HEREAS
the borough
of
Leigh in the county of Lancaster
W
(hereinafter called
the borough
”)
is subject to the Acts
relating to municipal corporations and is under the local govern-
ment
of
the mayor aldermen and burgesses of the
borough
(herein-after called
tlie Corporation
”)
:
Ancl
whereas
by
the South Lancashire Waterworks Company were authorised to
construct waterworks and to supply
water
within
amongst,
other
townships and places the following townships and places naniely
Bedford Leigh West Leigh and Pennington
:
And whereas the Soutli Lancashire Waterworks
Company
did not construct any of the works by the last-mentioned
Act
authorised
.
And whereas by the Leigh and Hindley Local
Boards
(Water)
Act
1876
(herein-after referred
to
as
“the Act of 187G
’7]
the local
boards of the districts
of
Leigh and Hindley
now
tlie Corpomtion
and
the
Urban District Council of Hindley (herein-after called
‘‘
the Dislrict Conneil
”)
were
authorised to construct certain
of
the
worlcs
authorised
by
the South Lancasliire Waterworks Act 1871
and
for
the purpose
of
enabling the two
boards
to supply water
in the districts of Leigh and Hindley amongst other places ceitain
of
the
powers authorities and privileges
of
the South Lancashire
Waterworks Company were transferred to and vested in the
said
two
boards and
for
the purpose
of
carrying out the provisions

the Act of
1816
a
joint committee
of
the said two boards was
collstituted by that Act
in
that Act designated
the Water Joint
Committee
of
the Leigh and Hindley Local Boards
(herein-after
called “the mrater joint committee
”)
and
that Act further
provided that all the rights powers and authorities
of
the South
Lancashire Waterworks Compa,ny not
so
transferred and vested
in the two local boards should ilbsolutely cease and determine
:
And whereas the water joint committee have constructed
certain
of
the works authorised

the Act
of
1876
namely the
Leigh Service Reservoir and the Hindley Service Reservoir and
certain works in connexion therewith
for
supplying the borough
and
the urloan district
of
Hindley with water from such service
reservoirs but tlie other
~orks
authorised by the said Act have
not been constructed as
it
was found that
a
better supply for
the two districts could be obtained in bulk from Bolton or
Liverpool than
from
the sources
of
supply by the said Act
nuthoriscd to be acquired the other places in the limits
of
supply
oi
the water joint committee having been provided with water
from ocher sources
:
And whereas the Corporation and the District Council are
now taking the supply
of
water for the borough and district of
Hindley from the Liverpool Corporation under and by virtue of
an agreement dated the
first
day
of
October one thousand eight
hundred and ninety-three
:
And whereas between the thirtieth day
of
June one thousand
eight hundred and seventy-six and the thirty-first day of March
one thousand eight hundred and eighty-seven the sum of twenty-
one thousand fcur hundred and seventy-nine pounds eighteen
shillings
and
fivepence was borrowed
by
the Leigh
Local
Board
(the predecessors of the Corporation) under the powers in that
behalf conferred upon them
by
section
72
of the Act of
1876
and
between
tlie
said first-mentioned date and the thirty-first day
of
March one thousand nine hundred and three
a
further sum of
twenty thousand seven hundred and eleven pounds one shilling
and sevenpence was borrowed for waterworks purposes by the
Corporation and their predecessors the Leigh Local Board and
the urban district council of Leigh under
a
misapprehension
of
their statutory pcwers for those purposes making an aggregate
amount of forty-two thousand one hundred and ninety-one pounds
borrowed by the Corporation and their predecessors
for
the
purposes of their waterworks undertaking
:
Bnd whereas under section
73
of
the Act
of
1876
the
Corporation have established
a
sinking fund
for
the repavment
of
the loans
so
borrowed and have repaid thereout the
sum
of

seven thousand one hundred and ninety-five pounds part of the
A.D.
1903.
sums
so
borrowed
as
aforesaid leaving due and owing on the
thirty-first day of March one thousand nine hundred and three
of
the amounts
so
borrowed
as
aforesaid the sum of thirty-four
thousand nine hundred and ninety-six pounds
:
And whereas between the thirtieth day of June one thousand
eight liundred and seventy-six and the twenty-fifth day of March
one thousand eight hundred and eighty-seven the sum of fourteen
thousand two hundred and thirty pounds and nineteen shillings
was
borrowed by the Hindley Local Board (the predecessors of the
District Council) under the powers in that behalf confsrred upon
them
by
section
72
of the Act
of
1876
and between the said first-
mentioned date and the thirty-first day
of
March one thousand nine
hundred and three
a
further sum
of
ten thousand eight hundred
ancl sixty-nine pounds ancl oue shilling was borrowed for water-
works purposes by the District Council and their predecessors the
Hindley Local Board under
a
misapprehension of their statutory
powers
for
those purposes making an aggregate amount borrowed
by the District Council and their predecessors
for
the purposes
of
their waterworks undertaking of the sum of twenty-five thousand
and one hundred pounds
:
And whereas under section
73
of
the Act of
1876
the District
Council have established
a
sinking fund
for
the repayment
of
the
loans
so
borrowed and have repaid thereout the sum of five
thousand and three hiindred pounds part
of
the sums
so
borrowd
as aforesaid leaving due and owing on the thirty-first day of
March one thousand nine hundred and three of the amounts
so
borrowed
as
aforesaid the sum
of
nineteen thousand and eight
hundred pounds
:
And whereas cert.ain questions have arisen between the
Corporation and tjhe District Council and it has been agreed that
the water joint committee should be dissolved and that the Cor-
poration and the District Council should obtain the necessary
powers
for
that purpose ancl to vest the works held by the water
joint committee in the Corporation and the District Council in
the proportion
of
three-fifth parts thereof in the Corporation and
two-fifth parts thereof in the District Council and to confer upon
the Corporation and the District Council respectively the necessary
power for supplying the borough and urban district
of
Hindley
with water
:
And whereas in order to determine in what manner and
subject
to
what conditions the property vested in the water joint
committee should be divided between the Corporation and District
