1964 CHAPTER xviii
An Act to confer further powers on the mayor, aldermen
and burgesses of the borough of Preston, to make further
provision in reference to the Ribble Navigation, the
health, local government, improvement and finances
of the borough, to confer further powers on the
constituent councils of the Preston and District Water
Board in regard to the recovery of rates and charges
on behalf of the board; and for other purposes.

V17HEREAS
(1) The county borough of Preston (hereinafter referred to as
" the borough ") is a municipal borough under the management
and local government of the mayor, aldermen and burgesses of
the borough acting by the council (hereinafter referred to as
"the Corporation"):
(2) It is expedient to confer further powers on the Corporation
in regard to their Ribble Navigation undertaking:
(3) It is expedient that further and better provision should be
made with reference to lands, streets, buildings and markets and
the health, local government and improvement of the borough:
(4) It is expedient to make further provision with regard to
the
finances
of the borough as by this Act provided:

(5) It is expedient that the further powers as by this Act
provided should be conferred upon the Corporation:
(6) It is expedient that the provisions of section 24 of the
Preston and District Water Board Order, 1959, be extended as
in this Act provided:
(7) It is expedient that the other provisions contained in this
Act should be enacted:
(8) The purposes of this Act cannot be effected without the
authority of Parliament:
(9) In relation to the promotion of the Bill for this Act the
requirements of Part XIII of the Local Government Act, 1933,
have been observed:
May it therefore please Your Majesty that it may be enacted,
and be it enacted, by the Queen's most Excellent Majesty, by
and with the advice and consent of the Lords Spiritual and
Temporal, and Commons, in this present Parliament assembled,
and by the authority of the same, as follows:

I
PRELIMINARY
1.—(1)
This Act may be cited as the Preston Corporation
Act 1964.
(2) The Ribble Navigation and Preston Dock Act, 1883, the
Ribble Navigation &c. Act, 1888, the Ribble Navigation
Act, 1889, the Ribble Navigation Act, 1890, the Ribble
Navigation Act, 1892, the Ribble Navigation Act, 1896, and
the Ribble Navigation Act, 1905, and so much of the
Preston Corporation Acts, 1914, 1921, 1931, 1947 and 1952,
and this Act as relates to the Ribble Navigation may be
cited together as the Ribble Navigation Acts, 1883 to 1964.

3.—(1)
In this Act the several words and expressions to which PART I
meanings are
assigned by the Acts wholly or partially incorporated —cont.
herewith or by sections 90 and
343
of
the
Public Health
Act,
1936, Interpretation.
shall have
the same respective meanings unless there be something
in the
subject or context repugnant to such construction.
(2) In this Act unless the subject or context otherwise requires
" the Act of
1933
" means the Local Government Act, 1933;
" the Act of 1936 " means the Public Health Act, 1936;
"the appointed day" has the meaning assigned to it by
section 87 (The appointed day) of this Act;
" the borough " means the county borough of Preston;
" contravention" includes a failure to comply and
" contravene " shall be construed accordingly;
"the Corporation" means the mayor, aldermen and
burgesses of the borough;
" the council" means the council of the borough;
" daily fine " means a fine for each day on which an offence
is continued after conviction;
" enactment" includes an enactment in this Act and in any
general or local Act, and any order, byelaw or regulation
for the time being in force within the borough;
" the existing Acts" means the Ribble Navigation and
Preston Dock Act, 1883, the Ribble Navigation &c.
Act, 1888, the Ribble Navigation Act, 1889, the Ribbk-
Navigation Act, 1890, the Ribble Navigation Act, 1892,
the Ribble Navigation Act, 1896, the Ribble Navigation
Act, 1905, and so much of the Preston Corporation
Acts,
1914, 1921, 1931, 1947 and 1952, as relates to the
Ribble Navigation and each of those Acts is referred to
in this Act as the Act of the year in which it was
passed;
" the general rate fund " means the general rate fund of the
borough;
"the Harbours Clauses Act, 1847" means the Harbours,
Docks and Piers Clauses Act, 1847;
" the Lytham St. Annes Corporation " means the mayor,
aldermen and burgesses of the borough of Lytham
St. Annes;
" magistrates' court" has the same meaning as in sub-
section (1) of section 124 of the Magistrates' Courts
Act, 1952;
" the Minister " means the Minister of Transport;
" Minister of the Crown " has the same meaning as in the
Ministers of the Crown (Transfer of Functions) Act,
1946;
