CHAPTER cxxix.
An Act to extend the municipal and police boundaries of A.D. 1909.
the burgh of Greenock to consolidate the local Acts and
Orders relating to that burgh to confer further powers
on the provost magistrates and councillors thereof and
for other purposes. ' [16th August 1909.]

HEREAS the burgh of Greenock (hereinafter called "the
burgh ") in the county of Renfrew is under the government
for municipal purposes of the provost magistrates and councillors
thereof (in this Act called "the Corporation"):
And whereas by the Town Councils (Scotland) Act 1900
(section 8) it was enacted that in any burgh the whole rights
powers authorities duties liabilities debts officers and servants
(a) of commissioners under the Burgh Police (Scotland) Act 1892
and (b) of any body of police gas or water commissioners con-
sisting exclusively of members of the town council and (c) of the
burgh local authority under the Public Health (Scotland) Act
1897 and the whole lands works and other assets vested in them
respectively should in so far as that had not already been effected
be transferred to imposed on and vested in the town council
constituted under that Act:
And whereas by the Greenock Police Act 1877 the board of
police of Greenock (in this Act called " the board of police ") was
incorporated as the police gas cleansing lighting street and sewer
formation tramway public parks and sanitary authority of the
burgh:
And whereas under the Greenock and Shaws Water Transfer
Act 1866 the Greenock Water (Additional Works) Act 1866 and
the Greenock Water Acts 1869 and 1875 the water trust of
Greenock (in this Act called "the water trust") was incorporated

1909. under that name to manage the then existing undertaking for
~ the supply of water to Greenock to acquire the undertaking of the
Shaws Water Joint Stock Company and to construct additional.
waterworks and consisted exclusively, of members of the town
council:
And whereas in the year 1877 by an Act intituled "An Act
" to confirm a Provisional Order of one of Her Majesty's Principal
" Secretaries of State for the improvement of unhealthy areas in
" the Parliamentary Burgh of Greenock" a scheme made under
the Artizans and Labourers Dwellings Improvement (Scotland)
Act 1875 was confirmed:
And whereas by the Greenock Street Tramways Act 1871 the
board of police was authorised to construct and work street
tramways in the burgh and the said tramways so far as con-
structed are leased to and worked by the Greenock and Port
Glasgow Tramways Company under and by virtue of the powers
contained in the Greenock and Port Glasgow Tramways Acts
1887 and 1899 and the Greenock and Port Glasgow Tramways
Order 1902
And whereas under the Roads and Bridges (Scotland) Act
1878 the burgh local authority under that Act was declared to he
the local authority having the control and management of the
streets of any burgh arid such control and management has been
vested in and exercised by the board of police since the date of
the passing of the said Act:
And whereas the board of police was authorised to supply
electricity within the- burgh under the Greenock Electric Lighting
Order 1883 and the Corporation are supplying the same:
And whereas doubts having arisen as to the effect of the.
Town Councils (Scotland) Act 1900 it was provided by the
Greenock Corporation Order 1901 that the Corporation should
be the sole authority for all the purposes theretofore under the
control of the board of police and the water trust respectively
anything in the local Acts relating'to the burgh to the contrary
notwithstanding:
And whereas it *is.expedient to. extend the boundaries of the,
burgh to include certain portions of the county of Renfrew lying
contiguous to the burgh:
- And whereas there are in force in the burgh the local Acts
and Orders set forth in the First Schedule to this Act relating to:
the improvement and.local government of the burgh including the:

supply, of gas water and electricity the construction and/working A.D. 1909./
e£ tramways and other matters; -..•-:
. And whereas many of the provisions of those Acts have been ;
superseded by subsequent legislation and ought to be .repealed.
and it would be of local and public advantage if certain of their
provisions were subject to amendments and additions consolidated
in one Act:
And whereas the sums of money borrowed or authorised to
be borrowed by the Corporation for the purposes of those Acts
and Orders and the portions of such sums remaining to be paid
off are set forth in the Ninth Schedule to this Act:
And whereas the Corporation have borrowed and expended
the sum of twenty thousand pounds on the provision and erection
of a dust destructor and doubts have arisen as to the power of
the Corporation so to do'and it is expedient, to remove such
doubts:, ,' '

And whereas it is expedient to authorise the Corporation to
borrow further money for the provision and equipment of baths
and wash-houses and the general purposes of this Act:
And whereas it is expedient to confer upon the Corporation
the further and better powers contained in this Act in relation
to the financial municipal police public health and other admini-
stration of the burgh and to the gas water and electrical
undertakings of the Corporation:
And whereas Sir Michael Hugh Shaw Stewart has bestowed
the gift of five thousand pounds upon the burgh upon the con-
ditions that the said sum shall be invested by the Corporation
and the produce thereof applied to the furtherance of the well-
being of the burgh and it is expedient to provide accordingly:
And whereas the purposes aforesaid cannot be effected without
the authority of Parliament:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows :
