CHAPTER cxvi.
An Act to empower the Aberystwyth Rural District
A.D.
1937.
Council to acquire the reservoir known as Llyn- —
Craig-y-pistyll and to construct waterworks to
make further provision in regard to their water
undertaking and the local government of their
district and for other purposes. [30th July 1937.]

HEREAS in the exercise of their powers under the
Public Health Act 1875 and the Acts amending 38
&
39 Vict.
the same the Aberystwyth Rural District Council (in

this Act referred to as "the Council") are supplying
water in various parts of their district:
And whereas in or about the year eighteen
hundred and seventy-seven a reservoir known as
Llyn-Craig-y-pistyll was provided by the construction
of an embankment across the Afon Leri and it is
expedient to empower the Council to acquire that
reservoir for the supply of water within their district
and to construct further waterworks :
And whereas it is expedient to confer further
powers upon the Council with respect to the supply
of water and to authorise them to carry on their
several water undertakings as one undertaking and
to make provision in regard to the expenses thereof
as in this Act contained :

1937. And whereas it is expedient to make further
— provision with regard to the health local government
and improvement of the district:
And whereas it is expedient that the other
provisions contained in this Act be enacted:
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by the
Council for the purposes hereinafter mentioned and
such estimates are as follows :—
For the purchase of lands and easements £
for the purposes of this Act - - 6,370
For the construction of the works
authorised by this Act - - - 45,380
And whereas the several works included in such
estimates are permanent works and it is expedient that
the cost thereof should be spread over a term of years :
And whereas in relation to the promotion of the
Bill for this Act the requirements of Part XIII of the
23 &
24 Local Government Act 1933 have been observed:
And whereas plans and sections showing the lines
and levels of the works authorised by this Act and
also a book of reference containing the names of the
owners and lessees or reputed owners and lessees and
of the occupiers of the lands required or which may
be taken for the purposes or under the powers of this
Act were duly deposited with the clerk of the county
council of the administrative county of Cardigan which
plans sections and book of reference are in this Act
respectively referred to as the deposited plans sections
and book of reference :
May it therefore please Your Majesty that it may
be enacted and be it enacted by the King's most
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons
in this present Parliament assembled and by the
authority of the same as follows :—

1.—(1)
This Act may be cited as the Aberystwyth

(2) This Act shall come into operation on the A.D. 1937.
first day of October nineteen hundred and thirty-seven —
except where otherwise provided and except the PAB,T I-
provisions thereof relating to the acquisition of lands ~~cont'
and the construction of waterworks which shall come
into operation on the passing of this Act.

Subject to the provisions of this Act the Application

The following Acts and parts of Acts (so far Incorpora-

(1) The Lands Clauses Acts with the following
exceptions and modification :—
(a) Sections 127 to 132 of the Lands 8&9Vict.
Clauses Consolidation Act 1845 are not c-18.

(b) The bond required by section 85 of
the Lands Clauses Consolidation Act 1845
shall be sufficient without the addition
of the sureties mentioned in that section :
(2) The provisions of the Waterworks Clauses

Act 1847 which are incorporated with the c. 17.
Act of 1936 and in addition thereto—
Sections 6 to 15 with respect to the
construction of the waterworks;
Sections 16 and 17 with respect to the
construction of works for the accommodation
of lands adjoining the waterworks;
Sections 18 to 27 with respect to mines :
(3) The Waterworks Clauses Act 1863 except
26 & 27

(4) The provisions of the Railways Clauses Consoli-

dation Act 1845 with respect to the temporary c- 20-
occupation of lands near the railway during
the construction thereof and in such provisions
for the purposes of this Act "the railway"
means the waterworks authorised by this Act
and " the centre of the railway " means the
centre of such waterworks respectively.
