An Act to confer further powers upon the mayor,
aldermen and burgesses of the borough of Bournemouth
in relation to lands and the health, local government,
improvement and finances of the borough; and for
other purposes. [5th August 1971]
V17HEREAS-
(1) The borough
of
Bournemouth
is a
county borough under
the
government
of
the mayor, aldermen
and
burgesses
of
the said
borough (in this
Act
called
"
the Corporation "):
(2)
It is
expedient that further provision should
be
made
with
reference to lands and the health, local government, improve-
ment
and
finances
of the
borough
and
that
the
powers
of the
Corporation in regard thereto should be enlarged and extended as
m this
Act provided:
(3)
It is
expedient that
the
other provisions contained
in
this
Act be enacted:
(4)
The
purposes
of
this
Act
cannot
be
effected without
the
authority
of
Parliament:
(5)
In
relation
to the
promotion
of the
Bill
for
this
Act the
requirements
of
Part
XIH of the
Local Government
Act
19331933

May it therefore please Your Majesty that it may be enacted
and be it enacted, by the Queen's most Excellent Majesty,
by and
with the advice and consent of
the
Lords Spiritual and Temporal,
and Commons, in this present Parliament assembled, and
by
the
authority of
the
same, as follows, that is to say:
PART
I
PRELIMINARY
1.—(1)
This Act may be cited as the Bournemouth Corporation
Act 1971.
(2) The Bournemouth Corporation Act 1969 and this
Act may
be cited together as the Bournemouth Corporation Acts
1969 and
1971.
2.
This Act is divided into Parts as follows:
Part I.—Preliminary.
Part II.—Lands.
Part III.—Parks.
Part IV.—Public order and public safefy-
Part V.—Public health.
Part VI.—Hackney carriages, etc.
Part VII.—Superannuation.
Part VIIL—Finance.
Part IX.—Miscellaneous.
Part X.—General.
Interpretation.
3.—(1)
In this Act the several words and expressions to which
meanings are assigned by section 343 of the Act of
1936 have the
same respective meanings, unless there be something
in
the subject
or context repugnant to such construction.
(2) In this Act unless the subject or context otherwise requires
" the Act of
1933
" means the Local Government Act 1933;
" the Act of 1936 " means the Public Health Act 1936;
" the Act of 1946 "
means the
Acquisition of Land (Authorisa-
tion Procedure) Act 1946;
" apparatus " means any
mains,
pipes or other apparatus
and
electric lines and works (as respectively defined in the
Electric Lighting Act 1882) and telegraphic lines (as
defined in the Telegraph Act 1878) belonging to or
maintained by a statutory undertaker and includes any
structure or works for the lodging therein of apparatus;

"the appointed day" has the meaning assigned to that PART I
expression by section
70
(The appointed
day)
of this Act; —com.
"
the
borough " means the borough of Bournemouth;
" bulk refuse container " means a container of not less than
1 cubic yard nominal capacity for refuse designed or
adapted to be emptied by mechanical means into a
refuse vehicle of the Corporation or to be removed by a
vehicle of the Corporation for emptying;
"contravention" includes a failure to comply and
" contravene " shall be construed accordingly;
"
the
Corporation "
means
the mayor, aldermen and burgesses
of
the
borough;
" the council" means the council of the borough;
" daily
fine
" means a fine for each day on which an offence
is continued after conviction therefor;
" enactment" includes an enactment in this Act or in any
general or local Act and any order, byelaw or regulation
for the time being in force within the borough;
"magistrates' court" has the same meaning as in the
Magistrates' Courts Act 1952;

" Minister of the Crown " has the same meaning as in the
Ministers of the Crown (Transfer of Functions) Act
1946;

" operational land ", in relation to the Post Office, has the
same meaning as in sub-paragraph (4) of paragraph 93
of Schedule 4 to the Post Office Act 1969 and means,
1969

in relation to statutory undertakers (other than the
Post Office), land which is used for the purpose of the
carrying on of their undertaking and land in which an
interest is held for that purpose, not being land which,
in respect of its nature and situation, is comparable
rather with land in general than with land which is
used, or in which interests are held, for the purpose of
the carrying on of statutory undertakings;
" public service vehicle " has the meaning assigned to that
expression by section 117 of the Road Traffic Act 1960;

" the railways board " means the British Railways Board;
" statutory undertakers " means persons authorised by any
enactment to carry on any undertaking for the supply
of electricity, gas or water, and includes the Post Office;
" the town clerk " means the town clerk of the borough.
(3) Any reference in this Act to any enactment shall be con-
strued as a reference to that enactment as applied, extended,
amended or varied by or by virtue of any subsequent enactment
including this Act.
