[30th Jirize 1 S45.1 HEREAS the making of a Railway from Leeds, by Dews- bury, to HudclersJield, in the West Riding of the County of York, would be of great public Advantage, and would improve the Communication by Railway between the Towns of Leeds and Huddersfield and the Town of Manchester: And whereas the Persons herein-after named are willing, at their own Expence, to carry such Undertaking into execution, but the same cannot be effected without the Authority of Parliament : May it therefore please Your Majesty that it may be enacted ; and be it enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parlia- ment assembled, and by the Authority of the same, That the several Acts follo~ving, (that is to say,) the Companies Clauses Consolidation ~~~''~P~~~c- Act, 1845, the Lands Clauses Consolidation Act, 1845, and the Acts, [ Local. 1 8M Railways Railways Clauses Consolidation Act, 1845, shall be incorporated with and form Part o h the same be construed as One Act. short Title. 11. A4nd 8" & 9" VICTORIE, Cupxxxvi. 691 . Iv. And whereas the estimated Expence of making the said Capital. hilway is Six hundred and forty thousand Pounds; be it enacted, That the Capital of the Company shall be Six hundred and fifty thousand Pounds : Provided nevertheless, that if, under the Provision's herein-after contained, the Company shall not execute so much of the Railway hereby authorized as lies between the Town of Huddersfield and the Junction thereof with the Manchester and Leeds Railway, then the Capital of the Company shall be only Five hundred thousand Pounds. V. And be it enacted, That the Number of Shares into which Numberallcl the Capital shall be divided shall be Thirteen thousand if the Com- Amount of pany shall raise the whole Sum of Six hundred and fifty thousand Shares* Pounds, and Ten thousand if the Company shall only raise the Sum of Five hundred thousand Pounds, and the Amount of each Share shall be Fifty Pounds. greatest Amount of any One Call which the Company may make on the Shareholders, and Twenty Pounds of the Amount of a Share shall be the utmost aggregate Amount of Calls that may be made in any One Year upon any Share, and Three Months at the least shall be the Interval between successive Calls. VI. And be it enacted, That Five Pounds per Share shall be the Calls. VII. And be it enacted, That it shall be laxful for the Company Power to to borrow on Mortgage or Bond any Sums not exceeding in the whole borrow the Sum of One hundred and sixty-six thousand Pounds, but no Part of such Sum shall be borrowed until the whole of the said Capital or Sum of Five hundred thousand Pounds shall have been subscribed for, and Three hundred and twenty-five thousand Pounds shall have been actually paid up. VIII. And be it enacted, That the Number of Directors shall be Nuniber anti Nine, and the Qualification of a Director shall be the Possession in Qualificatiol1 his own Right of Twenty Shares in the Undertaking. IX. And be it enacted, That it shall be lawful for the Company Power to to increase or reduce the Number of Directors, provided that the var~t11e increased Number do not exceed Twelve, and that the reduced Directors. XIV. And whereas Plans ancl Sections of the Railway showing the Line and Levels thereof, and also Books of Reference containing the Kames of the Owners, Lessees, and Occupiers, or reputed Owners, Lessees, and Occupiers, of the Lands through which the same is intended to pass, have been deposited with the Clerk of the-Peace of the West Riding of the County of York; be it therefore enacted, That, subject to the Provisions in this and the said Acts contained, it shall be lawful for the said Company to make and maintain the said Railway and Works in the Line and upon the Lands delineated on the said Plans, and described in the said Books of Reference, and to enter upon, take, and use such of the said Lands as shall be necessary lor such Purpose. And be it enacted, That the said Railway shall coinmeiice in the Tomnship of Holbeck in the Parish of Leeds, there forming a Junction with the Leeds nnd Bradford Railway, and shall pass through or into the several Places following, or some of them ; that is to say, Leeds, Holbeck, Woi* tley, Beestola, Cliurwell, West Ardsley otherwise Woodchz~rclr, Jforlq, Bntley, Soot?ttill, Batley Car, Dews- bury, Afirjield, Kirkhenton, and Huddersf2ld, all in the West Riding of the Ciunty of York-, and shall (subject to the Provisions herein- after incntioiied respecting the Execution of the Works of such Rail- way between the Town of Huddersjeld and the Junction of the said Railway with the Line of the dfnncliester and Leeds Railn-ay) termi- nate at or near the Town of HuddersJield in the Township and Parish of Huddersjeld, and also by a Junction with the Manchester and , Leeds Railway in the Township and Parish of Kirkheaton aforesaid ; and one of such Branch Railways shall be made within the Town- ship and Parish of Kirkheaton aforesaid, and shall form a Junction with the said Mhncliestes. and Leeds Railway ; and another of such Branch Railways shall be made within the Township and Parish of Mirfield aforesaid, and shan also form a Junction with the Manchester and Leeds Railway; and another of such Branch Railways shall commence in the Township and Parish of Batley, and shill pass through or into the several Townships of Batle:y, Birstal, and Gor?zei*.saZ, or some of them...
