CHAPTER liv.
An Act to provide for the transfer of the undertaking
A.D.
1915.
of the Lurgan Gas light and Chemical Company
Limited to the urban district council of Lurgan to
confer further powers on the Council with respect to
the supply of gas electricity and water and to make
further and better provision for the improvement health
and local government; of the district and for other
purposes. [15th July 1915.]

HEREAS the district of Lurgan in the county of Armagh
was in the year 1854 constituted a town in pursuance of
the provisions and for the purposes of the Towns Improvement
(Ireland) Act 1854:
And whereas by the Public Health (Ireland) Amendment
Act 1879 the Town Commissioners of Lurgan elected under the
Towns Improvement (Ireland) Act 1854 for the municipal
government and administration of the said town were incor-
porated as the urban sanitary authority for the said town as
an urban sanitary district within the meaning of the Public
Health (Ireland) Act 1878:
And whereas by the Lurgan Town Provisional Order 1882
scheduled to and confirmed by the Local Government Board

Act 1882 there were transferred from the grand jury of the
county of Armagh to the said urban sanitary authority all
jurisdiction power and authority with respect to roads bridges
footpaths and public works within the said town of Lurgan
except public works concerning and chargeable on the county of
Armagh at large:

1915. And whereas under the Local Government (Ireland) Act 1898
~~ the town of Lurgan heing an urban sanitary district for the
purposes of the Public Health (Ireland) Act 1878 was con-
stituted an urban district within the meaning of the said Act
of 1898 under the name of the urban district of Lurgan (in
this Act referred to as "the district") and the town commis-
sioners being the urban sanitary authority of the town of
Lurgan were constituted an urban district council under the
name of the urban district council of Lurgan (in this Act
referred to as "the Council"):
And whereas the district which is wholly included in the
parish of Shankill together with portions of that parish outside
the district and of the parish of Seagoe are supplied with gas
by the Lurgan Gas Light and Chemical Company Limited (in
this Act referred to as " the company") and it is expedient
that the gas supply 0I" the district and certain parts of the
adjoining rural districts should be in the hands of the Council:
And whereas the Council have subject to the approval of
Parliament agreed to buy and the company have agreed to sell
and transfer to the Council the undertaking of the company as
defined by and subject to the terms and conditions contained in
the agreement set forth in the Eirst Schedule to this Act:
And whereas it is expedient that the said agreement be
confirmed and made binding upon the company and the Council
and that the Council be empowered to maintain extend and
improve the existing gasworks upon the lands described in the
Second Schedule to this Act and thereon to continue works for
the manufacture and storage of gas and residual products as in
this Act provided:
And whereas it will be for the public and local advantage
that the Council should be empowered to supply gas within
certain townlands and places adjacent to the district in which
there is no supply of gas:

confirmed by the Electric Lighting Orders Confirmation (No. 5)
Act 1914 the Council were empowered to supply electricity
within the district and it is expedient that further powers be
conferred upon the Council in regard to the supply of electricity
as by this Act provided:

And whereas in pursuance of the powers of the Puhlic A.D. 1915
Health (Ireland) Act 1878 the Council have constructed water-
works and provided a supply of water for the district and it is
expedient that further powers he conferred upon the Council
with respect thereto:
And whereas it is expedient to make.further provision in
regard to streets and buildings in the district and that the
powers of the Council in relation to slaughterhouses and as to
the health local government and improvement of the district be
enlarged as by this Act provided:
And whereas Parts III. and V. of the Public Health Acts
Amendment Act 1890 are in force within the district:
And whereas by an order of the Chief Secretary for Ireland
dated the nineteenth day of March one thousand nine hundred
and eight the whole of Parts VII. VIII. and IX. of the Puhlic
Health Acts Amendment Act 1907 were declared to be in force
within the district:
And whereas by an order of the Local Government Board
for Ireland dated the second day of July one thousand nine
hundred and eight the whole of Parts II. III. IV. V. VI. and
X. of the Public Health Acts Amendment Act 1907 were
declared to be in force within the district subject to certain
conditions and adaptations specified in the said order:
And whereas estimates have been prepared by the Council
for the extension and improvement of the gas undertaking and
such estimates amount to the sum of five thousand pounds:
And whereas the works included in such estimates are
permanent works and it is expedient that the cost thereof
should be spread over a term of years and that the Council
should be empowered to borrow further moneys for the other
purposes of this Act:
And whereas the objects aforesaid cannot be effected
without the authority of Parliament:
And whereas the Council have complied with the require-
ments of the Borough Funds (Ireland) Act 1888 in relation to
the promotion of the Bill for this Act and have obtained the
approval of the Local Government Board for Ireland and the
Chief Secretary for Ireland in pursuance of the provisions of
