Urban District Council Act, 1934.
CHAPTER xciv.
An Act to empower the urban district council of
A.D.
1934.
Weston-super-Mare to construct waterworks and
execute street improvements and to acquire
lands for those and other purposes to confer
upon them further powers with respect to their
water undertaking to make further provision
for the improvement health good government
and finance of their district and for other
purposes. [31st July 1934.]

HEREAS the urban district of Weston-super-
Mare in the county of Somerset (in this Act called
" the district ") is an urban sanitary district within the
meaning of the Public Health Act 1875 and an urban
district within the meaning of the Local Government
Act 1894 and is under the management and control of
the urban district council of Weston-super-Mare (in
this Act called " the Council "):
And whereas the Council are the owners of a water
undertaking and under statutory authority supply water
in the district and certain parishes and places adjacent
thereto in the county of Somerset:
And whereas it is expedient that the Council should
be empowered to construct the waterworks described in
this Act and that such further powers with reference
to the said water undertaking as are contained in this
Act should be conferred upon the Council:

And whereas it is expedient that the Council should
be empowered to execute the street works described in
this Act:
And whereas it is expedient that the Council should
be authorised to acquire lands for the purposes of the
said waterworks and street works and for other purposes :
And whereas it is expedient that the Council should
be authorised to acquire the ancient monument known
as " Worlebury Camp " and also lands in the district
forming part of " Weston Woods " for the preservation
of the amenities of the district and its neighbourhood:
And whereas it is expedient that further and better
provisions should be made for the improvement health
and local government of the district and that the powers
of the Council in regard thereto should be enlarged as
in this Act provided :
And whereas it is expedient that the provisions with
regard to the finances of the district which are contained
in this Act should be made and that the Council should
be empowered to borrow money for the purposes of this
Act:
And whereas it is expedient that the other
provisions contained in this Act should be enacted :
And whereas the objects of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by the
Council of the expense of the works hereinafter mentioned
and such estimates are as follows : £
For the construction of waterworks ... 130,000
For the execution of street works ... 7,000
And whereas the several works included in such
estimates are permanent works and it is expedient that
the cost thereof should be spread over a term of years :
And whereas plans showing the lands required or
which may be taken or used compulsorily for the pur-
poses or under the powers of this Act such plans showing
the lines or situations of the works authorised by this
Act and sections showing the levels of such works with
a book of reference to such plans containing the names
of the owners and lessees or reputed owners and lessees
and of the occupiers of the said lands were duly deposited

with the clerk of the county council of Somerset and A.D. 1934.
are in this Act respectively referred to as the deposited
plans sections and book of reference :
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough Funds
Acts 1872 and 1903 have been observed :
May it therefore please Your Majesty that it may
be enacted and be it enacted by the King's most Excellent
Majesty by and with the advice and consent of the Lords
Spiritual and Temporal and Commons in this present
Parliament assembled and by the authority of the same
as follows (that is to say) :

This Act may be cited as the Weston-super-Mare Short title.

This Act is divided into Parts as follows : Act divided

grounds.
Part X.—Knightstone Bay and Uphill
Wharf.
Part XI.—Finance.
Part XII.—Miscellaneous.

The following Acts (so far as the same are Incorpora-
applicable for the purposes and are not inconsistent tionof
Acts.
with the provisions of this Act) are hereby incorporated
with this Act (that is to say) :
(1) The Lands Clauses Acts with the following
exception and modification (namely):
{a) Section 127 of the Lands Clauses Con-
solidation Act 1845 (relating to the sale of
