Proceedings in Vice-Admiralty Courts see the title "Colonial Court of Admiralty and Vice-Admiralty Court."
General Rules as to appeals to H.M. in Council see the title "Judicial Committee."
THE PRIZE COURT RULES, 1939.(a)PRESENT,
The King's Most Excellent Majesty in Council.
Whereas by section three of the Prize Courts Act, 1894, His Majesty in Council is authorised to make rules of court for regulating, subject to the provisions of the Naval Prize Act, 1864, and the said Act, the procedure and practice of prize courts within the meaning of the Naval Prize Act and the duties and conduct of the officers thereof and of the practitioners therein, and for regulating the fees to be taken by the officers of the courts and the costs, charges and expenses to be allowed to the practitioners therein:
And whereas by section five of the Naval Prize Act, 1864, it is provided that every appeal from a prize court within the meaning of that Act shall be made in such manner and form and subject to such regulations (including regulations as to fees, costs, charges and expenses) as may for the time being be directed by Order in Council:
And whereas it is expedient that the Prize Court Rules, 1914, as amended by Orders in Council dated the 28th day of November, 1914, the 3rd day of February, 1915, the 29th day of April, 1915, and the 21st day of December 1917, should cease to have effect except in the Union of South Africa and Eire (b):
And whereas by section one of the Prize Act, 1939, it is provided that the law relating to prize shall apply in relation to aircraft and goods carried therein as it applies in relation to ships and goods carried therein, and shall also apply notwithstanding that the aircraft is on or over land:
(a) These Rules supersede Provisional Rules to like effect approved by Order in Council 2nd September, 1939.
(b) The Prize Court Rules, 1914 and amendments thereof, are, on account of their limited application, omitted from this volume. They are printed in S.R. & O. 1914 (No. 1407 and 1701) III, pp. 103–212, 1915 (Nos. 135 and 357) III, pp. 87–9 and 1917 (No. 1349) p. 929.
And whereas it is expedient that in the countries and territories herein-after mentioned the rules set out in the Schedule hereto should come into force:
And whereas the Dominion of Canada has requested and consented to the making of this Order so far as the same extends thereto:
And whereas the provisions of the Rules Publication Act, 1893, have been complied with:
Now, therefore, His Majesty by virtue of the powers in this behalf by the said Prize Courts Act, 1894, and the said Prize Act, 1939, or otherwise in Him vested, is pleased, by and with the advice of His Privy Council, to order, and it is hereby ordered, as follows:—
Forthwith upon the making of this Order:—
(1) The Prize Court Rules, 1914, as amended by the Orders in Council dated the 28th day of November, 1914, the 3rd day of February, 1915, the 29th day of April, 1915, and the 21st day of December, 1917,(a) shall, except in their application to the Union of South Africa and Eire, be revoked.
(2) The rules contained in the Schedule hereto shall come into force in the following countries and territories, that is to say,—
(a) the United Kingdom, the Channel Islands and the Isle of Man,
(b) the Commonwealth of Australia and the Dominion of New Zealand,
(c) British India and British Burma,
(d) Newfoundland and every colony,
(e) every British protectorate, and
(f) every territory in respect of which a mandate on behalf of the League of Nations has been accepted by His Majesty, and is being exercised by His Majesty's Government in the United Kingdom, in the Commonwealth of Australia or in the Dominion of New Zealand,
and (to the extent of His Majesty's jurisdiction therein in matters of prize) in every other country or territory in which for the time being His Majesty has such jurisdiction.
