An Act to make more effectual Provisions for lighting", cleansing, and watching the City of Londonderry, and to amend several Acts relating to the said City. [4th July 1832.] W HEREAS an Act passed in the Parliament of Ireland in the Thirtieth Year of the Reign of His late Majesty King George the Third, intituled An Act for building 30G.3. (I.) a Bridge over the River Lough Foyle at the City of Londonderry and the Suburbs thereof, and for certain Regulations relative to said City ; and another Act passed in the Parliament of Ireland in the Fortieth Year of the Reign of His late Majesty King George the Third, intituled An Act for amending an Act passed in the Thirtieth 40 G. 3. (I.) Year of His Majesty's Reign, intituled ' An Act for building a Bridge over the River Lough Foyle at the City of Londonderry and the ' Suburbs thereof, and for certain Regulations relative to said City ;' and another Act passed in the Parliament of the United Kingdom in the Forty-eighth Year of the Reign of His late Majesty K'wgGeorge the Third, intituled An Act to amend Two Acts, so far as relate to 4SG.3. supplying the City (^Londonderry with Water, improving the Harbour c-136- of the said City, and the Regulation of Pilots and Vessels using the same, and for extending the Jurisdiction of the Court held in the said City for the Recovery of small Debts ; and another Act passed in the Fifty-fourth Year of the Reign of His late Majesty King George the Third, intituled An Act for rebuilding or repairing the 54s£'3' [Local] 28 L Bridge c'2M' 252S 2&30GULIELMI IV. Cap. cvii. Bridge across the River Foyle or Lough Foyle at Londonderry, for enabling the Corporation of that City to raise Money for that Purpose, to authorize the Advance of a certain Sum of Money out of the Consolidated Fund of Ireland, and for regulating the Fairs and Markets and improving the Race Course there ; and another Act passed in the Fifth Year of the Reign of His late Majesty King George the 5G.4.c.i5'2. Fourth, intituled An Act to amend an Act of the Thirtieth Year of His late Majesty, for lighting and improving the City of Londonderry ; and another Act passed in the Sixth Year of the Reign of His late 6G.4.C.180. Majesty King George the Fourth, intituled An Act to amend several Acts relating to the City of Londonderry: And whereas the City of Londonderry is large and populous, and possesses considerable Trade and Manufactures, and it would greatly tend to the Improvement, good Order, and Security, and much promote the Prosperity of the said City, if more effectual Provisions were established for the Purpose of watching, cleansing, and paving of the same City, for the better Regulation of the Port and Harbour of Lough Foyle, and for the Appointment and Powers of the Ballast Office Committee, and also for providing for the Repayment, by the Mayor, Commonalty, and Citizens of the said City of Londonderry, of the Sum of Fifteen thousand Pounds late Irish Currency, advanced by the Com-. missioners for executing the Office of Lord High Treasurer of Ireland, for repairing the Bridge over the River Foyle, near Londonderry ; but as these Objects cannot be effected without the Aid and Authority of Parliament, May it therefore please Your Majesty, that it may be enacted j and be it enacted by the King's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament Powers of assembled, and by the Authority of the same. That the said several former Acts recited Acts, and all the Powers, Provisions, Penalties, Forfeitures, ^.teAded t0 Matters, and Things therein contained, (except such as are altered, varied, or repealed,) shall extend to this Act, and shall be construed therewith in as full, ample, and beneficial a Manner, to all Intents, Constructions, and Purposes whatsoever, as if the same had been repeated and re-enacted in this Act, and had made Part thereof. Parts of II- And be it further enacted, That on the Second Monday Acts re- in October One thousand eight hundred and thirty-two so much pealed. of the said recited Act passed in the Thirtieth Year of the Reign of His late Majesty as authorizes the Mayor, Commonalty, and Citizens of Londonderry to direct the Streets of the said Cityto be paved, pitched, flagged, raised, or altered, and for obtaining Gravel for those Purposes, and as requires Owners to cleanse before their Doors, and so much of the said recited Act passed in the Fortieth Year of the Reign of His said late Majesty as regu* lates the sweeping and cleansing of the said City, and also so-much of the said recited Acts passed in the Fifth and .Sixth Years of the Reign of His late Majesty King George the Fourth as directs the Mode of appointing the Gas Light Committee, and the Oath to be taken by them, shall be and the same are hereby repealed, except so far as the said Acts repeal or alter any former Acts. Second Monday) Appoint-in October One thousand eight .hundred''and thirty-two it shall and- ment of nay be lawful for such and, so many of th'e;Inhabitants,of the'isaid' ^hce Con City and Suburbs of Londonderry as 'shall be liable 'to Assessment- under the Provisions.herein-after contained,,to meet arid assemble and they are hereby required to assemble in Common; Hall within the said City of Londonderry, of which Meeting Ten Days Notice shall be given by the Mayor of the said City in some Newspaper-published in the said City, and by posting a Copy of such Notice on the Door of the Mayor's Office, and shall then and there elect/by Police Com-Ballot Twelve Inhabitants of the. said City and Suburbs,, who, to- mitteeto' gether' with the Mayor of the said City for the Time being, shall* j0,^ be and be called " The Police Committee, for: the City .'of London- inhabitants derry ;" and the said Committee, or any Five or. more of them, shalli and Mayor have full Power and Authority to carry into execution all the1,Powers of the City. and Provisions of the said recited Acts of the .Fifth and Sixth Years; of the Reign of His late Majesty King George the Fourth, as far as the same Acts or either of them; or the Provisions therein contained* may relate to the lighting the said City with Gas ; .and also to' carry into execution all the Powers and Provisions herein contained in manner herein-after mentioned* and shall be: liable to all Engagements entered into by any Gas Lights Committee acting underi or by virtue of the said recited Acts passed in the Fifth jand-Sixth Years of the Reign of.His late Majesty, and shail^have full Po\ver to-recover all Sums due to the said Committee.; IV. And be it rurtner enacted, mat no rerson snan be proposed or Nomination put in Nomination as a Member of the said Police Committee, exceptr of Police by Persons duly qualified to vote at such Election' of trie*said' Com^- Committee. mittee j and the said Committee shall be chosen: and elected.out of or from those Persons only so put in Nomination ; and no Person or Persons shall be authorized or entitled to vote at any Meeting to be held under the Provisions .of this Act, other than such Persons as shall be liable to be assessed under.this Act,.and whoseiTax or Cess shall not be one Year in arrear:: Provided, always^'that not Qualification Person shall be capable of being elected or of acting as a Member; of Persons of the said Committee, save and except such Persons as are or shall el'g",ble' be rated at or above the, Sum of Twenty Pounds in theannual Ap- plotment made or to be made by virtue of the.said recited; Acts or. this Act, and shall also reside within the sai'd City or "the Suburbs thereof, as the same may be limited by virtue of this- Act. V. Cap.cvil elect a proper Person to be a Member in the Room of the Person who shall have ceased to be on such Committee as aforesaid : Pro-' vided always, that, until such casual Vacancy or Vacancies shall be supplied, the remaining Members, or any Five or more of them, shall, notwithstanding any such Vacancy or Vacancies, be fully competent to do all Acts and Things which by this Act the; Members of such Committee are authorized, empowered, or required to do. Election of VI. And be it further enacted, That the Committee so to be ttT COm" electe i and chosen under or in pursuance of the Provisions herein contained shall continue in Office Until the Second Monday in the Month of October One thousand eight'hundred and thirty-three, upon which Day, and on every Second Monday in the Month of October of each succeeding Year, the aforesaid Inhabitants liable to Assessment under the Provisions herein contained shall and they are hereby required to assemble in the Court House of the said City, and shall then . and there re-elect, by Ballot, Three...
