An Act for making and maintaining a Navigable Canal, from the Wilts and Berks Canal, in the Parish of Swindon, in the County of Wilts, to communicate with the Thames and Severn Canal, in the Parish of Latton, in the same County.

An A& for making and maintaining a Navigable Canal, from the Wilts and Berks Canal, in * the Parifh of Swindon, in the County of Wilts, to communicate with the Thames and Severn Canal, in the Parifh of Latton. in the fame County. [2d July 1813.] W HEREAS the making and maintaining of a Navigable Canal for Boats, Barges and other Veffels, from and out of the Wilts and Berks Canal, at or near Eaftcott, in the Parifh of Swindon, in the County of Wilts, to join or communicate with the Thames and Severn Canal, at or near a Place called Weymoor Bridge, in the Parifh of Latton in the faid County, will greatly facilitate, and render more! convenient and lefs expenfive than at prefent, the Conveyance of all Kinds of Commodities, to and from the Towns .and Places near the Line of fuch Canal, and will open a Communication between South Wales, the Counties of Hereford, W$rcefter and Gloucefter, and His Majefty VForeft, of Dean, and the City of London; and will alfo be of great public Utility j but fuch Canal cannot be made without the Authority of Parliament: May it therefore pleafe Your Majefty that it may be ena&ed ; and be it enafted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That Lord Vifcount AJhbrook, Nathan Atherton, Atkins Edwin Martin Names of Atkins, Maurice George BiJ/ett, Jofeph Butler, Thomas William, Bejl, The Proprietor* Bollo Pill Railway Company by John Fendall, Thomas,Baker, Thomas Bufl , \Loc. fcf Per.} 36 R Ann 3-a86 53GEORGII III. Mattingly, William Kent, William Brooks and Benjamin Kent, Benjamin Morland, Henry Moore, William Morland, William Mattingly, William Henry Price, John Prower Clerk, Jofeph Pitt, Robert Croome, Devereux Bowiey and William Wood, Jofeph Priejily, the Earl of Peterborough, Jofeph Pitt, James Pullen, Edmund Ruck, William Rowland, Jofeph Bouchier Smith, Richard Stratford, Richard Cowli/haw Sale, John Francis Spenlove, Richard Sfnith, Samuel Shaen, Richard Horfman Solly, George William Syms, Thomas Tubb, William Throckmorttn, William Tubb, William Taylor, Edward Thornhill, James Vine, William Wells, - Henry Walford, Richard Wootten, Thomas Richard Walker, Monton Walhouje, and their relpe&ive Suc-ceffors, Executors, Adminiltrators and Affigns, or fuch of them as (hall from Time to Time he poffeffed of any Share or Shares in the Navigation and Undertaking hereby authorized to be made and carried on, and alfo fuch other Peifon or Perfons as fhall from Time to Time be poffeffed of any Share or Shares therein, fhall be and they are hereby accordingly united into a Company for carrying on, making, completing and maintaining the faid Canal, for the Paffage of Boats, Barges and other Veffels, according to the Rules, Orders and Directions herein-after contained j Proprietors and {hall for that Purpofe be one Body Politic and Corporate, by the Comdannt * Nan\e of " The ComPaI1y of Proprietors of the North Wilts Canal Na-anTteckred vigation," and by that Name fhall have perpetual Succeffion and a Corn-to be aBody mon Seal, and by that Name fhall and may file and be fued'; and fhall Politic and alfo have full Power and Authority to purchafe Lands, Tenements and Sth'powr Hereditaments, to them, their Succeffors and Affigns, for the Ufe of the to purchafe faid Undertaking; and alfo to fell and difpofe of any of the Lands, Te* Lands, Sec. nements or Hereditaments to be purchafed by them, without incurring any of the Penalties or Forfeitures of the.Statutes of Mortmain ; and that it fhall be lavtful for the faid Company of Proprietors, and they are hereby accordingly fully authorized and empowered, from and after the paffing of this AQ., by themfelves or by their Deputies, Agents, Officers, Workmen or Servants, to make and keep navigable and paffable for Boats, Barges and other Veffels, a Canal from and out of the Wilts and Berks Cimalj at or near Eajicott, in the Parifh of Swindon m the County of Wilts, intd and through the feveral Parishes, Townfhips or Places of Swindon, Eajicott, Rodbourne Cheney, Even Swindon, Mortden, Burton* Cricklade Saint Sampfon, Gnat and .Little Chelworth, and Latton, in the faid County of Wilts, to join or communicate with the Thames and Severn Canal, at a Place called Weymoor Bridge, in the Parifh of Latton in the fame County* and to take and ufe Water for puddling the faid Canal, and for making Bricks for the Works of the faid Canal, whilft the fame fhall be : making and hot afterwards, from all fuch Springs as fhall be found in making the faid intended Canal, and from all Rivers, Springs, Brooks, Strearns5 and Wateicourfes whatfoever, which are or fhall be found within the 53*''GEORGil HI. Cap.182; 328.7 the Dlftance of One thoufahd Yards from any Part of the faid intended Canal, and for that Purpofeto make fuch Drains, Channels, or Feeders, as may be neceflary for conducting Water from any fuch Rivers, Springs^ Brooks, Streams, or Watercoufes, to the faid intended Canal or any Part thereof, whiiit the fame (hail be making, as they the faid Company of Proprietors (hall from Time to Time think proper and expedient, and for ever after the faid Canal (hall be made, to fupply the fame with Water from the faid Wilts and Berks Canal Navigation ; and for the feveral Purpofes aforefaid the faid Company of Proprietors, and their Deputies, Agents, Officers, Workmen, and Servants, are hereby authorized and empowered to enter into and upon the Lands and Grounds of or belonging to any-Perfon or Perfons, Bodies Politic, Corporate, or Collegiate whatsoever,-and to furvey and take Levels of the lame or any Part thereof, and to fet out and afcertain fuch Part or Parts thereof as they the faid Company of Proprietors (hall think neceffary and proper for the making, completing, maintaining, improving, and ufing of the faid Canal, and other Works and Conveniences hereby authorized to be made, and there to bore, dig, cut, trench, and fough, and alfo to remove, carry away, and take any Earth, Clay, Stone, Soil, Rubbifh, Trees, Roots of Trees, Beds of Giavel or Sand, or any other Matters or Things whatfoever, which (hall or may be dug or got in the making, or which may hinder, prevent, or obftruft the making, carrying on, maintaining, or repairing of the faid Canal and other Works, or of fuch Drains, Channels, or Feeders as (hall be necefTary to convey Water to or from the faid Canal, whilft the fame fhall be making, according to the true Intent and Meaning of this Aft j and alfo to make, build, ered, or fet up in or upon the faid Canal, or in or upon the Lands adjoining or near thereto, fuch and fo many Bridges, Tunnels, Soughs, Aqueducts, Sluices, Locks,' Flood Gates, Weirs, Pens for Water, Water Stanks, Bafons, Drains, Wham,jC)uays, Toll Houfes, Warehoufes, Watch Houfes, Landing Places, Weighing Beams, Cranes, Docks* Ways, Roads, and Conveniences as and where they the faid Company of Proprietors (hall think requifite and convenient j and from. Time to Time to alter, repair and amend, or difcontinue the fame, or any of them, as (hall be thought expedient and ufeful for the Purpofes of the faid intended Navigation, and for the carrying and conveying of Goods, Wares, Merchandizes, and other Things to and from the faid Canal, and for the carrying and conveying of all Kinds of Materials neceffary for the., making, erefting, finifliing, altering, repairing, amending, widening, or enlarging of the faid Canal and other Works reflectively, and to place, lay, work, or manufacture any Materials on the Lands or Grounds near to the Place or Places (other than and except any Part of the Towing Path belonging to, or any Part of the Lands veiled in, the Proprietors of the Thames and Severn Canal) where the faid Works or any of them (hall be carrying on ; and alfo from Time to Time to make, maintain, repair, divert, and alter any Fences, Roads, oi Paffages over, under, or through the faid Canal, or the Tunnels, Aqueducts, Soughs, Trenches, Gutters, Watercourfes, and Sluices, which (hall communicate therewith refpeftively; and alfo to make, fet out, and appoint fuch Towing Paths, Banks, Roads, and Ways, for the towing, hauling, or drawing of Boats, Barges, or other Veflels palling upon the faid Canal with Men, Hordes, or otherwife, and fuch convenient Places for Boats, Barges, and other Veffels to turn, lie in, or pafs each other, as the faid Company of Proprietors (hall think proper and expedient j 5 and 3388 539GEORGII HI.
