xlvi
An Act to confer further powers on the urban district
council of Orpington in regard to lands and streets
to make further and better provision for the health
local government finance and improvement of the
urban district
of
the said council and for other
purposes. [30th
July
1954.1
HEREAS the urban district
of
Orpington (hereinafter
referred to as
"
the district
'7
is under the government
of
the urban district council
of
Orpington (hereinafter
referred to as
"
the Council
''1
:
And whereas
it
is expedient that further and better provision
should be made with reference to lands streets buildings and
sanitation and for the local govelrnment and improvement of the
district and that the powers of the Council in relation thereto
should be enlarged and extended
:
And whereas it is expedient to make further provision with
regard to the finances of the district as by this Act provided:
And whereas
it
is
expedient that the other provisions con-
tained in this Act should be enacted
:
And whereas the purposes of this Act cannot be effected with-
out
the authority
of
Parliament
:
And whereas
in
relation to the
Bill
for this Act the require-
have been observed
:

therefore please Your Majesty that it may be enacted

Council Act, 1954
and with the advice and consent
of
the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority
of
the same as follows:-
PART
I
PRELIMINARY
1.
This Act may
be
cited as the Orpington Urban District
Short title.
Council Act 1954.
Division
of
Act
into
Parts.
2.
This Act
is
divided into Parts as follows
:
-
Part I .-Preliminary.
Part 11.-Lands.
Part 111.-Streets.
Part 1V.-Sanitation and buildings.
Part V.-Nuisances.
Part V1.-Burial grounds etc.
Part VI1.-Movable dwellings and camping grounds.
Part VII1.-Finance
etc.
Part IX.-Miscellaneous.
Part X.-General.
Incorporation
of
Lands
Clauses Acts.
3.
The Lands Clauses Acts except sections 127 to 132
of
the
(so
far
as
such Acts are
applicable for the purposes
of
and are not inconsistent with the
provisions of this Act) are hereby incorporated with and form
part
of
this Act:
Provided that the bond required by section 85
Clauses Consolidation Act 1845 shall be sufficient without the
addition
of
the sureties mentioned in that section.
Interpretation.
4.-(1)
In this Act the several words and eqpressions to which
meanings are assigned by sections 90 and 343
of
the Act
of
1936
have the same respective meanings unless there be something
in the subject or context repugnant to such construction and in
this
Act unless the subject or context otherwise requires-

the Act

means the Town and Country Plan-
ning Act 1947
;
"
authorised security
"
means any mortgage stock bond
or
other security which the Council are for the time being

authorised to grant create or issue or upon
or
by
means
of
which the Council are for the time being
authorised
to
raise money
;
classified road
has the same meaning as in the Local
;
clerk
medical officer
surveyor
and
sanitary
inspector
mean respectively the clerk and solicitor the
medical officer
of
health the engineer and surveyor
and any sanitary inspector of the Council and include
any pmson duly appointed iby the Council
to
discharge
temporarily the duties
of
any
of
those officers;
commission
means the British Transport Commission
;
contravention
in relation to any enactment byelaw order
rule term condition restriction
or
notice includes
a
failure to comply with that enactment byelaw order
rule term condition restriction or notice and
contra-
vene
shall be construed accordingly
;
‘Touncil
means the urban district council
of
Orpington
;
county
means the administrative county of Kent
:
county council
means the county council of the county
;
daily penalty
means a penalty for each day on which any
district
means the urban district of Orpington
;
enactment
includes an enactment in this Act or in any
general or local Act and any order byelaw
or
regulation
for the time being in force within the district;
food
has the same meaning as is assigned thereto by
100
of the
Food
and Drugs Act 1938
;
general rate fund
means the general rate fund
of
the
district
;
highway authority
in relation to a street in the district
repairable by the inhabitants at large means the
authority by whom the street
is
for the time being
maintained
;
Minister
means the Minister of Housing and Local
Government
private streets
means streets to which section 150
of
the
Act of 1875 applies
or
land which is deemed to be
a
private street by virtue of subsection (2) of section
48
of the Act of 1947
;
statutory borrowing power
means any power whether or
not coupled with a duty of borrowing
or
continuing on
loan
or
re’borrowing money or
of
redeeming or paying
