and other Commonable Lands, within the Town-
fhip of Mickkton and Pariih of
Romaldkirk^

North Riding of the County of Torh

HEREAS there is within the Manor and Townfliip of
Mickle*
ton in the Parifh of Romaldkirk, in the North Riding of the
County of Tork, a certain Moor or Common called Mickkton
Moor, containing by Eftimation Three thoufand three hundred and fifty
Acres or thereabouts; and there are within the faid Manor and Town*
fhip divers Fields or Grounds lying together, and moftly open and unin*
clofed, which are called Mickkton

Fields^ and contain in the Whole
by Eftiraation Four hundred and ten Acres or thereabouts

are alio within the faid Manor and Townfhip certain Stinted Pafture
Lands or Grounds^ containing together by Eftimation Five hundred and
ninety-fix Acres or thereabouts, and commonly called
Mickteton
Eaft
and
Weft,Pajiures: And whereas the Right Honourable John
Bowes
Earl of
Strathmore as Lord of the faid Manor of Mickkton is feifed of of entitled
to the Soil and Royalties df and within the faid Moor call Mickkton
Moor9
and is alfo feifed of or entitled to all Mines, Minerals, and Quarries*
within and under the faid Stinted Paftures called Mickkton Eaft and Weft

Paftures, and alfo within and under fuch Parts of the faid Town Fields Zi
are held under feveral Leafes granted
thereof,
by fome or One of his
Anceftors, to divers Perfons, for long Terms of Years, at and under
feveral fmall referved yearly or other Rents, Suits, Dudes, and Services,-
payable and to be performed for of in refpeft of the fame ; and the faid
Earl of Stratbmore is alfo feifed to him and his Heirs of the Reverfion and
Inheritance of and in divers Mefluages, Lands, and Tenements expectant
on the Determination of feveral Leafes granted thereof by fome or One of
his Anceftors, to divers Perfons, for long Terms of Years as aforefaid; and
the faid feveral Leflees are, in refpett of fuch Mefluages, Lands* and
Tenements, entitled to Right of Common in and upon the faid Moor
called Mickleton Moor ; and fuch Leafeholders and other Perfons claim to
have the Right of getting Lime Stone from or under the faid Moor and
Town Fields refpe&ively, for the Ufe of their refpe&ive Buildings, and for
the manuring and improving of their refpeitive Lands: And whereas the
faid Earl of

feveral other Perfons, Owners of Mefluages, Mills, Lands, Tenements, or
Hereditaments, or their refpeftive Truftees, Leflees, Farmers, or Tenants,
are alfo entitled to have and enjoy Right of Common in, upon, and over
the faid Moor called Mickleton Moor9 in refpeft of or as appendant or ap-
purtenant or belonging to fuch their faid feveral Mefluages, Lands, Tene-
ments, or Hereditaments, and the faid Earl of Stratbmore and divers other
Perfons are feverally Owners and Proprietors of the faid Fields or Grounds
called Mickleton Town Fields^ and the faid Stinted Paftures called Mickleton
Eaft and Weft Pa/lures, in feveral fpecifick Shares or Proportions, fome
whereof are of Freehold Tenure, and the other Parts thereof are held
.under divers Leafes for long Terms of Years, granted by fome or One of
the Anceftors of the faid Earl of Stratbmore : .And whereas the faid Com-
mon or Moor called
Mickleton'Moor*
and the faid Stinted Paftures called
Micklepop.
Faft andWtft Paftures, are in their prefent State but of little Ufe
or Service, and the Lands of the feveral Proprietors of and in the faid
Fields^or Grounds called Mickleton Town Fields, lie intermixed and dif-
perfed in fmall Parcels, and are in other Refpe&s inconveniently fituated
and incapable of Improvement j and therefore the faid Earl of Stratbmore,
and fuch feveral pfhtr Proprietors as aforefaid, are defirous that the faid
Common or Moor, Town Fields, and Stinted Paftures, fhall be refpec-
tivety divided and inclofed, fo as that fpecifick Shares thereof may be
allotted to thprn refpeiti^ely, according to their feveral Rights and Interefts
therein \ but although fuch Divifions, Allotments, and Inclofures, would
be.
of great publick Utility, yet the fame cannot be effe&ually completed
and eftablifhed without the Aid and Authority of Parliament: May it
therefore pleafe Your Majefty that it may be ena,6ted; and be it enaded
by the King's mod Excellent Majefty, by and with the Advice and Con-
fent of the Lords Spiritual and Temporal, and Commons, in this prefent
v.. M Parliament affembled, and by the Authority of the fame, That all the faid

Paftures^ fhall be refpeftively divided, fet out, and allotted-, as foon as may
