HEREAS
an Act was passed in the Forty-fourth Year
of
the Reign
of
His
Majesty
King
George
the Third, inti-

the better regulating and improving the

Fisheries

the
Arm
of
the
Sect
between the
County
of
Cumberland
and the Counties
of
Dumfries
and
Wigton
and the Stewurtry
of
Kirk-
cudbright,
and also
the
Fisheries
in
the several Streams
and
Woters
which
run
into
or
communicate with the said
Arm
of
the Sea:
And
whereas the Salmon Fisheries in the River
Annan
in
the
County
of
Dunlfries,
as
well as the Salmon Fisheries on the Shores or
Sea
Coast
adjacent to the Mouth or Entrance of the said River, have greatly
decreased, and there
is
reason to apprehend that
a
progressive
Decrease in the Value thereof
will
continue
to
take place unless
Measures be taken for the Preservation
of
the Breed
of
Salmon
and
Fish
of
the Salmon Kind in the
said
River, and on the Shores or Sea
Coast
adjoining the Mouth or Entrance thereof: And whereas it
has been found by Experience that the said recited Act
has
become

inadequate to the Purposes intended,
in
so
far as the same
is
appli-
cable to the said River and Shores or Sea Coast; arid it is expedient
that
a
weekly Close Time should be established in the said River and
Shores or Sea Coast, and that the said recited Act, in
so
far as tlie
same
is
applicable thereto, should be repealed, and that instead
thereof further and other Regulations should be made
;
but as the
Purposes aforesaid cannot be erected without the Authority of
Parliament, May it therefore please Your Majesty that
it
may be
enacted
;
and be it enacted by the Queen’s most JSxcellent Majesty,
by and with tlie Advice and Consent
of
the Lords Spiritual and
Temporal, and Commons,
in
this present Parliament assembled, and
by the Authority
of’
the same, That fyom and after the passing
of’
this
Act the said recited Act of the Forty-fourth Year of the Reign
of’
His said Majesty King
George
the Third shall be and the same
is
hereby repealed, in
so
fir
as the same includes or can be applied to
the said River
Anizan,
and to the Streams or Waters running into the
same, and to the Shores or Sea Coast adjacent to the Mouth or
Entrance
of
the said River
Aiznnn,
and that this Act shall thereafter
be put into execution for the Purposes herein-after mentioned.
11.
And be it enacted, That for executing tlie Purposes of this
Act ail and every the Proprietors
of‘
Salmon Fishings
in
the said
River
Annan
or on the Shores or Sea Coast aforesaid adjacent to the
Mouth or Entrance of‘the said River, of the annual Rent or Value
of‘
Five Pounds, or which extend Half a Mile in Length where such
Fishings are only on one Side of the said River, or a Quarter of
a
Mile where such Fishings compreliend both Sides of the
said
River,
and all and every the eldest Sons of such Proprietors, the Husband
of every such Proprietrix, One Guardian of’each Minor, One Judicial
Factor or other Person appointed judicially
to
act for any such Pro-
prietor or Proprietrix, and One Member
of
eac!i Corporation
or
associated Body, Iioldirig, enjoying, or possessing any such Salmon
Fishings
of‘
the annual Value or Extent aforesaid, and

of every such Estate, shall be and they are hereby appointed
Corn-
missioners for carrying this Act into execution.
111.
And be it enacted, That it shall be lawful for every Person
hereby appointed a Commissioner to appoint, by Writing under his
Hand, from Time to Time, any Person to be Proxy for and to act it1
all Meetings of the said Commissioners
as

appointed Proxy, to vote at all such Meetings for
each Commissioner by whom he is

Provided

that in no
Case
shall any Representative or Proxy and
the
Conimis-
sioner by whom he is appointed be entitled to vote at tlie same
Meeting, and that no Person shall hold more than One Proxy at olle
and the same Time.
IV.
And be it enacted,
Tliat
if any Person entitled to be a Corn-
inissioner for putting this Act into execution shall accept or continue
to liold any Place of
Profit
arising out of
the
Rate of Assessment
