CHAPTER lxxxvii.
An Act to enable the mayor aldermen and
burgesses of the borough of Macclesfield to
construct further waterworks to reduce the
amount of compensation water which they are
required to discharge into the river Bollin to
confirm an agreement for the purchase of the
undertakings of the Electricity Company of
Macclesfield Limited to make further provision
with regard to streets buildings sewers and
drains and the health and good government
of the borough and for other purposes.

HEREAS the borough of Macclesfield (in this
Act called "the borough") is under the muni-
cipal and local government of the mayor aldermen and
burgesses of the borough (in this Act called "the
Corporation "):
And whereas the Corporation supply water in the
borough and the supply of water from their water-
works is inadequate to meet the growing demands of
the borough and it is expedient that the Corporation
should be empowered to construct the additional
waterworks authorised by this Act:
And whereas by section 32 of the Macclesfield

Borough Waterworks Act 1849 it was enacted that as c-XXV1-

being of the mills and works of Messieurs Isaac Smith
Samuel Smith and William Pritchard or any of them
and of Messieurs Charles Wood and Richard Wood
situate in Sutton and which might be affected by the
waterworks compulsorily authorised by the said Act
the Corporation should be required to discharge from
and out of the then intended reservoir to be called the
Bottoms reservoir on each and every working day
for the supply of the said mills and works a quantity
of water equal at least to three cubic feet per second
for twelve hours of every working day :

:
Whereas the total quantity of compensation
water which the Corporation are required by
section 32 of the Act of 1849 to discharge from
the Bottoms reservoir considerably exceeds one-
third of the mean available rainfall in three
consecutive dry years of the whole gathering
ground of the Corporation above the said
Bottoms reservoir it is hereby enacted that the
provisions of the said section 32 of the Act
of 1849 shall be accepted and taken by all
persons interested as full compensation for all
the water of the Bollin Brook the Tupclose
Stream the Nessit Stream the Parting Gap
Stream the Winshaw Stream the Lower Hollin-
tongue Stream and the Twelveashes Stream
which the Corporation can divert collect
impound or appropriate by means of the works
by this Act authorised :
And whereas it is expedient that the obligations
of the Corporation with regard to the discharge of
compensation water into the river Bollin should be

should be conferred upon the Corporation with respect
to their water undertaking :
And whereas the Electricity Company of Maccles-
neld Limited supply electricity for public and private
purposes in part of the borough under the Maccles-
held Electric Lighting Order

the townships of Chorley Great Warford Kettleshulme
and Woodford and parts of the townships of Alderley
Inferior Poynton-with-Worth and Taxal) under the
Macclesfield Electricity (Extension) Order 1929 :
And whereas the Corporation in pursuance of the
powers contained in section 9 (Power of purchase by
Corporation) of the said Order of 1911 have exercised
their right to require the Electricity Company of
Macclesfield Limited to sell to the Corporation the
undertaking authorised by that Order :
And whereas the Corporation have agreed with
the said company to purchase the undertaking
authorised by the said Order of 1911 together with the
undertaking authorised by the said Order of 1929 upon
the terms contained in the agreement scheduled to
this Act as modified by the section of this Act of which
the marginal note is "As to officers and servants of
company " :
And whereas it is expedient that the said agree-
ment should be confirmed and made binding on the
company and the Corporation :
And whereas it is expedient to confer upon the
Corporation the further powers with regard to the
supply of electricity by them contained in this Act:
And whereas it is expedient to make further and
better provision with regard to streets buildings
sewers and drains in the borough and for the health
and good government of the borough and to enlarge
the powers of the Corporation with regard to those
matters as provided by this Act:
And whereas it is expedient that the other
provisions contained in this Act be enacted :
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by
the Corporation for the following purposes (that is
to say): £
(a) For and in connection with the
purchase of lands and easements - 3,800
