Act, 1939.
CHAPTER xxxi.
An Act to confer powers upon the corporations of
Smethwick Oldbury Rowley Regis and Tipton
in regard to certain tramways in their respective
boroughs and to empower the said corporations
to provide and work public service vehicles to
confirm an agreement between the said corpora-
tions and the Birmingham and Midland Motor
Omnibus Company Limited and for other
purposes. [25th May 1939.]

HEREAS the mayor aldermen and burgesses of
the borough of Smethwick the mayor aldermen
and burgesses of the borough of Oldbury the mayor
aldermen and burgesses of the borough of Rowley
Regis and the mayor aldermen and burgesses of the
borough of Tipton (in this Act respectively referred
to as " the Smethwick Corporation" " the Oldbury
Corporation " " the Rowley Regis Corporation " and
" the Tipton Corporation " and collectively as " the
local authorities") are respectively the local
authorities within the meaning of the Tramways Act
33 &
34 Vict.
1870
for the county borough of Smethwick the borough c-78-
of Oldbury the borough of Rowley Regis and the
borough of Tipton and are local authorities within
the meaning of the Road Traffic Act
1930:

And whereas in pursuance of the provisions of the
Birmingham and Western Districts Tramways Order
1881 (which was confirmed by the Tramways Orders 44&45Vict.

Rowley Regis and Tipton Transport Act, 1939.
Confirmation (No. 2) Act 1881) the promoters therein
mentioned were authorised to construct and maintain
certain tramways including the tramways therein
described as Tramway No. 3 Tramway No. 4 Tramway
No.
5 Tramway No. 6 and Tramway No. 7 which tram-
ways are wholly or partly situate in the boroughs of
Smethwick Oldbury Rowley Regis and Tipton:
2Edw. 7. And whereas by the Birmingham and Midland
c ccxxiii. Tramways Act 1902 the Birmingham and District
Investment Trust Limited (then known as "the
Birmingham and Midland Tramways Limited ") who
are the owners of the above-mentioned tramways were
authorised to construct the tramways mentioned in that
Act including Tramway No. 3 Tramway No. 4 and
Tramway No. 5 therein described which are situate in
the borough of Smethwick:

And whereas by the Black Country Tramways and

.. Light Railways Act 1922 it was amongst other things

local authorities could exercise the powers of
compulsory purchase (in pursuance of the provisions
of the Tramways Act 1870) of so much of the under-
takings authorised by the said Order of 1881 and the
said Act of 1902 which comprise the tramways or
portions of tramways which are within their respective
boroughs should be the thirty-first day of December
nineteen hundred and thirty-eight:
And whereas in pursuance of the provisions of
section 44 of the Tramways Act 1870 the Birmingham
and District Investment Trust Limited have with the
consent of the Minister of Transport agreed to sell to
the Smethwick Corporation so much of the undertaking
comprising the said tramways as is situate in the
borough of Smethwick and the Smethwick Corporation
have agreed to purchase the same and have complied
with the requirements of the said section 44 with
reference to such purchase:
And whereas the Oldbury Corporation the Rowley
Regis Corporation and the urban district council of
Tipton (the predecessors of the Tipton Corporation)
respectively gave notice to the Birmingham and
District Investment Trust Limited that under and by
virtue of the powers vested in them respectively by
section 43 of the Tramways Act 1870 they respectively

required the said Birmingham and District Investment
Trust Limited to sell to them on the thirty-first day of
December nineteen hundred and thirty-eight so much
of the said tramways as are situate within their
respective boroughs:
And whereas the Smethwick Corporation are by
the Smethwick Corporation Act 1901 authorised to l

work any tramways for the time being belonging to c- ccxliv.
them and it is expedient to empower the Oldbury
Corporation the Row7ley Regis Corporation and the
Tipton Corporation to work the tramways purchased
by them as aforesaid until the same are abandoned as
hereinafter mentioned:
And whereas it is expedient to empower the local
authorities to abandon the said tramways and to confer
powers upon them with reference to the running of
public service vehicles on the routes of the tramways
so abandoned:
And whereas it is expedient to confirm the
agreement with reference to the running of public
service vehicles which has been made between the
local authorities and the Birmingham and Midland
Motor Omnibus Company Limited and which is set
forth in the schedule to this Act:
And whereas it is expedient that the other
provisions contained in this Act should be enacted:
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas in relation to the promotion of the
Bill for this Act the requirements of Part XIII of
the Local Government Act 1933 have been observed

Corporation respectively:
May it therefore please Your Majesty that it may
be enacted and be it enacted by the King's most
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons in
this present Parliament assembled and by the authority
of the same as follows (that is to say):

This Act may be cited as the Smethwick Short title.
