CHAPTER lxxv.
An Act to vest in the mayor aldermen and burgesses A.D. 1937.
of the borough of Newcastle-under-Lyme the
properties and liabilities of the trustees of the
Newcastle-under-Lyme Marsh Lands to confer
further powers upon the said mayor aldermen
and burgesses with reference to their gas and
electricity undertakings and to make further
provision with regard to the health local govern-
ment and improvement of the said borough
and for other purposes. [13th July 1937.]

HEREAS the borough of Newcastle-under-Lyme
(in this Act called "the borough") is under the
local government of the mayor aldermen and burgesses
of the borough (in this Act called " the Corporation "):
And whereas by an Act passed in the twenty-second
year of the reign of His Majesty King George III

intituled " An Act for inclosing and leasing a piece c-29-
of waste land called The Marsh within the parish
and borough of Newcastle-under-Lyme in the county
of Stafford and applying the profits thereof in aid
of the poor's rates of the said parish and borough "
(in this Act referred to as " the Act of 1782 ") certain
persons therein named were appointed trustees for the
purpose of putting that Act and the several powers
therein contained into execution and a piece or parcel
of waste land called " the Marsh " was vested in the
said trustees and their successors for ever :

1937. And whereas by the said Act of 1782 powers were
conferred upon the said trustees with reference to the
making of leases the division of the said land into lots
and other matters and it was provided that after
making certain payments referred to in the Act the
residue and remainder of the money to arise from time
to time under or by virtue of the Act after defraying
the expenses attending the execution thereof and the
trusts vested thereby in the said trustees should be
applied to and disposed of in the relief and maintenance
of the poor of the said parish and borough and in aid
and ease of the poor's rates within the same :
And whereas further powers with reference to the
said land were conferred upon the said trustees by an

3. Act passed in the twenty-third year of the reign of His
c-10- said Majesty King George III intituled " An Act to
" amend an Act passed in the twenty-second year
" of His present Majesty's reign intituled 'An Act for
" ' inclosing and leasing a piece of waste land called The
" 'Marsh within the parish and borough of Newcastle -
" 'under-Lyme in the county of Stafford and applying
" ' the profits thereof in aid of the poor's rates of the
" ' said parish and borough'" (in this Act referred to
as "the Act of 1783"):

And whereas by the Newcastle-under-Lyme Marsh
c. xliii. Lands Act 1861 (hereinafter referred to as " the Act
of 1861 ") it was enacted that the persons therein named
(being trustees appointed by or elected under the Acts
hereinbefore referred to) and being the only persons
then living who had at any time since the first day
of January eighteen hundred and fifty-six acted as
trustees under the said Acts and the further trustees
to be thereafter elected under the said Acts in order
to make up the number of trustees to twenty-four and
the successors of such existing and further trustees
to be from time to time elected under the said Acts
or either of them should thenceforth be called " the
Trustees of the Newcastle-under-Lyme Marsh Lands "
and by that name should be a body corporate with
powers to purchase take and hold and sell and convey
lands hereditaments and other properties for any of the
purposes of the Act of 1861:
And whereas by the Act of 1861 all the estate right
and interest of the trustees under the Acts of 1782

and 1783 in the lands hereinbefore referred to and in the A.D. 1937.
other property therein mentioned were absolutely vested
in the trustees incorporated by the Act of 1861 in fee
simple and those trustees were empowered to divide
and sell or let such lands and other powers with regard
thereto were conferred upon such trustees :
And whereas the estate now vested in and belonging
to the trustees consists of the lands buildings properties
funds rights and privileges set forth in the First
Schedule to this Act:
And whereas it is expedient that the property
rights and liabilities now vested in the trustees should
be transferred to the Corporation and that the trustees
should be dissolved:
And whereas it is expedient to confer further powers
upon the Corporation with reference to the acquisition
retention disposal and development of lands :
And whereas the Corporation are the owners of the
undertakings whereby the borough is supplied with gas
and electricity and it is expedient to confer further
powers upon the Corporation with reference to their
gas and electricity undertakings and the supply of gas
and electricity by them :
And whereas it is expedient to make further provi-
sion with regard to streets buildings and camping
grounds in the borough and that the powers of the
Corporation in relation to the health local government
and improvement of the borough be enlarged as by this
Act provided:
And whereas it is expedient to provide for the
establishment of a consolidated loans fund by the
Corporation and to make further provision with regard
to the finances of the Corporation and the application
of the revenues of their several undertakings :
And whereas it is expedient that the other provi-
sions contained in this Act be enacted:
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas in relation to the promotion of the Bill
for this Act the requirements of Part XIII of the Local

Government Act 1933 have been observed.:
