An Act for authorizing the Corporation of the
Borough of Preston to establish and regulate
Markets and Fairs, to erect a Town Hall, an
Exchange, and Public Offices, and make new
Streets in Preston; and for other Purposes.
[17th May 1861.]
W
HEREAS the Mayor, Aldermen, and Burgesses of the
Borough of Preston (in this Act called " the Corporation")
are,
by various Royal Charters, Grants, Prescriptions, or other-
wise,
entitled to hold all Markets and Fairs within the Borough of
Preston (in this Act called " the Borough"), for the Sale of Cattle,
Grain, Fish, Fruit, Vegetables, Provisions, Hay, Straw, and all other
marketable Commodities, and to demand and take Tolls, Rents, Stallages,
and other Payments in respect
thereof:
And whereas the existing Mar-
kets and Fairs are now held partly in Market Houses and Market Places
provided by the Corporation, and partly in the Streets and public
Thoroughfares of the Borough, to the great Obstruction of the Public,
and to the Inconvenience of the Passengers through and near the same:
And whereas by reason of the Increase of the Population and the Ex-
tension of the Trade and Commerce of the Borough and the Neighbour-
hood
thereof,
it is expedient that the Corporation be authorized to erect

and provide more commodious and convenient Market Houses and
Market Places for the Sale of all marketable Commodities, and to hold
and provide a Cattle Market, and to hold and regulate all Markets and
Fairs within the Borough, and to levy and demand the several Tolls, Rents,
Stallages* and other Payments by this Act authorized: And whereas it
is expedient that the Corporation be authorized to erect and maintain
a Town Hall, an Exchange, Public Offices, and all necessary Buildings in
connexion therewith, and Approaches thereto : And whereas it is expedient
that the Corporation be authorized to make the new Streets and Improve-
ments of Streets by this Act authorized, and to purchase and acquire
Lands for the Purposes of the Markets, Fairs, Town Hall, Exchange,
Public Offices, and all necessary Buildings in connexion therewith, and
Approaches thereto, and for the new Streets and Improvements of Streets
by this Act authorized : And whereas the Borough has been formed into
a District under " The Public Health Act, 1848," and the Corporation are
the Local Board of Health for the Borough: And whereas it is expedient
that the Corporation be authorized to borrow Monies for the above Pur-
poses
;
but the several Objects aforesaid cannot be effected without the
Authority of Parliament: May it therefore please Your Majesty that it
may be enacted; and be it enacted by the Queen's most Excellent
Majesty, by and with the Advice and Consent of
the"
Lords Spiritual and
Temporal, and Commons, in this present Parliament assembled, and by
the Authority of the same, as follows; (that is to say,)
Short
Title.
1. This Act may be cited for any Purposes as " The Preston Cor-
poration Markets Act,
1861."
Limits of
Act.
2.
The Limits within which this Act shall be put in force shall be all
Places within the Borough; and the Expression " the Borough " shall
in this Act mean and include the whole of the Borough of
Preston,
and
the Expression " the Corporation" shall in this Act mean the Mayor,
Aldermen, and Burgesses of the Borough.
3.
This Act shall be executed by the Corporation acting by the
Council of the Borough, pursuant to the Powers and Provisions of the
Act to be
put in exe-
cution by
Corporation. Act of the Sixth Year of King William the Fourth for the Regulation of
Municipal Corporations, and the other Statutes (whether General or
Local) and Laws from Time to Time in force affecting the Municipal
Corporation of the Borough.
Power to
appoint
Committees.
4.
The Corporation may from Time to Time appoint out of their own
Body such and so many Committees, consisting of such Number of
Persons as they shall think fit, for all or any of the Purposes of this Act,
which, in the Discretion of the Corporation, would be better regulated
and managed by means of Committees, and may respectively fix the
Quorum of such Committees: Provided always, that the Acts of every
such Committee shall be submitted to the Council for Approval.
