HEREAS the urban district of Ilfracombe (in this

Act referred to as
"
the district
")
is an urban
district within the meaning of the Public Health Act
38&39~ict.
1875
and an urban district within the meaning of the

and is under the manage-

ment and control of the urban district council of
Geo.
3.c.31.
Ilfracombe

this Act referred to
as
"
the Council
")
:
And whereas by the Ilfracombe Improvement Act

1900
(in this Act referred to
as
"
the Act of
1900
")
c.

the Council who for many years previously had supplied
water within their district from works established in the
district under the provisions of the Public Health Act
were authorised to obtain
a
further supply of water
by
means of
works
consisting of intakes formed
by
dams across certain brooks including the river Bray
in the parish of Challacombe in the rural district of
Barnstaple in the county of Devon
:
And whereas the supply of water from the present
waterworks of the Council is inadequate to meet thc

present and growing demands
of
the inhabitants of the
-
limits of the Council
for
the supply
of
water and
it
is
expedient that the Council should be empowered to
make and maintain the additional waterworks autho-
rised
by
this Act including
a
reservoir on the said river
Bray and that the other provisions contained in this
Act with reference to the construction
of
those works
should be enacted
:
And whereas it
is
expedient to authorise the
Council to acquire additional lands for the purpose
of
protecting against pollution the waters which by the
Act of
1900
the Council were empowered
to
take:
And whereas
it
is
expedient to make further
provision with regard to the water undertaking
of
the
Council and the supply
of
water by them
:
And
whereas it
is
expedient that further and better
provision should
be
made with reference to streets
buildings sewers and drains infectious disease and
sanitary matters and camping grounds and otherwise
for
the health and local government
of
the district and
that the powers
of
the Council in relation thereto should
be enlarged and extended:
And whereas
it
is expedient that the provisions
with regard to the finances of the district which are
contained in this Act should be made and that the
Council should be empowered to borrow money
for
the
purposes of this Act:
And whereas
it
is
expedient that the other provisions
contained in this Act should be enacted:
And whereas the objects
of
this Act cannot be
effected without the authority
of
Parliament
:
And whereas estimates have been prepared by the
Council for the purposes hereinafter mentioned and such
estimates are as follows:-

And whereas the several works included in such
A.D.
1936.
estimates respectively are permanent
works
and
it
is
expedient that the Council should be empowered to
borrow money for those purposes
as
provided by this
Act
:
And whereas in relation
to
the promotion of the
Bill for this Act the requirements of Part XI11 of the
have been observed
:
And whereas plans and sections showing the lines
and levels of the works authorised by this Act and also
a
book of reference containing the names of the owners
and lessees
or
reputed owners and lessees and
of
the
occupiers
of
the lands required
or
which
may
be taken
for
the purposes
or
under the powers of this Act were
duly deposited with the clerk
of
the county council
of
the administrative county
of
Devon which plans
sections and book
of
reference are in this Act referred
to as the deposited plans sections and book of reference
:
May
it
therefore please
Your
Majesty that it may
be enacted and be it enacted by the King's most
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons in
this present Parliament assembled and by the authority
of the same
as
follows
