CHAPTER xvi
An Act to confer further powers on the lord mayor
aldermen and citizens of the city of Liverpool in
relation to streets and the local government health
improvement and finances of the city and in relation
to their markets undertaking and for other purposes.

YJETHEREAS
(1) The city of Liverpool (hereinafter referred to as " the city ")
is a county borough under the management and local govern-
ment of the lord mayor aldermen and citizens of the city acting
by the council (hereinafter referred to as " the Corporation "):
(2) It is expedient that further and better provision should be
made with reference to streets and for the local government
health and improvement and finances of the city and that the
powers of the Corporation in relation thereto should be enlarged
and extended:
(3) It is expedient that an increase or alteration in the tolls
and stallages chargeable by the Corporation in connection with
their markets undertaking should be authorised:
(4) It is expedient that the other provisions in this Act should
be enacted:
(5) The purposes of this Act cannot be effected without the
authority of Parliament:
(6) In relation to the promotion of the Bill for this Act the
requirements of Part XIII of the Local Government Act 1933

May it therefore please Your Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by
and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority of the same as follows:

PRELIMINARY
This Act may be cited as the Liverpool Corporation Act
2.
This Act is divided into Parts as follows:
Part I.—Preliminary.
Part II.—Streets.
Part III.—Public health.
Part IV.—Nuisances.
Part V.-—Movable dwellings and camping grounds.
Part VI.—Public order and safety.
Part VII.—Weights and measures.
Part VIII.—Finance and miscellaneous.
Part IX.—General.
Interpretation.
3.—(1)
In this Act the several words and expressions to which
meanings are assigned by sections 90 110 and 343 of the Public
Health Act,,>1936 have the same respective meanings unless there
be something in the subject or context repugnant to such con-
struction.
(2) In this Act unless the subject or context otherwise requires
the following expressions have the following meanings:
" Act of 1921 " means the Liverpool Corporation Act
1921;
" Act of 1927" means the Liverpool Corporation Act
1927;
" Act of 1933 " means the Local Government Act 1933 ;
" Act of 1936 " means the Public Health Act 1936;
" appointed day " has the meaning which is assigned to it
by section 89 (The appointed day) of this Act;
" city " means the city of Liverpool;
" city building surveyor " has the same meaning as in the
Act of 1921 ;
" commission " means the British Transport Commission ;
" contravention" includes a failure to comply and
" contravene " shall be construed accordingly ;

" Corporation " means the lord mayor aldermen and citizens PART I
of the city acting by the council; cont-
" council " means the council of the city;
" daily penalty " means a penalty for each day on which
any offence is continued after conviction;
" dock board" means the Mersey Docks and Harbour
Board;
" electricity authority" means the Central Electricity
Authority;
" enactment" includes any enactment in this Act or in
any general or local Act and any order byelaw or
regulation for the time being in force within the city;
" food " has the same meaning as in section 100 of the
Food and Drugs Act 1938 ;
" gas board " means the North Western Gas Board;
" general rate fund " and " general rate " mean respectively
the general rate fund and the general rate of the city;
" Minister" means the Minister of Housing and Local
Government;
" statutory undertakers" means any company body or
person authorised by any enactment to supply
electricity gas or hydraulic power ;
" street byelaws " means any byelaws for the time being
in force in the city with respect to the level width and
construction of new streets ;
" telegraphic line" has the same meaning as in the
Telegraph Act 1878;
" town clerk " " medical officer " and " sanitary inspector "
mean respectively the town clerk the medical officer of
health and any sanitary inspector of the city and
include any person duly appointed by the Corporation
to discharge temporarily the duties of any of those
officers.
(3) Any reference in this Act to any enactment shall be
construed as a reference to that enactment as applied extended
amended or varied by or by virtue of any subsequent enactment
including this Act.
(4) For the purposes of this Act the erection of a building
shall be deemed to have begun at the time when the clearing of
the site or the excavation for the foundations thereof began
whichever is the earlier. A4 3
