CHAPTER lxxviii.
An Act to constitute the rural district council of
A.D.
1933.
Plympton St. Mary the harbour authority for
the estuary and tidal waters of the river Yealm
to confer further powers upon the Council in
respect of their water and electricity under-
takings and in regard to moveable dwellings and
to make further and better provision for the
health local government and finance of the
district and for other purposes. [28th July 1933.]
W
HEREAS the rural district of Plympton St. Mary
in the county of Devon (in this Act referred to
as " the district") which comprises nineteen parishes
is under the jurisdiction of the rural district council
of Plympton St. Mary (in this Act referred to as " the
Council"):
And whereas it is expedient that the Council should
be constituted the harbour authority for the estuary
and tidal waters of the river Yealm as defined in this
Act and that they should be authorised to construct
the works in this Act described and exercise the powers
in this Act contained :
And whereas it is expedient that further powers
should be conferred on the Council in respect of their
water and electricity undertakings :
And whereas it is expedient to make further and
better provision with reference to moveable dwellings in
the district the laying out of new streets the construction
of buildings sewers drains and sanitary matters :

1933. And whereas an estimate has been prepared by the
Council for the purpose hereinafter mentioned and such
estimate is as follows :
For the purchase of the lands for and i
for the construction of the works
authorised by this Act - - - £2,300
And whereas the several works included in such
estimate are permanent works and it is expedient that
the cost thereof should be spread over a term of years :
And whereas plans and sections showing the lines
and levels of the works authorised by this Act and
plans showing the lines of the works confirmed by this
Act and also a book of reference containing the names
of the owners and lessees or reputed owners and lessees
and of the occupiers of the lands required or which
may be taken for the purposes or under the powers
of this Act were duly deposited with the clerk of the
county council of Devon which plans sections and book
of reference are in this i\.ct respectively referred to as
the deposited plans sections and book of reference :
And whereas it is expedient that the other provisions
contained in this Act be enacted :
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough Funds
Acts 1872 and 1903 as amended and applied by section 55
of the Local Government Act 1929 have been observed:
May it therefore please Your Majesty that it may
be enacted and be it enacted by the King's most
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons in
this present Parliament assembled and by the authority
of the same as follows :

1. This Act may be cited as the Plympton St. Mary
Rural District Council Act 1933.

This Act is divided into Parts as follows :

3.
The following Acts and parts of Acts (so far as Incorpora-
the same are applicable for the purposes and are not tionofActs.
inconsistent with the provisions of this Act) are hereby
incorporated with this Act (that is to say):
(1) The Lands Clauses Acts except section 127 of
the Lands Clauses Consolidation Act 1845
relating to the sale of superfluous lands :
Provided that the bond required by section 85
of the said Act of 1845 shall be under the
common seal of the Council and shall be
sufficient without the addition of the sureties
mentioned in that section:
(2) The Harbours Docks and Piers Clauses Act 1847
except sections 16 to 19 25 26 30 84 and 85 :
(3) In the application to this Act of the Harbours
Docks and Piers Clauses Act 1847 the expressions
" packet boat " or " Post Office packet " and
" Post Office bag of letters" used in that
Act shall mean respectively a vessel employed
by or under the Post Office or the Admiralty
for the conveyance under contract of postal
packets as defined by the Post Office Act 1908
and a mail bag as defined by the same Act
Provided that nothing in the Harbours Docks
and Piers Clauses Act 1847 or in this Act
shall extend to exempt from rates or duties
any such vessel as aforesaid if she also conveys
passengers or goods for hire.
4.—(1) In this Act the several words and expressions Interpre-
