in
the 'West Riding
of
the County
of
York;
and
to amend the Act relating to the
said
Navigation. [31st

HEREAS
an Act was passed in the Ninth Year
of
the
9G.3.c.71.
Reign
of
His
'
late Majesty King
George
the Third,
intituled,
An
Act
for
extending the Navigation
of
the
River
Calder
to
Salterhebble Bridge,
and to
Sowerby Bridge,
in
the
County
of
York
;
and
for
repealing- an Act
for
that
Purpose
;
reciting
that great Damages had been done
to
the said Navigation
by
the
Violence
of'
repeated Floods, and that the Commissioners therein
named could not raise Money to make the Navigation good again,
no Person being willing to lend Money under the then existing Cir-
cumstances, upon such Security as the Commissiohers were em-
powered
to
give by virtue of'the Act then in force,
SO
that
all those
who had advanced Money
for
making the said Navigation were likely
to
lose their Money
so
advanced,
to
the great Discouragement
of
all
Persons
willing
to
engage
in such
wefill
Undertakings,
and
that

the
Public were in great Danier
of
losing the Benefit
of
such
Navi-
gation, unless some further Provision should be made by Law
for
restoring, completing, and maintaining the same
;
it was therefore
enacted, that certain Persons therein named, being the Persons
who had advanced the Money
so
borrowed
on
the Credit of the
said
first-mentioned Act, or such
of
them as were then living, their several
and respective Executors, Administrators, and Assigns, and the
several and respective Executors, Administrators, and Assigns, or
other personal Representatives
of
such
of
them as were then dead, and
their several and respective Executors, Administrators, and Assigns,
together
with
such other Person or Persons as was, or were, or there-
after should be possessed of One or more Share or Shares of and
in
the
said Navigation were united into a Company, and incorporated
by the Name
of
The Company
of
Proprietors
ofthe
Calder
and
Hebble
Navigation,
for making, completing, and maintaining the said Navi-
gation, and the several Works necessary for carrying the said Act
into Execution
;
and the said Company
of
Proprietors were thereby
authorised to raise and contribute amongst themselves,
or
by
the Ad-
mission of new Proprietors, by voluntary Subscriptions and Contri-
butions, such competent Sums of Money for making, completing,
and
maintaining the said Navigation, and other the Purpo~es of the
Act,
as the said Company of Proprietors at any General Meeting should
order and direct
;
and the said Company of Proprietors, their Suc-
cessors, and Assigns are authorised from Time to Time to assign over
any Part of the Rates or Duties arising by virtue of the Act
as
a
Security for any
Sum
or Sums
of
Money not exceeding
in
the whole
the
Sum
of Twenty thousand Pounds
to
be borrowed
with
Interest
not exceeding Five Pounds
per Centzcm per Annum,
as
a
Security for
any Sum or Sums of Money to be
so
lent and advanced to the Person
or
Persons who should advance the same, and the Act then in force
is
thereby repealed: And whereas the said Rivers were
in
pur-
suance
of
the said recited Act
of
the
Ninth Year of the Reign
of'
19s

late
Majesty,
restored and made navigable some time after
the
passing thereof, and have since been kept and continued navigable
for
Baits,
Barges, Lighters, and other Vessels
;
and great Advan-
tages..have arisen therefrom to the Trade
and
Commerce
of'
the
Country, and the same hath tended materially to the Encourage-
ment, and Increase
of
the Woollen Manufacture: And whereas
$he
said
Calder
and
Hebble
Navigation is still capable
of
further
Improvement, and by Surveys lately made and Levels taken, it
appears
that
a
navigable Cut or Canal may be made from and out of
the Cut belonging to the said Navigation at
Salterhebhle
Bridge
aforesaid, in the Township
of
Skircoat,
in
the
Parish
of'
IrlTnZ$hx,
in
the
West Riding
of
the County of
York,
to a certain Place called
Bailey
Hall?
in
the
Township
of
Southowam,
near the said Town
of'HaZ$m,
in the said County
of'
York
:
And whereas by the making
of
such navigable
Cut
or Canal
a
more easy, cheap, and expedi-
tious
Means will be afforded for the Conveyance
of'
Goods, Wares,
and Merchandize between the Town and Neighbourhood
of'
Hal$m
and
the
populous and manufacturing Towns
of
Leeds, Wakglield,
Huddergeld,
Rochdale,
Mancheste?;
and other Places,
within
the
Counties
of
York
and
Lancaster
;
and the same will otherwise
be
of
great public Utility
:
And whereas
it
is expedient that some
of'
the

the Provisions and Regulations of' the said recited Act should be
re.

pealed and others amended
:
May
it
therefore please
Your
Majesty
may
make
that
it may be enacted; and
be
it
enacted by the King's most
Excellent Majesty, by and with the Advice and Consent
of'
the
Lords Spiritual and Temporal, and Commons, in this present Par-
Iiatnent assembled, and by the Authority of the same, That it shall
and may be lawful to and for the said Company of Proprietors ofthe
calder
and
Hebble
Navigation in the West Riding
of
the County
of'
York
;
and they are hereby fully authorized and empowered at
their own Costs and Charges, by themselves and their nepnties,
Ag.ents, Officers, Servants, and Workmen, to make, complete, and
maintain
a
Cut or Canal, navigable and passable for Boats, Barges,
and other Vessels from and out ofthe said Cut, made under and by
virtue
of'
the Powers and Authorities contained
in
the said last men-
tioned Act at
Salterhebble
aforesaid, in the Township
of
Slcircoat,
in
the
Parish of
Hulgax,
in the West Riding
of
the County of
Yorlc,
in,
through, and into the several Townships
of'
Skircoat, Southomam,
and
Hal$ax,
all in the Parish of
Halgax,
in
tlie
West Riding
of
the
County of
York,
to a certain Place called
Bailey Hall,
in the Town-
ship
of'
Southowram
aforesaid, near to the said Town of
Halijkr;
and also to supply the said intended Canal or Cut at all Times for
ever, while making, and after the same shall be made with Water
from such Springs,
Ponds,
Pits, and Watercourses,
as
shall be found
in digging or making the said Cut, Canal, Tunnel and other Works,
and also from and out
of
the Cut, Canal, or Basin, belonging to the
said Company, at or near
Salterhebble Bridge
aforesaid, by Means
of
a
Tunnel, Culvert, or Drain, to be made underground in a level Direction
with the said
Cut,
Canal, or Basin at
Safterhebbk Bridge
aforesaid, and
from the same to an Engine, Pit, or Shaft, to be made near
Bat'ley
HaR
aforesaid, and the Summit Level of the said intended Canal
at
which
Place, or at some other convenient Place upon the said Summit Level,
the Water in the said Company's Cut, Canal,
or
Basin, at
Sulkrhebble
Bridge,
when conveyed as aforesaid, will be raised up to the Summit
Level of the said Canal, hereby authorized to be made by the Applica-
tion of a Steam Engineor Engines, orotherPower, andone or more Pump
To
make
or Pumps for that Purpose
:
And also to make, sink, and drive
the
said
Tunnels,
scc.
Tunnel, Culvert, or Drain, and such andso many Wells, Soughs, Culverts,
erect Steam
Tunnels, Pits, Levels, Perforations, Feeders, Bridges, and Aqueducts,

and to make, erect, and set up such and
so
many Weirs, Steam Engines,
Water-wheels, and other Machines, with proper Shafts and Tunnels
thereto for supplying the said Canal with Water fiom and out ofthe
said Company's Canal or Basin at or near
Salterhebble Bridge
afore-
said, and for conveying Water
to
or fiom the same for the Purpose
of Navigation, or for any other Purpose necessary for the better making
and maintaining
of'
such Canal, as the said Company of Proprietors,
their Successors and Assigns shall

and expedient, and also for effectuating
the
Purposes of this Act,

Brooks, Streams,

shall
be
situate within the Line or Track

the said intended Canal,

or
otherwise obstruct the
making
of the said Canal, and for the Purposes aforesaid, or any of them,
the
said Company
of'
Proprietors, their Successors and Assigns, and
their
Canal.
