Anno nono G E O R G I I III An Act for the better paving, cleansing, lighting, and watching, the Streets and Lanes in the Parish and Borough ofNew Windsor , in the County of Berks , and for preventing Nusances and Annoyances therein.

'WHEREAS the Streets and Lanes within the Parish and Borough ofNew Windsor , in the County of Berks , are very ill paved and cleansed, and incommodious to Passengers, by Annoyances and Incroachments therein; and many Disorders and Irregularities are frequently committed in the Night-time in the said Streets and Lanes, for want of the same being properly lighted and watched: And whereas it will tend greatly to the Benefit and Safety of the Inhabitants of the said Parish and Borough, and of all Persons resorting thereto, if the said Streets and Lanes were properly paved, cleansed, lighted, and watched, and kept clear and free from Annoyances and Incroachments; but as the same cannot be effected without the Aid of Parliament: May it therefore please Your Majesty, that it may be enacted; and' be it enacted by the King'smost Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, That the HonourableAugustus Keppel Esquire, Richard Tonson Esquire, the Mayor and Justice of the Borough of New Windsor , and the Under Steward of the said Borough for the Time being; the Reverend John Bostock , D. D. the Reverend Pilgrim, Henry, Isherwood, Owen Salusbury Brereton Esquire, John Cheshyre Esquire, Samuel Waller, James Straker, Francis Pigott Esquires; William Bidle M. D. Richard Jephson Esquire, Richard Grape Esquire, Charles Eldridge, Elliot Salter, Thomas Poppleton, George Aylet, William Kimber, Charles Ballard, George Hatch, Nicholas Trevanion , the Reverend Thomas Walker , Major Boifragon, Charles Hedges , Esquire, Alexander Schomberg Esquire, the Reverend John Hand, Thomas Rutter Esquire, Frederick Thackeray M. D. Humphry Hackshaw Esquire, James Roffee Esquire, Daniel Highmore Esquire, Edmund Whinfield, Henry Isherwood junior Abraham Sharratt, William Charsley, John Williamson, William Tyrrell, George Bryer, William Pearson, John Spencer, John Snowden, Henry Coombes, Richard Seaward, Richard Pinnork, John Carr, John Davis, John Simes, John Williams, John Benning, Richard Bradbury, Robert Style, John Norton , Sir Edward Walpole Knight of the Bath , Sir Thomas Reeve Knight, Charles Bowles Esquire, Richard Neville Esquire, Arthur Vansittart Esquire, Richard Mead Esquire, and their Successors, to be elected in Manner herein aftermentioned, shall be, and they are hereby appointed Commissionersfor putting this Act in Execution; and when any of the Commissioners herein named, or hereafter to be elected, shall die or refuse to act, it shall and may be lawful for the surviving or remaining Commissioners, or any Seven or more of them, at any Meeting, to elect a fit Person or Persons to supply the Place or Places of him or them so dying or refusing to act; and all Persons who shall be so elected are hereby vested with the same Powers for putting this Act in Execution as the Persons in whose Stead they shall be elected were vested with.

II. Provided always, and be it further enacted, That no Person shall be capable of acting as a Commissioner in the Execution of this Act, during the Time he shall hold any Office of Profit, or have any Share or Interest in any Contract relating to the Execution of any of the Powers of this Act.

III. And be it further enacted, That the said Commissioners, or any Five or more of them, shall meet on theMonday Sevennight next after the Day of the Passing of this Act, between the Hours of Ten and Twelve of the Clock in the Forenoon, at the Guildhall within the said Borough; and shall, from Time to Time, afterwards meet upon the First Monday in every Month at the Guildhall aforesaid, with the Consent of the Mayor for the Time being, or at such other Place or Places within the said Parish and Borough as they the said Commissioners, or any Five or more of them, shall think proper; and shall and may adjourn themselves, and meet at any other Time or Place within the said Parish and Borough as the said Commissioners, or any Five or more of them, shall appoint, for putting this Act in Execution; and the said Commissioners shall at all their Meetings pay their own Expences.

IV. And be it further enacted, That no Person shall be qualified or capable of acting as a Commissioner in the Execution of this Act (except the Mayor and Justice of the Peace and Under Steward for the said Borough for the Time being) unless he shall be in his own Right, or in the Right of His Wise, in the actual Possession or Receipt of the Rents and Profits of Lands, Tenements, or Hereditaments, of the clear yearly Valueof Fifty Pounds, or possessed of a Personal Estate alone to the Amount or Value of One thousand five hundred Pounds: And if any Person (except the Mayor and Justice of the Peace and Under Steward for the said Borough for the Time being) shall act as a Commissioner for putting this Act, or any of the Powers herein contained, in Execution, contrary to the Intent and Meaning hereof; every such Person shall, for every such Offence, forfeit and pay the Sum of One hundred Pounds to any Person or Persons who shall sue for the same, to be recovered in any of His Majesty's Courts of Record by Action of Debt, or on the Case, or by Bill, Suit, or Information; wherein no Essoin, Protection, or Wager of Law, or more than One Imparlance, shall be allowed; and the Person so prosecuted shall prove that he is so qualified, or otherwise shall pay the said Penalty, without any other Proof or Evidence on the Part of the Prosecutor than that such Person hath acted as a Commissioner in the Execution of this Act.

V. And be it further enacted, That the said Commissioners, or any Seven or more of them, shall and may appoint One or more Treasurer or Treasurers, Collector or Collectors, of the Monies to be raised by virtue and for the Purposes of this Act; and also One or more Surveyor or Surveyors, and such other Officer or Officers, as the said Commissioners, or any Seven or more of them, shall think necessary for the due Execution of this Act: And the said Commissioners, or any Seven or more of them, shall take Security for the due Executionof their respective Offices as the said Commissioners, or any Seven or more of them, shall think proper; and shall and may, from Time to Time, remove any or either of such Officers or other Persons, and appoint others in the Room of such of them as shall be so removed or shall die: And such Personor Persons as is or are hereby made liable to pay the several Rates or Sums of Money hereby granted shall pay the same to such Person or Persons as shall, from Time to Time, by the said Commissioners, or any Five or more of them, be appointed to collect and receive the same: And all such Officers and Persons so to be appointed as aforesaid shall, under their Hands, at all Times when the said Commissioners, or any Five or more of them, shall direct, deliver to the said Commissioners, or any Five or more of them, a true and perfect Account in Writing, to be fairly entered in a Book to be kept for that Purpose, of all Matters and Things committed to their Charge by virtue of this Act; and also of all the Monies which shall have been by such Officer or Officers received by virtue and for the Purposes of this Act, and how much thereof hath been paid and disbursed by Order of the said Commissioners, or any Five or more of them, and for what Purposes, together with the proper Vouchers for such Payments; and shall pay all such Money as shall remain in their respective Hands to the said Commissioner, or any Five or more of them, or to such Person or Persons as they shall appoint to receive the same; and all such Persons so accounting as aforesaid shall upon Oath verify their said Accounts; which said Oath the said Commissioners, or any Two or more of them, are hereby impowered and required to administer: And if any such Officer or Person shall not make and render, or shall refuse to verify upon Oath any such Account, or to produce or deliver up the Vouchers relating to the same, or to make Payment as aforesaid, or shall not deliver to the said Commissioners, or any Five or more of them, or to such Person or Persons as they shall appoint, within Ten Days after being thereunto required by any Five or more of the said Commissioners, all the Books, Papers, and Writings, in his Custody or Power relating to the Execution of this Act; or shall refuse or neglect to pay such Monies as upon the Balance of any Account or Accounts shall appear to be in his or their respective Hands, to the said Commissioners, or any Five or more of them, or to such Person or Persons as they shall appoint to receive the same; then, and in either of the Cases aforesaid, the said Commissioners, or any Five or more of them, may and are hereby authorised and impowered to bring, or cause to be brought, any Action or Actions in the Name of any Two or more of the said Commissioners, or in the Name of their Treasurer or Clerk, against the Officer or Officers, Person or Persons so neglecting or refusing as aforesaid, in order for the Recovery of the Monies that shall be in the Hands of such Officer or Officers, Person or Persons, respectively; or in case of such Neglect or Refusal, as aforesaid, it shall and may be lawful to and for any Justice or Justices of the Peace in and for the said Borough, and he or they is and are hereby authorised and impowered, by a Warrant or Warrants under...
