CHAPTER xlii.
An Act to authorise the Commissioners of the Port and
A.D.
1919.
Harbour of Waterford to levy rates on goods to
provide for the appointment of the chairman and
vice-chairman of the Commissioners to confer further
powers on the Commissioners and to amend their
existing Acts and for other purposes.

HEREAS by an Act of the ninth and tenth years of the
reign of Queen Victoria chapter two hundred and ninety-
two intituled "An Act for improving preserving maintaining
" and better regulating the port and harbour of Waterford and
" for other purposes relating thereto" (in this Act called "the
Act of 1846") the persons therein mentioned were constituted
Commissioners for the purposes of that Act with perpetual
succession by the name and style of "The Commissioners for
improving the port and harbour of Waterford" (hereinafter in
this Act called "the Commissioners"):
And whereas by the Waterford Harbour (Dry Dock) Act
1868 and the Waterford and New Ross Harbours Act 1874
further powers were conferred on the Commissioners:
And whereas by the Waterford Harbour Order 1904 the
limits of the port and harbour were extended and further pro-
vision was made with respect to tonnage rates dues and charges:
And whereas the revenues of the harbour are insufficient
for its efficient administration and maintenance and it is expedient
that the Commissioners should be entitled to levy the rates and
charges by this Act authorised:
And whereas it is expedient that the further powers con-
tained in this Act should be conferred on the Commissioners:

And whereas the objects of this Act cannot be effected
without the authority of Parliament:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say):

This Act may be cited as the Waterford Harbour Act
1919.
2.
The following Acts and portions of Acts so far as the
same are applicable and are not varied by or inconsistent with
the provisions of this Act are incorporated with and form part
of this Act (that is to say) :-
(1) The provisions of the Harbours Docks and Piers Clauses
Act 1847 with respect to the following matters (that
is to say):
With respect to the construction of this Act and
any Act incorporated therewith;
With respect to the construction of warehouses
wharfs and other conveniences;
With respect to the collection and recovery of
rates;
With respect to the accounts to be kept of the
rates and of the vessels in respect of which they
are payable;
With respect to the discharging of vessels and the
removal of the goods;
With respect to the protection of the harbour dock
and pier and the vessels therein from fire and
other injury;
With respect to the byelaws to be made by the
undertakers;
With respect to access to the special Act;
With respect to the saving of rights:
(2) Section 28 of the Harbours Docks and Piers Clauses Act
1847 Provided that the following expressions used in

the said Act shall have the following respective A.D. 1919.
meanings (that is to say):
The expressions "packet boat" and "Post Office
packet" mean respectively a vessel employed by
or under the Post Office or the Admiralty for
the conveyance under contract of postal packets
as defined by the Post Office Act 1908 and the
expression "Post Office bag of letters" means a
mail bag as defined by the same Act:
Provided also that nothing in the Harbours Docks
and Piers Clauses Act 1847 or in this Act shall
extend to exempt from rates or duties any such
vessel as aforesaid if such vessel also conveys pas-
sengers or goods for hire:
(3) The provisions of the Commissioners Clauses Act 1847
with respect to the contracts to be entered into and
the deeds to be executed by the Commissioners and
with respect to the liabilities of the Commissioners
and to legal proceedings by or against the Commis-
sioners and with respect to the appointment and
accountability of the officers of the Commissioners.

In this Act unless there be something in the subject or Interpre-
context repugnant to such construction the several words and tatl0n-
expressions to which meanings are assigned by the Acts wholly
or partially incorporated herewith have the same respective
meanings and the following words and expressions have the
meanings hereby assigned to them:
" The port" means the port and harbour of Waterford within
the limits existing at the passing of this x\ct:
"The Act of 1846" means the recited Act 9 & 10 Vict,
cap.
ccxcii.:
"The Act of 1868" means the Waterford Harbour (Dry
Dock) Act 1868:
"The Act of 1874" means the Waterford and New Ross
Harbours Act 1874:
" The Order of 1904" means the Waterford Harbour Order
1904:
"The existing Harbour Acts" means and includes the Act
of 1846 the Act of 1868 the Act of 1874 and the Order
