An Act for reclaiming from the Sea certain Lands
near Harwich, for constructing Docks and a Pier
on such Lands, and for other Purposes.
[20th August 1853.]

HERE AS there is a large Tract of Waste Lands, Mud
Banks, or Slobs adjacent to the Town of Harwich in the
County of Essex, and lying between the said Town and
Ray Island in the Parish of Ramsey in the said County: And whereas
it would tend greatly to the Prosperity of the said Town and to the
public Advantage if certain Portions of the said Lands were reclaimed,
and if on Part of the said Lands or near or adjoining thereto a Dock,
Pier, and other Works were constructed: And whereas a Plan and
Section of the proposed Works showing the Situation andLevels
thereof,
and also a Book of Reference containing the Names of the Owners or
reputed Owners, Lessees or reputed Lessees, and Occupiers of the
Property upon or through which the Works will be made, have been
deposited with the Clerk of the Peace for the said County of Essex :
And whereas by " The Harwich Improvement Quays and Pier Act,
1851,"
the Mayor, Aldermen, and Burgesses of the Borough of Harwich

The Harwich Dock and Pier Act, 1853.
(herein-after referred to as the Corporation) are empowered to con-
struct a Pier, Quays, and other Works at Harwich, and to embank
Part of the Foreshore of the Harbour there: And whereas some of the
Powers hereby conferred may be considered as an Extension of and
might possibly clash with certain of the Rights and Authorities
granted to the Corporation by the said Act; and it is expedient that
the Corporation should be empowered to contract and agree with the
Company by this Act incorporated touching these Powers: And
whereas the Eastern Union Railway Company are authorized to con-
struct a Pier at Harwich, which would be rendered needless by the
Construction of the Pier and the Works connected therewith by this
Act authorized; and it is expedient that the said Railway Company
should be enabled to agree for the Substitution of the said last-men-
tioned Works for those which they as aforesaid have Power to con-
struct : And whereas the several Persons after named, with others, are
willing, at their own Expense, to reclaim the said Lands, and to con-
struct the said Dock, Pier, and other Works ; but they cannot do so
without the Authority of Parliament: May it therefore please Your
Majesty that it may be enacted; and be it enacted by the Queen's
most Excellent Majesty, by and with the Advice and Consent of the
Lords Spiritual and Temporal, and Commons, in this present Parlia-
ment assembled, and by the Authority of the same, as follows; that
is to say,

I. The several Acts of Parliament following, (that is to say,) " The

A**: Provided always, that it shall not be necessary for the Company
to provide and maintain a Life Boat or Tide Gauge until so required
by the Lord High Admiral of the United Kingdom of Great Britain
and
Ireland,
or the Commissioners for executing the Office of Lord
High Admiral aforesaid; but upon such Requirement being made in
Writing under the Hand of the Secretary of the Admiralty, then the
Clauses in "The Harbours, Docks, and Piers Clauses Act, 1847,"
with respect to Life Boats, and keeping a Tide and Weather Gauge,
shall come into and be in full Force and Effect, and be incorporated
with and form Part of this Act.

"Quarter II. The Expression "Quarter Sessions" in this Act and all Acts
Sessions. incorporated herewith shall mean the Quarter Sessions for the County
of Essex holden at Chelmsford.

Short Title, III. In citing this Act it shall be sufficient to describe it as " The
Harwich Dock and Pier Act,
1853."
