proper water supply or sanitary conveniences :

1932. And whereas the greater part of the Sandhills in the
parish of Mablethorpe in the urban district of Mable-
thorpe and Sutton is vested in and under the control of
the urban district council of that urban district by virtue
of the Mablethorpe Urban District Council Act 1914 and
other parts of the Sandhills in the urban district of
Skegness are vested in and under the control of the
urban district council of that urban district:
And whereas it is expedient that for securing or
preserving to the public access to and the use and enjoy-
ment of such parts of the Sandhills as are not under such
control as aforesaid and for securing the development
thereof in the best interests of the inhabitants of the
said county the county council of the said county
should be empowered to acquire such portions as they
think fit of the said parts of the Sandhills as well as other
lands for the provision of access to the Sandhills and that
such provisions for the regulation and control of the
said uncontrolled parts of the Sandhills as are contained
in this Act should be made :
And whereas it is expedient that the other powers
and provisions contained in this Act should be conferred
and enacted:
And whereas the objects aforesaid cannot be attained
without the authority of Parliament:
And whereas plans showing the lands which the
said county council may acquire compulsorily under
the powers of this Act and which are to be subject to
the provisions for control and regulation contained in
this Act and a book of reference to the said plans con-
taining the names of the owners or reputed owners and
of the lessees or reputed lessees and of the occupiers of
and describing such lands have been deposited with the
clerk of the county council of the said administrative
county of the Parts of Lindsey and are in this Act
respectively referred to as the deposited plans and book
of reference:
And whereas in relation to the promotion of the
Bill for this Act the said county council have complied
with the requirements of the Borough Funds Act 1872
so far as that Act applies to county councils under
the provisions of the Local Government Act 1888 as
extended by the County Councils (Bills in Parliament)

May it therefore please Your Majesty that it may be A.D. 1932.
enacted and be it enacted by the King's most Excellent
Majesty by and with the advice and consent of the
Lords Spiritual and Temporal and Commons in this
present Parliament assembled and by the authority of
the same as follows (that is to say):
1.
This Act may be cited as the Lindsey County Short title.
Council (Sandhills) Act 1932.
2.
The Lands Clauses Acts so far as the same are Incorpora-
applicable for the purposes and are not inconsistent with tion
of
the provisions of this Act are hereby incorporated £ands
with and form part of this Act subject to the following Acts<
exceptions and modification (namely):
(a) Sections 92 and 127 of the Lands Clauses Con-
solidation Act 1845 are not incorporated with
this Act:
(6) The bond required by section 85 of the Lands
Clauses Consolidation Act 1845 shall be under
the corporate seal of the County Council and
shall be sufficient without the addition of the
sureties mentioned in that section.

In this Act unless the subject or context Interpreta-
otherwise requires tion-
" The county " means the administrative county of
the Parts of Lindsey Lincolnshire;
" The County Council" means the county council
of the county;
" The county fund " and " the county rate " mean
respectively the county fund and the county
rate of the county;
" The commissioners " means the Commissioners of
Sewers for the county of Lincoln the city of
Lincoln and county of the said city and part
of the county of Nottingham and includes any
successors of such commissioners;
" The prescribed date " means the thirty-first day of
July one thousand nine hundred and thirty;
" Structure " includes
(a) a dwelling-house shed hut or tent or
other building structure or erection of any
description other than a fence; and
