£59 VICT.] Local Government Board's Provisional [Gh. Vii.] Order Confirmation (No. 1Q) Act, 1895, Session 2. CHAPTER vii. An Act to confirm a Provisional Order of the Local A.D. 1895. Government Board relating to the City of Liverpool. [5th September 1895.] WHEREAS the Local Government Board have made the Provisional Order set forth, in the schedule hereto under the provisions of the Local Government Act 1888: J1 * 5 2 Vict- And whereas it is requisite that the said Order should be confirmed by Parliament: Be it therefore enacted by the Queen's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows : 1. The Order as altered and set out in the schedule hereto j^ j ^ (herein-after referred to as " the Order ") shall be and the same is confirmed. hereby confirmed and all the provisions thereof shall have full validity and force subject to the provisions herein-after contained. 2. Words and expressions to which meanings are assigned by the Order shall have the same respective meanings when used in this Act. 3.(A.) If at any time hereafter it shall appear that the number ^ovjsiou^ of citizens on the citizens' roll in the two wards by the Order £££ constituted in the Walton district shall be seven thousand five tfon in hundred and upwards it shall be the duty of the council of the ^ n city (herein-after referred to as " the council") within three months from such citizens' roll coming into operation to petition the Queen to increase the number of the wards in the Walton district from two to three and to increase the number of the councillors in the city council by three and the number of aldermen by one and it [Price 2s.] A * A.D. 1895. Nomination' of aldermen by urban district councils. shall be lawful for Her Majesty by Order in Council to increase the number of wards councillors and aldermen accordingly and all the provisions of section thirty sub-sections two to fifteen inclusive of the Municipal Corporations Act 1882 shall subject as aforesaid apply accordingly. (B.) If the council shall fail iti the performance of their duty as aforesaid it shall be lawful for the majority of the councillors representing the said two wards in the Walton district to present a petition to Her Majesty in like manner as the same might have been presented by the council and all subsequent proceedings may thereupon be taken upon such petition as if it had been a petition presented by the councii 4 . The provisions of section three shall apply mutatis mutandis to the added part of "West Derby. ,5.(A.) If at any .time hereafter it shall appear that the number of citizens on the citizens' roll in the ward by the Order constituted in the Wavertree district shall be four thousand five hundred and upwards it shall be the duty of the council within three months from such citizens' roll coming into operation to petition the Queen to divide the Wavertree district into two wards and to increase the number of councillors in the city council by three and the number of aldermen by one and it shall be lawful for Her Majesty by Order in Council to increase the number of wards councillors and aldermen accordingly and all the provisions of section thirty subsections two to fifteen inclusive of the Munieipal Corporations Act 1882 shall subject as aforesaid apply1 accordingly. : (B.) If the council shall fail in the performance of their duty as aforesaid it shall be lawful for the majority of the councillors representing the said Wavertree district to present a petition to Her Majesty in like manner as the same might have been presented by the council and all subsequent proceedings may thereupon be taken upon such petition as if it had been a petition presented by the council. 6. The provisions of section five shall apply mutatis mutandis to the Toxteth district. 7.(A.) The Waltpn. Council and the West Derby Council respectively may if, they think: fit by resolution nominate two persons whAm they wish to be, elected as aldermen of the city and in Hke manner the Wavertree Council and the Toxteth Council may respectively nominate1 one such person to be an alderman. % Order Confirmation {No.lG) Act, 1895, Session. A copy of any such resolution sent to the town clerkrof the .AJ). 1695. city prior to the first day of November one thousand eight hundred and ninety-five shall be laid by him before the Council at their meeting on the ninth day of November one thousand eight hundred and ninety-five prior to the election taking place of the six additional aldermen required to be elected under Article IX. (2) of the Order. 8. If the Corporation should promote legislation or otherwise Rights of attempt to act contrary to the provisions of the Order or to obtain ^ners or any amendment or rescission of any such provisions so far as the to prevent same apply to the added areas or any one or more of them any departure owner or ratepayer for the time being in any added area which will be affected thereby or of the rural district of Sel'ton shall be entitled to petition against or otherwise oppose such application and the Corporation shall not be entitled to object to the locus standi of any such person or persons. 9. All costs charges and expenses (as between solicitor and client) Corporation of and incidental to the negotiations for the extension of the &c# PofiocaJS existing city the opposition by the local authorities of the added authorities. areas respectively and their respective predecessors thereto and the carrying out of the same including (inter alia) the costs charges and expenses of and incidental to meetings and polls of ratepayers and owners (if any) of the attendance of counsel solicitors and witnesses before the inspectors or other officers of the Local Government Board who have held inquiries with reference to the extension of the existing city and its re-division into wards respectively and before any Committees of the Houses of Parliament and otherwise of and incidental to this Act and of and incidental to the transfer of the properties and affairs of the local authorities of the added areas to the Corporation as taxed and allowed by the clerk of the peace or his deputy or failing them by the taxing officer of the House of Lords or of the House of Commons shall be paid in the first instance by the local authorities respectively by whom the same shall have been incurred to the solicitors to whom such costs are respectively payable and the Corporation shall repay to each of the said local authorities the amount so paid by them respectively : ; Provided that if such costs shall not have been paid before the commencement of the. order the same shall be payable and paid by the Corporation to such solicitors as aforesaid respectively. * 10. Corporation to provide' fire-engine stations &c. As to removing ashpit refuse in Toxteth Park Wavertree and West Derby. Ashbins in Toxteth district. No new hospital to be provided in fl aver- tree or West Derby. No public abattoirs to be erected in Wavertree or West Derby. Technical instruction in Wavertree and West Perby. . Order Confirmation (No. 10) Act, 1895, Session 2. portions of the Toxteth or Walton districts or the added part of West Derby respectively. 11. The Corporation shall within one year after the commencement of the Order establish within the Toxteth district a branch public library and will establish as soon as conveniently may be after the commencement of the Order within the Walton district a library and news room and a fire-engine station and further if necessary will thereafter make reasonable provision of public baths for the convenient use of the inhabitants of the "Walton district and moreover will within two years after the commencement of the Order establish within the Wavertree district a fire-engine station and appliances and shall further provide public baths and a library within the Wavertree district within a reasonable time if the Corporation funds will admit and further will within two years after the commencement of the Order establish within and for the added part of West Derby a fire-engine station with all necessary appliances and within five years from the commencement of the Order a library and public baths. 12. Ashpit refuse shall only be removed within the Toxteth and Wavertree districts and the added part of West Derby respectively in covered carts and no ashpit or other refuse from the existing city or from any other of the added areas shall be carted or otherwise brought into or through the Wavertree district or the added part of Wrest Derby respectively except for the purpose of conveying the same to a refuse destructor. 13. The Corporation will continue within the Toxteth district the system of removable ashbins and will cause such bins to be emptied at least once a week. 14. The Corporation shall not maintain any hospital within the Wavertree district or the added part of West Derby other than the existing hospital in Mill Lane Old Swan and shall not erect or permit to be erected within the Wavertree district or the added part of West Derby any public abattoir. 15. So long as the Corporation receive a grant under the Local Taxation (Customs and Excise) Act 1890 or any other Act...
