Kirkburton
in the West
Riding of the County of York [28th May 1827-]

HEREAS there are within the Township of
Shepley
in the
Parish of Kirkburton in the West Riding of the County o*
Tork, certain Commons, Commonable Lands, and Waste
Grounds, called or known by the Name of
Shepley
Common,
containing
together Two hundred and twenty Acres or thereabouts: And whereas
Sir
Joseph Radeliffe
Baronet, and
Thomas
Hardy Esquire, are Lords of the
Manor of
Shepley
aforesaid: And whereas the said Sir
Joseph
Radeliffe
Baronet,
Thomas
Hardy, John
Tinker,
Hezekiah
Tinker,
Robert
firth, John
Firth of
Shepley,
John Firth of New
Chapel
near
Penistone,
Samuel
Stocks,
Tedbar Tinker, and several other Persons, or Trustees for them, are or
claim to be entitled to the Soil and Freehold of the aforesaid Commons,
Commonable Lands, and Waste Grounds: And whereas the Reverend
Benjamin Hutchinson
is the present Vicar of the Parish Church of Kirk-
burton,
and the King's most Excellent Majesty is, in right of His Crown,
Patron of the Vicarage of the same Church: And whereas an Act was
passed in the Forty-first Year of the Reign of His late Majesty King
George
the Third, intituled An Act for
consolidating

visions usually inserted
in Acts of
Inclosure,
and
for
facilitating
the
Mode of
proving the several Facts usually required on the passing
of
such
Acts : And
whereas another Act was passed in the First and Second Years of the
Reign of His present Majesty, intituled An Act
to
amend
the
Laws
respecting

Fields,
Pastures,
Moors,
Commons,
and Waste
Lands, in c.

England: And
whereas the
said
Commons,
Commonable
Lands,
and
Waste
Grounds, in their present open and uncultivated State, are of little or no
Advantage to the Majority of the said Proprietors or Owners, but might,
if divided, allotted, and inclosed, be cultivated and rendered productive
and valuable; and it would be advantageous to the Proprietors and Parties
interested in the said Lands and Grounds, and to the Persons and Parties
interested in the several old inclosed Lands and Grounds, as well Wood
Lands as
otherwise, within the
same
Township,
if the same respectively
were
to be exonerated from all Vicarial Tithes, and all Dues payable in lieu
thereof,
and from all
Easter
Offerings and Mortuaries, and all Dues pay-
able in lieu
thereof,
and of all other Dues, and Allotments made to the
Vicar in lieu of such Tithes and Dues (Surplice Fees only excepted):
May it therefore please Your Majesty that it may be enacted; and be it
enacted by the King's most Excellent Majesty, by and with the Advice and
Consent of the Lords Spiritual and Temporal, and Commons, in this
Commis- present Parliament assembled, and by the Authority of the same, That

pointed. be and he is hereby appointed Commissioner for dividing, allotting, and
inclosing the said Commons, Commonable Lands, and Waste Grounds,
and for carrying this Act and the said recited Acts into Execution, (save
and except such Parts of the said recited Acts as are hereby altered and
varied,) and under and subject to such of the Regulations and Restrictions
contained in the said recited Acts as are not repugnant to the Powers and
Provisions of this Act.

- IL And be it further enacted, That when and as often as the said
Commissioner, or any other Commissioner to be hereafter appointed by
virtue of this Act, shall die or become incapacitated, or for the Space of
Six Calendar Months neglect or refuse to act as such Commissioner in
the Execution of this Act, then and in such Case the major Part in value,
to be ascertained by the then last Land Tax Assessment for the said
Township, of the Persons interested for the Time being in the said Com-
mons,
Commonable Lands, and Waste Grounds, and present at some
public Meeting to be holden in the said Township of
Sbepley,
of which
Meeting, and the Purpose
thereof,
Notice shall be given by any Two or
more of such Persons so interested as aforesaid, for at least Forty Days
previous to such Meeting, by affixing such Notice on the Southern
Entrance outer Door of the Parish Church of
Kirkburton
aforesaid, and
by inserting the same in the
Leeds
Mercury, or some other public News-
paper printed or circulated in the West Riding of the County of
Tork,
shall and they are hereby required and empowered from Time to Time,
by Writing under their Hands, to appoint
some
other Person (not interested
in the said intended Division and Inclosure) to be a Commissioner in the
Room and Stead of each such Commissioner so dying or becoming
incapacitated, or neglecting or refusing to act as aforesaid; and any Com-
missioner so to be appointed by the Persons interested as aforesaid shall,
after taking the Oath or Affirmation prescribed by the said first-recited
Act in that
Behalf,
have the like Power and Authority for carrying this
Act and the said recited Acts into Execution, and shall be subject and
liable to the like Rules, Regulations, and Restrictions, as if he had been
originally nominated a Commissioner in and by this Act.
