"THEREAS a Railway from the Harwich Branch of the Great
%/%/ Eastern Railway at Mistley to Walton-le-Sohn otherwise

Walton-on-the-Naze,
all in the County of Essex, would be of
public Advantage: And whereas the Persons in this Act named, with
others, are willing to form a Company and carry the Undertaking into
effect: And whereas the Objects of this Act cannot be attained without
the Authority of Parliament: May it therefore please Your Majesty that
it may be enacted ; and be it enacted by the Queen's most Excellent
Majesty, by and with the Advice and Consent of the Lords Spiritual and
Temporal, and of the Commons, in this present Parliament assembled,
and by the Authority of the same, as follows; (that is to say,)

(save so far as any of the Clauses or Provisions thereof respectively
are by this Act expressly excepted or varied,) are respectively incorporated
with this Act.
2.
In construing the incorporated Acts for the Purposes of this Act,
and in construing this Act, the Words and Expressions herein mentioned
or referred to shall have the Meanings hereby assigned to them respec-
tively, unless there be something in the Subject or Context repugnant to
such Construction; (that is to say,)
The Expression " the Special Act" shall mean this Act:
The Expression " the Company," or " the Promoters of the Under-
taking," shall mean the Company incorporated by this Act:
The Expression " Superior Courts," or " Court of competent Jurisdic-
tion," or any other like Expression, shall be read and have effect as
if the Debt or Demand with respect to which the Expression is
used were a common Simple Contract Debt, and not a Debt or
Same Mean- Demand created by Statute :

anc[ Corporations who have already subscribed or may here-
after subscribe to the Undertaking, and their Executors, Administra-
tors,
Successors, and Assigns respectively, are by this Act united into a
Company for the Purpose of making and maintaining the Railway, and
for other the Purposes of this Act, and for those Purposes are by this Act
incorporated by the Name of " The
Mistley,
Thorpe, and Walton Railway
Company," and by that Name shall be a Body Corporate with perpetual
Succession and a Common Seal, and with Power to purchase, take, hold,
and dispose of Lands and other Property for the Purposes but subject to
the Restrictions of this Act.
Capital. 4. The Capital of the Company shall be Sixty thousand Pounds in Six
thousand Shares of Ten Pounds each.
Calls.
5. Two Pounds a Share shall be- the greatest Amount of a Call, and
Two Months at least shall be the Interval between successive Calls, and
Four Fifths of the Amount of the Share shall be the. utmost aggregate
Amount of the Calls made in any Year upon any Share.
6. The Company from Time to Time may borrow on Mortgage any
Sums not exceeding in the whole Twenty thousand Pounds, but no Part
thereof shall be borrowed until the whole of the Capital of Sixty thousand
Pounds is subscribed for or taken, and One Half thereof is paid up, nor
until the Company has proved to the Justice who is to certify under the
Fortieth
