An Act to extend the Borough of Stockton otherwise called AD-1889-Stockton-on-Tees and for other purposes. [26th July 1889.] W HEBEAS the borough of Stockton otherwise called Stockton-on-Tees in the county of Durham is a municipal borough subject to the Acts relating to municipal corporations and the mayor aldermen and burgesses of the said borough are the urban sanitary authority for the district thereof : And whereas the following Acts or parts thereof are in force within the borough (that is to say): The Stockton Gas Act 1857; c!m21 Vict" The Stockton Gas Act 1866; ccvi. The Stockton-on-Tees Extension and Improvement Act 1869; c2ilxw.Vlct' The Stockton Gas Act 1873; f"m The Stockton-on-Tees Market Act 1876; ?£&Ttefc The Stockton and Middlesbrough Corporations Waterworks Act f ^vict 1876; The Stockton-on-Tees Quay and Markets Act 1878; c.cxciv.' " The Stockton Bridge Act 1881; "m. 1C' The Stockton and Middlesbrough Corporations Waterworks Act £&$. lct 1884; and The Stockton and Middlesbrough Waterworks Act 1888; "n. " which Acts are in this Act collectively referred to as " the recited Acts " and each of them separately as an Act of the year in which it was passed: And whereas the Corporation are the joint owners with the corporation of Middlesbrough and the local board for the district of South Stockton of the water undertaking whereby the said borough and the borough of Middlesbrough and the said district and certain places adjacent thereto are supplied with water under powers contained in the Act of 1876 the Act of 1888 and the South Stockton 47 &48Vict. And whereas the Corporation are the owners of the gas under-taking of the said borough and under the powers of the recited Acts manufacture gas and supply gas in the said borough and in townships and places adjacent thereto: And whereas the Corporation are also the owners of the markets and quays of the borough: And whereas it is expedient that the municipal limits of the said borough be extended so as to include the parts of the townships of Stockton in the parish of Stockton-on-Tees and Linthorpe in the parish of Middlesbrough adjoining the existing borough and in this Act particularly described and that so much of the said parishes as is added to the borough be detached from the jurisdiction of the rural sanitary authority of the Stockton Union and the Middlesbrough Union respectively so that the Corporation be constituted the sole sanitary authority within the borough as extended: And whereas it is expedient to make provision for the representation of the area added to the said borough and for the division into wards of the extended borough : And whereas the existing borough is a school board district under the Stockton-on-Tees School Board and it is expedient that the district of the Stockton-on-Tees School Board be extended : And whereas the Corporation are the burial board for the said borough and it is expedient that they be constituted the burial board for the borough as extended: And whereas it is expedient that the name of the extended borough should be the borough of Stockton-on-Tees: And whereas under the powers of the Stockton-on-Tees and District Tramways Order 1880 (in this Act called " the Order of 1880") the Tramways Trust Company Limited constructed the tramways by that order authorised in the existing borough and in the parish of Norton: And whereas under the powers of the Darlington Tramways Order 1880 certain persons therein named constructed the tramways thereby authorised in the borough and parish of Darlington : And whereas by the Stockton-on-Tees and District Tramways (Extension) Order 1884 (in this Act called "the Order of 1884") the tramways authorised by the foregoing- orders and the powers conferred by those orders became vested in the Stockton and Darlington Steam Tramways Company (Limited) and that company (in this Act called "the tramway company") were authorised to extend the first-mentioned tramways into South Stockton and Thornaby: And whereas at the instance of the debenture holders of the tramway company a receiver and manager of the tramways has 2 [52 & 53 Vict.] Stockton-on-Tees Extension and [Ch. XCii.l Improvement Act, 1889. been appointed and the tramway company are now being wound up a.D 1889 under the order of the Chancery Division of the High Court of Justice and an official liquidator of the said company has been appointed : And whereas it is expedient that the Corporation be authorised to purchase upon the terms herein-after mentioned so much of the undertakings of the tramway company as are sanctioned by the Order of 1880 and the Order of 1884: And whereas it is expedient that the Corporation be authorised to borrow money for the purposes and to the extent herein-after mentioned: And whereas it is expedient that the Corporation be authorised to exercise their statutory borrowing powers b y the creation and issue of redeemable stock: And whereas a statement of the borrowing powers and indebtedness of the Corporation on capital account subsisting on the twenty-eighth day of February one thousand eight hundred and eighty-nine is set forth in the Fifth Schedule to this Act : And whereas it is expedient that further powers be granted to the Corporation for the improving and better governing of the borough and that the recited Acts be in divers particulars altered and amended and the powers thereof extended: And whereas the purposes aforesaid cannot be effected without the authority of Parliament: And whereas an absolute majority of the whole number of the council at a meeting held on the eleventh day of January one thousand eight hundred and eighty-nine after ten clear days notice by public advertisement of such meeting and of the purpose thereof in the " North-eastern Daily Gazette " a local paper published or circulating in the borough such notice being in addition to the ordinary notices required for summoning such meeting resolved that the expense in relation to promoting the Bill for this Act should be charged on the borough fund and borough rate: And whereas such resolution was published twice in the said North-eastern Daily Gazette and has received the approval of the Local Government Board in respect of matters under the jurisdiction of that Board: And whereas the propriety of the promotion of the Bill for this Act was confirmed by an absolute majority of the whole number of the council at a further special meeting held in pursuance of a similar notice on the seventh day of May one thousand eight hundred and eighty-nine being not less than fourteen days after the deposit of the Bill in Parliament: A2 3 [Ch. And whereas the owners and ratepayers of the borough by reso- lution in the manner provided in the Third Schedule of the Public Health Act 1875 consented to the promotion of the Bill for this Act: May it therefore please Your Majesty that it may be enacted and be it enacted by the Queen's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows (that is to say): Part I.Preliminary. Short title. 1, This Act may be cited for all purposes as the Stockton-on-Tees Extension and Improvement Act 1889. Commence- 2. For the purposes of proceedings preliminary to the municipal ment of Act. elections of one thousand eight hundred and eighty-nine this Act shall take effect on its passing but except for those purposes and except where herein-after expressly provided this Act shall commence on the thirty-first day of October one thousand eight hundred and eighty-nine and that date is in this Act referred to as the commencement of this Act.
