An Act to vest a Part of the entailed Estate of
Dunure and others, in the County of Ayr, in Trus-
tees in Fee Simple, for the Purpose of disposing
of or applying the Lands so vested, or the Price
thereof or the Securities to be granted thereon,
towards satisfying the Debts contracted for Money
laid out in the Improvement of the said entailed
Estate. [29th May 1830.]

HEREAS
Thomas Kennedy
of Dunure, Esquire, one of the
Barons of His Majesty's Court of Exchequer in
Scotland,
by a
Disposition of Tailzie bearing Date the Thirteenth Day of
August in the Year One thousand seven hundred and forty-six, and
registered in the Register of Tailzies the Sixth Day of
August
in the
Year One thousand seven hundred and fifty-four, and in the Books of
Council and Session the Twenty-sixth Day of the said Month and Year,
gave,
granted, and disponed to and in favours of himself and the Heirs
Male procreated or to be procreated of his Body in his then present Mar-
jiage with Dame Grizel
Kynynmound,
his dearly beloved Wife, and the
Descendants of the Bodies of the said Heirs Male; whom failing, to the
Heirs Male to be procreated of his Body in any other lawful Marriage he
might thereafter enter into, and the Descendants of the Bodies of the said

Descendants of the Bodies of the said Heirs Female; whom failing, to

Esquire, Colonel of a Regiment of Foot in His Majesty's
Service, his immediate younger Brother German then in Life, and the
Heirs Male of his Body; whom failing, to
Francis Kennedy
Esquire, his
only other Brother German then in Life, and the Heirs

of his Body ;
whom failing, to the Heirs Female of the Body of the said Colonel
James
Kennedy, his immediate younger Brother, and the Descendants of the
Bodies of said Heirs Female; whom failing, to the Heirs Female of
the Body of the said
Francis
Kennedy Esquire, and the Descendants
of their Bodies; whom failing, to such Person or Persons as he had
nominated and appointed or should nominate and appoint by any
Deed executed or to be executed by him; whom all failing, to his
own nearest and lawful Heirs and Assignees whatsoever, the eldest
Heir Female secluding all other Heirs Portioners, and succeeding
always without Division through the whole Course of the Suc-
cession in all Time coming; all and sundry the Lands, Baronies,
and others after mentioned, with the Pertinents;
videlicet,
all and hail!
the Lands and Barony of
Dunure,
with the Castle, Fortalice, and Mill of
the same, and haill other Pertinents
thereof,
extending to a Forty Merk
Land of old Extent, all lying contigue to the said Castle, and within the
Bailliary of Carrick and Sheriffdom of Ayr, as Principal; and in case of
eviction
thereof,
the haill other Lands, Baronies, and Estate which
formerly belonged to the deceased John Earl of
Cassillis,
and were
adjudged from him at the Instance of
John
Earl of
Ruglen,
conform to a
Decreet of Adjudication obtained before the Lords of Council and Session,
upon the Twelfth Day of June One thousand seven hundred and one,
excepting such of the said Lands and Baronies as were sold by the said
Earl of Ruglen in the Month of March One thousand seven h-undred
and four, at a Roup authorized by the said Lords, and that in so far
as may be extended to the said Eviction, if any should happen, and
moreover, all and haill the Ten Pound Land of
Dalquharran,
containing
the particular Roums after specified,
videlicet,
the Manor of
Dalquharran,
Burnside,
Wallacetown,
the Ten Shilling Land of
Knockronald,
Ball-
house, and Highmains Claycroft, and Forty Shilling Land of Doun,
together with the Superiority of the Lands of

and Pertinents of the same, as a Part of the Barony of , and
