CHAPTER xx.
An Act to authorise the mayor aldermen and bm-gesses

1907.
of the county borough of Middlesbrough to construct a
transporter bridge across the River Tees and to discon-
tinue the Middlesbrough and Port Clarence Ferry and
for other purposes. [4th July 1907.]

HEREAS the borough of Middlesbrough in the north riding
of the county of York is a municipal borough and under
the government of the mayor aldermen and burgesses thereof
(hereinafter called " the Corporation ") and is a county borough
under the Local Government Acts 1888 and 1894 and the Corpo-
ration acting by the council of the borough are the urban sanitary
authority of the district of the borough:
And whereas the Corporation are under and by virtue of the
Middlesbrough Improvement Act 1856 the Middlesbrough Improve-
ment Act 1858 the Middlesbrough Extension and Improvement Act
1866 and the Middlesbrough Improvement Act 1877 the owners
of the Middlesbrough and Port Clarence Ferry and landing places
on the north and south sides of the River Tees and are also the
owners of ferry or passage boats plying between those places :
And whereas the construction of a transporter bridge across
the River Tees between Middlesbrough and Port Clarence would
be of public and local advantage and it is expedient that the
Corporation be authorised to construct and maintain the same
and if they think fit to suspend or discontinue the working of
the said ferry :
And whereas estimates have been prepared by the Corporation
for the cost of and connected with the works authorised by this
Act (including land) amounting to seventy-seven thousand pounds :

1907. And whereas the works included in such estimates are per-
manent works and it is expedient that the cost thereof be spread
over a term of years:
And whereas the objects of this Act cannot be effected without
the authority of Parliament:
And whereas plans and sections showing the lines and levels
of the works by this Act authorised and the lands which are liable
to be taken under the powers of this Act with books of reference
to those plans containing the names of the owners and lessees
and of the occupiers of the said lands were duly deposited with
the clerks of the peace for the north riding of the county of York
and the county of Durham respectively and those plans sections
and books of reference are hereinafter respectively referred to as
the deposited plans sections and books of reference :
And whereas an absolute majority of the whole number of
the council of the borough at a meeting held on the tenth day
of December one thousand nine hundred and six after ten clear
days'
notice by public advertisement of such meeting and of the
purpose thereof in the Northern Echo a local newspaper published
and circulating in the borough such notice being in addition to
the ordinary notices required for summoning such meeting resolved
that the expense in relation to promoting the Bill for this Act
should be charged on the borough fund and borough rate of the
borough :
And whereas the said resolution was published twice in the
said Northern Echo and has received the approval of the Local
Government Board:
And whereas the propriety of the promotion of the Bill for
this Act was confirmed by an absolute majority of the whole
number of the council at a further special meeting held in pur-
suance of a similar notice on the fourteenth day of January one
thousand nine hundred and seven being not less than fourteen
days after the deposit of the Bill in Parliament:
And whereas in relation to the promotion of the Bill for
this Act the requirements contained in the First Schedule to the
Borough Funds Act 1903 have been observed:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say):
