CHAPTER xx
An
Act to confer further powers upon the mayor aldermen
and burgesses of the borough of Blackpool and to make
further provision for the improvement health and
local government of the borough and for other
purposes. [7th July 1958.]
V¥7HEREAS
(1) The borough of Blackpool is a county borough under the
government of the mayor aldermen and burgesses thereof
(in
this
Act called " the Corporation "):
(2) It
is
expedient to confer further
powers
upon
the
Corporation
and to make further provision with reference to the improvement
health and local government of the borough:
(3) In order to prevent serious danger at a point in the borough
where six highways (including Arnott Road) meet it is necessary
to make provision as in this Act contained for partly stopping up
that road for the traffic other than pedestrians and for that
purpose to empower the Corporation to execute the street
improvement referred to in this Act:
(4) Blackpool Pleasure Beach Limited (in this Act called
" the company ") are the owners of certain land in the borough
which is used by them as a pleasure beach amusement park and
for similar purposes and by virtue of a number of agreements
made between the Corporation and the company which have
been confirmed by Parliament the company are exempt from
certain obligations in respect of that land including the obligation
to deposit plans of temporary or movable buildings or structures
under the building byelaws and the obligation to obtain the
consent of the Corporation to the erection

(5) By an agreement dated the fourth day of October nineteen
hundred and
fifty-seven
and made between the Corporation and
the company provision is made for exempting the company
their successors and assigns from the obligation to obtain the
permission of the Corporation to the erection of temporary or
movable buildings or structures on the said land:
(6) It is expedient that the agreement should be amended and
as so amended should be confirmed as by this Act provided:
(7) A copy of the agreement as so amended is set forth in the
First Schedule to this Act:
(8) It is expedient that the other provisions contained in this
Act be enacted:
(9) The purposes of this Act cannot be effected without the
authority of Parliament:
(10) An estimate has been prepared by the Corporation for and
in connection with the following purpose:
The construction of the street improvement
authorised by this Act and works in
connection therewith £1,026
(11) The work included in such estimate is a permanent work
and it is expedient that the Corporation be empowered to borrow
money for that purpose as provided by this Act:
(12) In relation to the promotion of the Bill for this Act the
requirements of Part XIII of the Local Government Act 1933
have been observed:

A
plan and sections showing the lines and levels of
the work
authorised by this Act and showing the lands required or which
may be taken for the purposes or under the powers of this Act
and also a book of reference containing the names of the owners
and lessees or reputed owners and lessees and of the occupiers of
those lands were duly deposited with the town clerk of the borough
which plan sections and book of reference are in this Act referred
to respectively as the deposited plan sections and book of
reference:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say):

(2) The Blackpool Corporation Acts 1853 to 1952 and this PART I
Act may be jointly cited as the Blackpool Corporation Acts —cont.
1853 to 1958.

This Act is divided into Parts as follows:
Part I.—Preliminary.
Part II.—Partial closing of Arnott Road.
Part III.—Streets buildings and sanitation.
Part IV.—Premises used for sales by auction.
Part V.—Miscellaneous.
Part VI.—Finance.
Part VII.—General.

The Lands Clauses Acts (so far as the same are applicable Incorporation
for the purposes of and are not varied by or inconsistent with this Sf LandsA
Act) are hereby incorporated with and form part of this Act with aauses Acts-
the following exceptions and modification:
(a) section 92 and sections 127 to 132 of the Lands Clauses
Consolidation Act 1845 are not incorporated with this
Act;
(b) the bond required by section 85 of the Lands Clauses
Consolidation Act 1845 shall be under the corporate
seal of the Corporation and sufficient without the
addition of the sureties mentioned in that section.
4.—(1) In this Act the several words and expressions to which Interpretation.
meanings are assigned by sections 90 and 343 of
the
Public Health
Act
1936
have the same respective meanings unless there be some-
thing in the subject or context repugnant to such construction.
(2) In this Act unless the subject or context otherwise
requires
" the Act of 1933 " means the Local Government Act 1933;
" the Act of 1936 " means the Public Health Act 1936;
" the Act of 1947 " means the Town and Country Planning
Act 1947;
" the appointed day " has the meaning assigned to it by
section 48 (The appointed day) of this Act;
" the borough " means the borough of Blackpool;
" the commission " means the British Transport Commission;
" the company " means Blackpool Pleasure Beach Limited;
"contravention" includes a failure to comply and
" contravene " shall be construed accordingly;
" the Corporation" means the mayor aldermen and
burgesses of the borough; 3
