An Act for amending and repairing the Road &om T&irsk, over Sk+ton Bridge, to Hutton Moor, and through Ainderby- Quernhow and Nostereld, to Masham, in the North Riding of the County of York. 124th March 182 1 .] HEREAS an Act was passed in the Twenty-eighth Year of the Reign of King George the Second, intituled An 28G,2,c,51. Act for repairing and widening the Road from Thirsk, over Skipton Bridge, through Baldersby to Baldersby Gate adjoining to Hutt,on Moor in the Way to Ripon, and through Ainderby-Quernhow md Nosterfield, by Well Flashes Gate, to Masham, in the Coun& of York j and likewise for removing the YbZZ House and Turnpike Gates at Busby Stobb, in the said County, to some other convenient Place in the Road leading from Boroughbridge to the City of Durhani : And whereas an Act was passed in the hineteenth Year of the Reign of His late Mdjesty King George the Third, intituled An Act for en- 196.3.c.80. kzrgin. the 7'ek and Powers ofan Act made in the Twenty-eighth Year Of the Reign // His Majesty King George the Second, intituled ` An ` Act for repairing and widening the Road from Thirsk, over Skipton Bridge, through Bddersby to Baldersby Gate, agjoining to Hutton [Local.] RT- ' Moor, 15Q 1" 8i 2' GEORGII IV. And be it further enacted, That it shall be lawful for the said Power to ap. '"'''- Trustees, or any Seven or more of them, and they are hereby autho- poillt add;- riqed and empowered, at any of their Meetings to be holden in pur- suance of this Act, to elect any additional Number of fit and proper Persons, residing within the County of York, not exceeding Ten in the whole, to be Trustees for the Purposes of this Act; and such Trustees so elected, and being duly qualified as herein-after mentioned, shall be and are hereby invested with the same Powers and Authorities for executing this Act, as ifthey had been herein named. IV. And be it further enacted, That when and so often as any of On Death or the Trustees hereby named or appointed, (except the Justices of the Refusaltu.w othkr Triiq- Peace 160 tees to ba chosen. Peaoe acting for the North Riding of the County of York), or to be appointed by virtue of this Act, shall die or become disqualified, or by Writing under his or their Hand or Hands delivered to the Clerk to the Trustees of the said Road, refuse to act, it shall be lawful for the surviving or remaining Trustees, or any Seven or more of them, and they are hereby authorized and empowered to elect and appoint some other Person or Persons, residing in the said County of York, to be .a Trustee or Trustees, in the Room of any Trustee or Trustees so dying, or becoming disqualified, or refusing to act; and Notice of the Time and Place of Meeting for every such Election shall be given by Two or more of the said Trustees, or by the Clerk to the said Trustees, in Writing, under the Hands or Hand of such Trustees or Clerk, and fixed at or on all the Turnpike Gates on the said Road ; and such Notice shall also be inserted in One or more public News- papers printed at York, and circulated in the North Riding of the said County of York, at least Seven Days previous to every such Meeting; and all and every Person and Persons who shall be so elected and appointed, shall immediately upon such Election and Appointment, be a Trustee or Trustees for the Purposes of this Act, and having taken the Oath or Affirmation hereby prescribed, shall be vested with the same Powers and Authorities for carrying this Act into Execution, as any Trustee or Trustees hereby nominated and appointed is or are vested with. V. Provided always, and be it further enacted, That no Person shall be capable of acting as a Trustee in the Execution of' this Act, in any case wherein he shall be personally interested otherwise than as a Creditor, nor while he holds any Place of Profit under this Act, or while being a Victualler, or while he shall be a Vendor of any Ale, Beer, or Wine, or Spirituous Liquors by Retail, or who shall be in- terested or concerned in any Contract or Contracts, or who shall be Lessee or Farmer 0f the Tolls or any Part or Parts thereof under this Act ; nor shall any Person be qualified to act as a Trustee, unless at the Time of his acting he shall be a Resident of the County of York, and shall be in his own Right, or in the Right of his Wife, in the actual Possession and Enjoyment of...
