said late Majesty, intituled

Act
for
making and maintaining a

vigable Canal from
the
Wilts
and
Berks
Canal, in the Parish
of
Swindon,
in
the
County
of
Wilts,
to
conniunicate with the
Thames
and
Severn
Canak
in
the Parish
of
Latton,
in
the
same County,
whereby certain Persons
therein named and described were united into
a
Company for carrying
on, making, completing and maintaining the said Canal,
by
the Name and
Style
of
'l'he
Company of Proprietors
of
the
iVortb

Canal Naviga-
tion,' in perpetual Succession,
with
a Common Seal
:
And
whereas by the
said Act
of
the Thirty-fifth Year
of
the Reign
of
His
said
late Majesty,
the
said Company
of
Proprietors thereby formed, were authorized and
empowered, from and after the passing
of
such
Act,
by
themselves,
or
by
their Deputies, Agents, Officers, Workmen
or
Servants, to make and
keep
navigable and passable, for Boats, Barges and other Vessels, a Canal
from
the
River
Thames
or
Isis,
at
or
near the
Town
of
Abingdon,
in the
County
of
Berks,
through or near the Towns
of
Wantage, Swindon,
Wootton
Bassett, Chippenham,
and
Melkshrrm,
to
join and communicate with
the
Canal then making or about
to
be made
from
the River
Kennet
to
the
River
Avon,
at
or near the Town
of
Trowbridge,
in the County
of
Wilts;
and also a Navigable Cut
or
Branch
out
of and from the first-mentioned
Canal, in or near a Field called or known
by
the Name
of
The
Breach
Field,
in the Hamlet
of
Grove,
in the Parish
of
Wantqge,
in the said
County
of
Berks,
to or near to the Town of
Wantage,
in the same County;
and also another Navigable Cut
or
Branch out of and from the same
Canal, in or near a Field called or known by the Name
of
The Ploughed
Field,
in the Parish
of
Brimhill,
in rhe said County
of
Wilts,
in
the Qccu-
pation
of
Jacob Gaby,
to or near to the Town of
Calne,
in the same County;
and
ab
another Navigable Cut
or
Bvanch out
of
and from the same
Canal
at
and in a Close of Ground in the Parish
of
Chippennbnm,
in the
said County
of
Wilts,
called
or
known by the Name
of

Middle
Ground,
in
the
Occupation
of
John Lawes,
to
or
near to the
Town
of
Chip-
penham,
in the same County; and
to
supply the said Canal and
Cuts
respectively, whilst the Same should be making, and at all Times for ever
after
the same
should
be
made,

Water

all such Springs as should
he
found
in
making
the
same,

from
all
Rivers, Springs, Brooks,

and for that Purpose to cleanse,
scour, deepen, enlarge
or
straighten any such Rivers, Brooks, Streams
or
Watercourses,
or
any others which might come or be brought into
the
same respectively
;
and also to make One or more Reservoir
or
Reser-
voirs for the Purpose
of
supplying the said Canal and Cuts,
or
any Part
thereof, with Water, and to make such and
so
many Feeders and Aque-
ducts, and to make, erect, and set up such and
so
many Weirs, Steam
Engines, and other Machines, with proper Shafts and Tunnels therete,
for
supplying the said Canal and Cuts and Reservoirs with Water,
and
for conveying Water from any such Reservoir or Reservoirs to the said
Canal and Cuts, or any Part thereof respectively, or for any other Purpose
necessary for the better making and maintaining
of
such Canal and Cuts
respectively, as they the said Company
of
Proprietors should from Time
to
Time think proper and expedient
;
and for the several Purposes afore-
said the said Company
of
Proprietors, and their Deputies, Agents, Officers,
Workmen and Servants were thereby authorized and empowered to enter
into and upon the Lands and Grounds
of
or belonging to any Person
or
Persons, Bodies Politic, Corporate, or Collegiate whatsoever, and to survey
and take Levels
of
the same, or any Part thereof, and to set
out
and
ascertain such Part or Parts thereof
as
they the said Company
of
Pro-
prietors should think necessary and proper for the making, completing,
maintaining, improving and using
of
the said Canal and Cuts, and other
Works and Conveniencies thereby authorized to be made, and there to
bore, dig, cut, trench and sough, and also to remove, carry away and
take any Earth, Clay, Stone, Soil, Rubbish, Trees, Roots
of
Trees, Beds
of
Gravel or Sand, or any other Matters or Things whatsoever, which
should or might be dug or got in the making, or which might hinder,
prevent, or obstruct the making, carrying on, maintaining
or
repairing
of
the
said Canal and Cuts, Reservoirs and other Works respectively, or
of
such Feeders, Trenches, Passages, Aqueducts and Watercourses as should
or might be necessary and proper
to
convey Water to or from the said
Canal and Cuts and Reservoirs respectively, according to the true Intent
and Meaning
of
such Act
;
and
also
to
make, build, erect, or set up, in
or upon the said Canal and Cuts respectively, or in or upon the Lands
adjoining
or
near thereto respectively, such and
so
many Bridges, Tunnels,
Soughs, Aqueducts, Sluices, Locks, Floodgates, Weirs, Pens for Water,
Waterstanks, Reservoirs, Drains, Wharfs, Quays, Toll-houses, Ware-
houses, Watch-houses, Landing-places, Weighing-beams, Cranes, Dry
Docks, Fire Engines,
or
other Machines,
Ways,
Roads and Conveniencies,
as and where they the said Company
of
Proprietors should think requisite
and
convenient, and
from
Time to Time
to
alter, repair, and amend
or
discontinue the same
or
any
of
them,
as
should be thought expedient and
useful
for
the Purposes of the
satid
intended Navigation, and for
the
carrying and conveying
of
Goods,
Wares, Mefchandizes, and
other
Things to
qnd
from
the said
Canal
and Cuts respectively,
anti
for the
carrying
arid
conveying
of
all
Manner
of
Material; necessary for the
making, erecting, finishifig, altering, repairing, amending, widening,
or
darging
of
the
said
Canal
and
Cuts,
and other Works respectively, and
to
place,
lay,
.work,
or
manu[acture
any
Materials
on
the Lands
OF
Grounds
