CHAPTER xlix.
An Act to confer further powers on the urban district
council of Long Eaton in regard to their electricity
and water undertakings lands and other matters to
make further and better provision for the improvement
health and local government of their district and for
other purposes. [1st August 1946.]

HEREAS the urban district of Long Eaton (in this Act
referred to as " the district ") is under the govern-
ment of the urban district council of Long Eaton (in this Act
referred to as " the Council M):
And whereas the Council are the undertakers for the supply
of electricity under the provisions of the Long Eaton
Electric Lighting Order 1900 (which was- scheduled to and
confirmed by the Electric Lighting Orders Confirmation
63 & 64
Vict.
(No.
4) Act 1900) and under die provisions of that Order

and the Long Eaton Electricity (Extension) Special Order
1926 are now supplying electricity throughout the district
(except the area which was added to the district by the Derby-
shire Review Order 1934) and part of the parish of Toton in
the rural district of Stapleford and it is expedient that further
powers should be conferred upon the Council with respect to
their electricity undertaking:
And whereas it is expedient that further powers should be
conferred upon the Council with respect to their water
undertaking:
And whereas it is expedient that further and better pro-
vision should be made for the health good government and
improvement of the district and that the powers of the Council
in regard thereto should be enlarged as in this Act provided:

And whereas it is expedient that the provisions in regard to
the finances of the Council which are contained in this Act
should be made :
And whereas it is expedient that the other provisions
contained in this Act be enacted:
And whereas the purposes of this Act cannot be attained
without the authority of Parliament:
And whereas in relation to the promotion of the Bill for
this Act the requirements of sections 253 254 and 255 of the

Local Government Act 1933 have been observed:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by
and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority of the same as

visions with respect to the purchase and taking of lands
otherwise than by agreement (so far as the same are applic-

provisions of this Act) are hereby incorporated with and form
part of this Act.

4.—(1) In this Act the several words and expressions to PART I.
which meanings are assigned by the Acts wholly or partiallv cont-.
incorporated herewith or by the Public Health Act 1936 have ^Se^

subject or context repugnant to such construction.
(2) In this Act unless the subject or context otherwise
requires
" The district " means the urban district of Long Eaton;
" The Council " means the urban district council of Long
Eaton;
" The electricity undertaking " means the electricity
undertaking of the Council for the time being
authorised;
" The electricity limits " means the area within which the
Council are for the time being authorised to supply
electricity;
11 The water limits " means the limits within which the
Council are for the time being authorised to supply
water;
" The clerk " "the surveyor " " the medical officer "
and " the sanitary inspector " mean respectively
the clerk the surveyor the medical officer of health
and any sanitary inspector of the Council;
The Minister " means the Minister of Health;
The Lands Clauses Acts " means the Lands Clauses
Acts as modified by the Acquisition of Land
(Assessment of Compensation) Act 1919 and Part II 9
&

Sunday school " means any school in which children
are assembled for instruction on a Sunday or specially
for religious instruction whether on a Sunday or not;
Child " means a person under the age of sixteen years;
Food '' has the meaning assigned to it by section 100
of the Food and Drugs Act 1938;

Daily penalty '' means a penalty for each day on which
any offence is continued by a person after conviction;
The general rate fund " and " the general rate *' mean
respectively the general rate fund and the general
