An Act to confirm certain Provisional Orders of a.d. 193j. the Minister of Health relating to the Counties of Gloucester Warwick and Worcester. [27th March 1931.] W HEREAS under the provisions of the Local Govern- 51 & 52 Vict. ment Act 1888 the Minister of Health has made 0. 41. certain provisional orders which need confirmation by Parliament: Be it therefore enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows: 1. The orders of the Minister of Health which as Orders in amended are set out in the schedule to this Act are schedule hereby confirmed and shall have full vaHdity and force, confirmed. 2, This Act may be cited as the Ministry of Health Short title, Provisional Orders Confirmation (Gloucestershire War wickshire and Worcestershire) Act 1931. SCHEDULE, Worcestershire to Gloucestershire Order. Short title. COUNTIES OF GLOUCESTER AND WORCESTER. Provisional Order made in pursuance of the Local Govern* ment Act 1888 for altering county boundaries. WHEREAS by section 54 of the Local Government Act 1888 the Minister of Health is empowered to make a provisional order altering the boundary of any county; And whereas the several parishes named in column 1 of the first schedule to this order form part of the administrative county of Worcester and, a representation has been made to the Minister of Health by the county council of Gloucester that it is desirable that the boundaries of the counties of Gloucester and Worcester should be altered so as to transfer those parishes to the county of Gloucester; And whereas the Shipston-on-Stour rural district which comprises the parish of Blockley and four other parishes is a detached part of the county of Worcester; And whereas the parish of Redmarley D'Abitot and the parish of Staunton form an unnamed rural district in the county of Worcester which is administered by the council of the rural district of Newent in the county of Gloucester; And whereas the parishes of (a) Chaceley and Teddington; (6) Cutsdean; and (c) Daylesford (otherwise Dalesford) and Evenlode; in the county of Worcester are comprised within the rural districts of Tewkesbury Winchcomb and Stow-on-the-Wold but the remainder of the parishes within the rural districts of Winch-comb and Stow-on-the-Wold are within the county of Gloucester and a majority of the parishes within the Tewkesbury rural district are within that county : Now therefore the Minister of Health in pursuance of the powers given to him by sections 54 and 59 of the Local Government Act 1888 and of all other powers enabling him in that behalf hereby orders as follows : Part I. Preliminaby. 1. This order may be cited as the Worcestershire to Gloucestershire Transfer Order 1931. 2 [21 Geo. 5.] Ministry of Health [Cll. ix.J Provisional Orders Confirmation (Gloucestershire Warwickshire and Worcestershire) Act, 1931. 2. In this order unless the context otherwise requires ^.D. 1931. " County " means an administrative county; " Existing" means existing immediately before the Wwpester- appointed day; otoucJL- " The Act of 1888 " means the Local Government Act shire Order. 1888; Interpret " The appointed day " means the first day of April nineteen tation- hundred and thirty-one; " The Campden rural council" means the rural district council of Campden; " The counties" means the administrative counties of Gloucester and Worcester and " the county councils " means the councils of those administrative counties; " The Minister " means the Minister of Health; " The Shipston rural district " means the rural district of Shipston-on-Stour as it exists immediately before the appointed day and " the Shipston rural council" means the rural district council of that rural district; " The transferred parishes " means the parishes mentioned in column 1 of the first schedule to this order; " The unnamed rural district " means the unnamed rural district consisting of the parishes of Redmarley D'Abitot and Staunton which is administered by the rural district council of Newent. When the day on which anything is required by this order Provision to be done falls on a Sunday Good Friday or a bank holiday that for Sundays thing shall be done on the next following day not being one of ?n,4Pubuo the days already mentioned. 1 ays* Save as otherwise expressly provided this order shall Commence-come into operation on the first day of April nineteen hundred mentf and thirty-one : order- Provided that for the purposes of the alteration of valuation lists to take effect on the appointed day or the preparation or revision of any estimate of the produce of a penny rate or the preparation of any precept to be made in respect of the financial year commencing on the appointed day this order shall operate from the date of the Act of Parliament confirming this order. Part II. Alterations of Boundaries of Counties and Rural Districts. 5. The parishes mentioned in column 1 of the first schedule Alterations to this order shall cease to form part of the county of Worcester of county and shall be transferred to the county of Gloucester. boundaries. A 2 3 A.D. 1931. Worcestershire to Gloucestershire Order. Alterations and continuance of rural districts. [Ch. ixj Ministry of Health [21 Geo. 5.] Provisional Orders Confirmation (Gloucestershire Wanvick'shire and Worcestershire) Act, 1931. 6.(1) The unnamed rural district consisting of the parish of Redmarley D'Abitot and the parish of Staunton shall cease to exist and those parishes shall be transferred to the rural district of Newent and there shall be one general rate fund and general rate for that rural district as extended by this order. The parish of Blockley shall be separated from the rural district of Shipston-on-Stour and shall form part of the rural district of Campden and until the Minister by order otherwise directs the special drainage district of Blockley and the remainder of the parish of Blockley shall be separate contributory places of the Campden rural district. The parishes of Chaceley and Teddington shall continue to form part of the Tewkesbury rural district the parish of Cuts-dean shall continue to form part of the Winchcomb rural district and the parish of Daylesford (otherwise Dalesford) and the parish of Evenlode shall continue to form part of the Stow-on-the-Wold rural district. Election and continuance in. office of county councillors Electoral divisions. Assizes sessions sheriff lieutenant coroner territorial army jtirors (fee. Part III. Provisions consequent on Alteration of County Boundaries. 7.(1) The ordinary election of county councillors in the present year shall be held for the existing counties and for the existing electoral divisions of those counties. Notwithstanding the alterations of area made by this order any person elected at the ordinary election of county councillors in the present year to represent an existing electoral division affected by this order shall continue a member of the county council to which he was elected unless and until other provision shall be made in an order of the Secretary of State for the alteration of electoral divisions. As from the appointed day each of the transferred parishes shall form part of the electoral division of the 'county of Gloucester named in column 2 of the first schedule to this order opposite the name of the transferred parish in column 1 of that schedule. , 8.(1) For the purposes of any commission of assize oyer and terminer or gaol delivery and for the purposes of sheriff heutenant and territorial army and the making up of the jurors book and the qualification and service of jurors the transferred parishes shall form part of the county of Gloucester. (2) The powers and duties of the quarter sessions justices coroners and clerk of the peace of the county of Gloucester and of the police constables and other peace officers of that county shall extend to the transferred parishes. 4 [21 Geo. 5.] Ministry of Health [Ch. ixj Provisional Orders Confirmation (Gloucestershire Warwickshire and Worcestershire) Act, 1931. Worcester* shire to Gloucester- shire Order* Each of the transferred parishes shall form part of the A.D. 1931 petty sessional division and coroner's district of the county of Gloucester named in columns 3 and 4 of the first schedule to this order opposite the name of the transferred parish in column 1 of that schedule. Notwithstanding the foregoing provisions of this section {a) Until the jurors books prepared next after the appointed day come into force the transferred parishes shall for the purposes of summoning jurors and of jury service be deemed to continue part of the county of Worcester; and (b) Every person committing an offence in any of the transferred parishes prior to the appointed day shall be tried and dealt with as if this order had not been made and every proceeding which prior to the appointed day has been begun by or before any court or justice or coroner in relation to any matter arising in or concerning any of the transferred parishes may be continued or completed in like manner and with the like incidents and consequences as nearly as may be as if this order had not been made. 9.(1) On the appointed day such number of the members Transfer of of the police force of the county of...
