An Act to empower the mayor aldermen and citizens of the city of Salford to execute street works and to acquire lands for those and other purposes to confer powers upon them of running trolley vehicles to make various provisions and to confer various powers with respect to the several undertakings of the Corporation and in regard to the health and finance and for the good government of the city and for other purposes.

An Act to empower the mayor aldermen and citizens a.D. 1933. of the city of Salford to execute street works and to acquire lands for those and other purposes to confer powers upon them of running trolley vehicles to make various provisions and to confer various powers with respect to the several undertakings of the Corporation and in regard to the health and finance and for the good government of the city and for other purposes. [28th July 1933.] W HEREAS the city of Salford (hereinafter referred to as " the city ") is a municipal borough subject to the Acts relating to municipal corporations and is a county borough within the meaning of the Local Government Act 1888 and the mayor aldermen and citizens of the city (hereinafter referred to as " the Corporation") are the urban sanitary authority for the city: And whereas it is expedient that the Corporation should be empowered to execute the street works and other works by this Act authorised and to acquire lands for the purposes thereof and for other purposes: And whereas under various Acts and Orders the Corporation own or are lessees of and work tramways in the city and in certain districts adjacent to the city and it is expedient that they should be empowered to provide and work trolley vehicles along the routes of [Price 4s. AD. 1933. such tramways and along an additional route partly in the city and partly in the city of Manchester and that the provisions with reference to the abandonment of such tramways and the further powers with reference to the running of trolley vehicles contained in this Act should be enacted and conferred : And whereas owing to natural causes subsidences have from time to time occurred in a part of the city known as " the Cliff Higher Broughton " and it is apprehended that further subsidences will from time to time occur which will affect or endanger the land described or referred to in this Act and the houses thereon and it is expedient that such powers as are contained in this Act with reference to such land and houses should be conferred upon the Corporation : And whereas it is expedient that the powers and provisions contained in this Act with reference to buildings in the city should be enacted and conferred: And whereas it is expedient that further powers should be conferred upon the Corporation with reference to their electricity undertaking : And whereas it is expedient that further and better provision should be made for the health local government and improvement of the city and that the powers of the Corporation in regard thereto should be enlarged as by this Act provided : And whereas under and by virtue of the Local Government and other Officers' Superannuation Act 1922 the Corporation have established a superannuation fund for the payment thereout of superannuation allowances to their officers and servants and it is expedient that the provisions relating to the said fund should be amended and extended as by this Act provided : And whereas it is expedient that the provisions with regard to the finances of the Corporation which are contained in this Act should be made and that the Corporation should be empowered to bosrow for the various purposes of this Act: And whereas it is expedient that the other provisions contained in this Act should be made: And whereas the purposes aforesaid cannot be effected without the authority of Parliament: 2 ...-?/..?'. Corporation of the expense of the works and purposes hereinafter mentioned and such estimates are as follows: £ For the execution of works - - 46,400 For the purchase of lands - - - 29,260 And whereas the several works included in such estimates are permanent works and it is expedient that the cost thereof should be spread over a term of years : And whereas plans and sections showing the lines or situations of the works by this Act authorised and plans showing the lands which the Corporation may acquire under this Act and the lands liable to subsidence in respect of which orders may be made by the Corporation under this Act and a book of reference to such plans containing the names of the owners or reputed owners lessees or reputed lessees and of the occupiers of all such lands and describing the same have been deposited with the town clerk of the city and with the clerk of the county council of the administrative county of Lancaster which plans sections and book of reference are in this Act respectively referred to as the deposited plans sections and book of reference: And whereas in relation to the promotion of the Bill for this Act the requirements of the Borough Funds Acts 1872 and 1903 have been observed: May it therefore please Your Majesty that it may be enacted and be it enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows (that is to say): Part I. Preliminary. 1. This Act may be cited as the Salford Corporation Short title. Act 1933. 2. This Act is divided into Parts as follows : Act divided Part L-Preliminary. **Parts- Part II.Street works &c. Part III.Lands. A 2 3 [Ch. Ixxxix.] Salford Corporation [23 & 24 Geo. 5.1 Act, 1933. A.D. 1933. Part IV.Road transport. Cliff Higher Part V.Houses at the Broughton. Part VI.Buildings &c. Part VII.Electricity. massage and Part VIII.Establishments for special treatment. Part IX.Ice-cream. Part X.Superannuation &c. Part XI.Finance. Part XII.Miscellaneous. Incorporation of Lands Clauses Acts. 3. The Lands Clauses Acts (so far as the same are applicable for the purposes and are not inconsistent with the provisions of this Act) are hereby incorporated with this Act with the following exception and modification: (a) Section 127 of the Lands Clauses Consolidation Act 1845 (relating to the sale of superfluous lands) is not incorporated with this Act; (6) The bond required by section 85 of the Lands Clauses Consolidation Act 1845 shall be under the corporate seal of the Corporation and shall be sufficient without the addition of the sureties mentioned in that section. Interpreta- 4.(1) In this Act unless the subject or context tion. otherwise requires " The city" means the city and county borough of Salford; " The council " means the council of the city; " The Corporation " means the mayor aldermen and citizens of the city acting by the council; " The Manchester Corporation" means the lord mayor aldermen and citizens of the city of Manchester; " The Eccles Corporation " means the mayor aldermen and burgesses of the borough of Eccles; " The town clerk " " the treasurer " " the medical officer " " the city engineer " and " the sanitary inspector" mean respectively the town clerk the treasurer the medical officer of health the 4 [23 & 24 Geo. 5.] Salford Corporation [Oh. lxxxix.] Act, 1933. city engineer and surveyor and any sanitary AD. 1933. inspector of the city and include any person duly authorised to discharge temporarily the duties of those offices respectively; " The general rate fund " and " the general rate " mean respectively the general rate fund and the general rate of the city; " The Minister " means the Minister of Health; " The street works " means the new streets street widenings improvements of streets and other works by Part II of this Act authorised or any of them or any part thereof respectively and "street work" means any of the street works or any part thereof;' " Trolley vehicle " means a mechanically propelled vehicle adapted for use upon roads without rails and moved by electrical power transmitted thereto from some external source; " The trolley vehicles" means the trolley vehicles by this Act authorised to be provided maintained and used by the Corporation; " Trolley vehicle routes" means the routes upon which the Corporation are or may be authorised by or under the provisions of this Act to work and use trolley vehicles; "The trolley vehicle undertaking" means the trolley vehicle undertaking of the Corporation authorised by this Act; " The Corporation tramways " means and includes all tramways for the time being belonging to the Corporation and all tramways in the borough of Eccles the urban district of Prest-wich the urban district of Whitefield and the urban district of Swinton and Pendlebury or any of them (as respectively constituted on the first day of January one thousand nine hundred and thirty-three) for the time being leased to or worked by the Corporation; " The tramway undertaking " means the tramway undertaking of the Corporation as authorised for the time being including the Corporation tramways; A3 5 [Oh. " The Eccles tramways" means the tramways belonging to the Eccles Corporation which are leased to and worked by the Corporation at the date of this Act; " Public service vehicle " has the same meaning as in the Road Traffic Act 1930; " The electricity undertaking" " the gas undertaking " and " the water undertaking" mean respectively the electricity undertaking the gas undertaking and the water undertaking of the Corporation as those undertakings are respectively authorised for the time being; " The...
