in substitution for and in addition to those
already authorized, and for other Purposes.

HEREAS by the Acts mentioned in the Schedule hereunto
W
annexed as having been passed in reference to " the
Birken-
head
Dock Trustees," and in reference, to " the
Birkenhead
Dock Company," certain Docks, Buildings, and Works have been autho-
rized to be constructed at
Birkenhead,
Part of which only have yet
been constructed : And whereas the several other Acts mentioned in the
Schedule hereunto annexed have been passed in reference to the
Liver-
pool
Docks : And whereas under or by virtue of the Local and Personal
Act 20 and 21

into One Estate, and

for vesting the Control and Management of them in One Public Trust,
and
for other Purposes,
the
Mersey
Docks and Harbour Board, nomi-
nated and elected under the Authority of the Provisions therein contained,
have become possessed of and entitled to, amongst other Property, all such

Short Title.
Interpreta-
tion of Terms
in this Act.
Estate and Interest in the Docks, Buildings, and other Works con-
structed under the Authority of the several Acts mentioned in Parts I.
and II. of the said Schedule, as were transferred or were intended to be
transferred to the Corporation of
Liverpool
by " The
Birkenhead
Docks
Act, 1855," (being One of such Acts,) and are authorized and in some
Instances are required to construct such of the Docks, Buildings, and
other Works by such Acts or any of them authorized to be constructed
as have not yet been constructed or completed : And whereas the
Bir-
kenhead
Docks would be rendered more available for the Commercial
Purposes of the Port of
Liverpool
if the Board were authorized to con-
struct certain Works in lieu of the Works authorized or required to be
constructed by the said Acts passed in reference to the
Birkenhead
Dock
Trustees, and in reference to the
Birkenhead
Dock Company : And
whereas the Objects and Purposes aforesaid cannot be effected without
the Authority of Parliament : And whereas the Board, in obedience to a
Provision contained in "The
Mersey
Docks and Harbour Act, 1857,"
are now prosecuting a Bill in Parliament for the -Purpose of repealing
the several Acts mentioned in the said Schedule, and for consolidating
the several Provisions contained in the said Acts, which Bill is herein-
after referred to as " the proposed Act :" May it therefore please Your
Majesty that it may be enacted ; and be it enacted by the Queen's most
Excellent Majesty, by and with the Advice and Consent of the Lords
Spiritual and Temporal, and Commons, in this present Parliament
assembled, and by the Authority of the same, as follows :
I.
In citing this Act in other Acts of Parliament and in legal Instru-
ments, it shall be sufficient to use the Expression " The
Mersey
Docks
and Harbour (Works) Act, 1858."
II.
In the Construction of this Act the following Words and Expres-
sions shall have the several Meanings hereby assigned to them, unless there
be something in the Subject or Context repugnant to such Construction :
" The Board" shall mean the
Mersey Docks and Harbour Board,
established by " The
Mersey
Docks and Harbour Act, 1857 :"
" The Corporation " shall mean the Mayor, Aldermen, and Burgesses
of the Borough of
Liverpool :
"
The County " shall mean the County of
Chester:
"
The Sheriff" shall mean the Sheriff of the County of
Chester,
and
shall include his Under Sheriff or other legally competent Deputy :
The Word " Justice" shall mean any Justice of the Peace having
Authority, either under the proposed Act or otherwise, to act in or
for the Place where the Matter requiring the Cognizance of such
Justice arises, and where such Matter arises in respect of Lands
situate not wholly in any One Jurisdiction shall mean a Justice
having such Authority as aforesaid to act in or for the Place where
