The Air Navigation (Restriction of Flying) (Bolesworth Castle) (No. 2) Regulations 2017

The Secretary of State has decided that it is necessary in the public interest to restrict flying in the vicinity of Bolesworth Castle, Cheshire by reason of the intended holding of a flying display at the CarFest North festival.
The Secretary of State makes the following Regulations in exercise of the powers conferred by article 239 of the Air Navigation Order 2016( 1).
Citation and commencement
1. These Regulations may be cited as the Air Navigation (Restriction of Flying) (Bolesworth Castle) (No. 2) Regulations 2017 and come into force on 28th July 2017.
Interpretation
2. In regulation 3(1) all times referred to are Co-ordinated Universal Time( 2).
Restricted airspace
3.—(1) Subject to paragraph (2), between 1000 hours and 1300 hours on each day beginning on 28th July 2017 and ending on 30th July 2017, no aircraft is to fly below 3,000 feet above mean sea level within the area bounded by a circle having a radius of 1.5 nautical miles whose centre is at 530552N 0024520W.
(2) Paragraph (1) does not apply to any aircraft flying with the permission of the flying display director at CarFest North 2017.
Revocation of Regulations
4. The Air Navigation (Restriction of Flying) (Bolesworth Castle) Regulations 2017( 3) are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations impose restrictions on flying in airspace specified in regulation 3(1) in the vicinity of Bolesworth Castle, Cheshire during an air display for the general public that is scheduled to take place there during the CarFest North festival during the period 28th to 30th July 2017 inclusive. A large number of aircraft will be involved in high energy manoeuvres during the display and therefore the Civil Aviation Authority and the Department for Transport agree that flying should be restricted in the vicinity of the displays for reasons of public safety.
In relation to regulation 3, the term ‘aircraft’ includes aircraft as classified by Part 1 of Schedule 4 to the Air Navigation Order 2016.
