An Act to confirm a Provisional Order of the
A.D.
1933.
Minister of Health relating to the Counties of
Chester and Lancaster. [29th March 1933.]

HEREAS under the provisions of the Local
51 &
52 Viet.
Government Act 1888 the Minister of Health c-41-
has made a provisional order which needs confirma-
tion hy Parliament:
Be it therefore enacted by the King's most Excellent
Majesty by and with the advice and consent of the Lords
Spiritual and Temporal and Commons in this present
Parliament assembled and by the authority of the same
as follows :
1.
The order of the Minister of Health which as Order in
amended is set out in the schedule to this Act is hereby schedule
confirmed and shall have full validity and force. confirmed.
2.
This Act may be cited as the Ministry of Health Short title.

SCHEDULE.
COUNTIES OF CHESTER AND LANCASTER.
Cheshire and
Lancashire
Order.
Short title.
Interpreta-
tion.
Provisional Order made in pursuance of the Local
Government Act 1888 altering county boundaries.
WHEREAS by section 54 of the Local Government Act 1888
the Minister of Health is empowered to make a provisional order
for the alteration of the boundary of a county;
And whereas the existing parishes entered in column 1 of the
first schedule to this order form part of the administrative county
of Chester and the existing parishes entered in column 1 of the
second schedule to this order form part of the administrative
county of Lancaster;
And whereas a joint representation has been made to the
Minister of Health by the county councils of Chester and
Lancaster that it is desirable that portions of the common
boundary of the administrative counties of Chester and Lancaster
which in general now follow the River Mersey should be altered
so as to follow (except as respects a short length of those portions
of the common boundary) the centre of the Manchester Ship
Canal and that accordingly parts of certain parishes should be
transferred from one administrative county to the other adminis-
trative county :
Now therefore the Minister of Health in pursuance of the
powers given to him by section- 54 of the Local Government Act
1888 and of all other powers enabling him in that behalf hereby
orders as follows :
PAET I.
PRELIMINARY.
1.
This order may be cited as the Cheshire and Lancashire
Order 1932.
2.—(1) In this order unless the context otherwise requires
" county " means an administrative county;
" existing" means existing immediately before the
appointed day;

" parish " includes a township which is a civil parish; A.D. 1933.
" road " means a highway repairable by the inhabitants, ~7~
at large and includes any bridge so repairable carrying LamcasMre
the road;
Order.
" the Act of 1888 " means the Local Government Act
1888;
" the appointed day " means the first day of April nineteen
hundred and thirty-three;
" the Cheshire areas " means those parts of the existing
parishes entered in column 1 of the first schedule
which are distinguished on the maps by the colour
mentioned in column 2 of that schedule opposite the
name of the parish and are transferred to the county
of Lancaster;
" the county councils" means the county councils of
Chester and Lancaster;
" the Lancashire areas " means those parts of the existing
parishes entered in column 1 of the second schedule
which are distinguished on the maps by the colour
mentioned in column 2 of that schedule opposite the
name of the parish and are transferred to the county
of Chester;
" the maps" means the triplicate maps marked "Map
" referred to in the Cheshire arid Lancashire Order
" 1932" and sealed with the official seal of the
Minister;
" the Minister " means the Minister of Health;
" the transferred areas " means the Cheshire areas and the
Lancashire areas.
(2) Unless the context otherwise requires any reference in
this order to
(a) a schedule shall be read as a reference to a schedule to
this order;
(6) the alteration extension inclusion or transfer of an area
shall be read as a reference to that operation as effected
by this order.
3.
This order shall have effect subject to the provisions of Effect of
any regulations made or to be made by the Minister under regulations
Part VI of the Local Government Act 1929 with respect to ofMinister-
grants payable under that Part of that Act.
4.
Save as otherwise expressly provided this order shall Commence-
come into operation on the first day of April nineteen hundred menfc of
and thirty-three : order'
