[15 & 16 Geo. 5.] Leeds Corporation [Ch. lx,] Act, 1925. CHAPTER Ix. An Act to confer further powers on the lord A.D. 1925. mayor aldermen and citizens of the city of Leeds in regard to the construction of tramways new streets and street improvements to enlarge the city to extend the powers of borrowing moneys for the waterworks undertaking and for other purposes. [31st July 1925.] V JTHEREAS in order to provide better means of access and to promote public convenience it is expedient to confer further powers upon the lord mayor aldermen and citizens of the city of Leeds (in this Act called "the Corporation") to make new streets and street improvements authorised by this Act and to construct the tramways and tramroad thereby authorised and to work an additional trolley vehicle route : And whereas Tramway No. 3 authorised by this Act will be situate partly in the city and partly in the rural district of Wharfedale and the council of that district have consented to the exclusion of section 43 of the Tramways Act 1870 from incorporation in this Act: And whereas it is expedient to extend the boundaries of the city so as to include therein a portion of the township of Adel-cum-Eccup as by this Act provided : And whereas by the Leeds Corporation Water Act 1901 and the Leeds Corporation Acts 1907 and 1913 the Corporation were authorised to construct waterworks and it is expedient to extend the powers of borrowing money for that purpose: [Price 2s. Net.] A 1 [Ch. lx.] Leeds Corporation [15 & 16 Geo. 5.] Act, 1925. A.D. 1925. (b) The bond required by section 85 of the Lands Clauses Consolidation Act 1845 shall be under the corporate seal of the Corporation and shall be sufficient without the addition of the sureties mentioned in that section : (2) Section 3 (Interpretation of terms) section 19 (Local authority may lease or take tolls) Part II. and Part III. (except section 43 relating to the future purchase of the undertaking by the local authority) of the Tramways Act 1870 Provided that The words in section 19 of that Act " but nothing in this Act shall authorise any " local authority to place or run carriages " upon such tramway and to demand and " take tolls and charges in respect of the " use of such carriages " shall not apply to the Corporation; So much of section 46 as authorises a local authority (not being the promoters) to make regulations shall not apply to so much of the tramways authorised by this Act as shall not be constructed on highways. Interprets 4.(1) In this Act the several words and expressions tion. to which meanings are assigned by the Acts wholly or partially incorporated herewith have the same respective meanings unless there be something in the subject or context repugnant to such construction. (2) In this Act unless the subject or context otherwise requires (a) " The Corporation" means the lord mayor aldermen and citizens of the city of Leeds; " The city " means the city of Leeds; " The existing city " means the city as it exists immediately before the appointed day; {d) " The council " means the council of the city; (e) " The town clerk " means the town clerk of the city and includes any person duly authorised to discharge temporarily the duties of that office; (/) "The city fund" and "the city rate" mean respectively the city fund and the city rate of the city; 4 [15 & 16 Geo. 5.] Leeds Corporation [Ch. lx.] Act, 1925. (.9) " The county " and " the county council" mean A.D. ii)2o. respectively the administrative county of the - west riding of Yorkshire and the county council of that county; {h) " The Wharfedale district " and " the Wharfedale Council" mean respectively the Wharfedale rural district and the Wharfedale Eural District Council and " the Hunslet district" and " the Hunslet Rural District Council" mean respectively the Hunslet rural district and Hunslet Rural District Council; (i) " The added area " means the part of the existing township of Adel-cum-Eccup which is coloured orange on the city map; (j) " The township of Eccup " means the township of Adel-cum-Eccup as diminished and renamed by this Act; (k) " The city map" means the map signed in triplicate by John Wells Wainwright Hopkins Esquire the Chairman of the Committee of the House of Commons to whom the Bill for this Act was referred one of which has been deposited in the Parliament Office of the House of Lords one in the Private Bill Office of the House of Commons and one with the town clerk at his office; (I) " The appointed day" means the first day of April nineteen hundred and twenty-six; (m) " Existing" in relation to any township or other area altered by this Act means existing immediately before the appointed day; (n) " The Act of 1888 " and " the Act of 1894" mean respectively the Local Government Act 1888 and the Local Government Act 1894; (o) "The Public Health Acts" means the Public Health Act 1875 and the Acts amending and extending the same; (p) " The Municipal Corporations Acts " means the Municipal Corporations Act 1882 and the Acts amending and extending the same; (q) " The local Acts " means the local Acts specified in Part I. of the First Schedule to this Act the Orders specified in Part II. of that schedule and so much of the confirmation Acts specified in that Part as relates to those Orders and each 5 [Ch. lx.] Leeds Corporation [15 & 16 Geo. 5.] Act, 1925. A.D. 1925. of the Acts and Orders specified in the said schedule is referred to as the Act or Order of the year in which it was passed or confirmed; (/) "The First Schedule" and "the Second Schedule " mean respectively the First Schedule and the Second Schedule to this Act; (s) " Trolley vehicle " means any mechanically propelled vehicle adapted for use upon roads without rails and moved by electrical power transmitted thereto from some external source; (t) " Statutory borrowing power " means any. power whether or not coupled with a duty of borrowing or continuing on loan or re-borrowing money or of redeeming or paying off or creating or continuing payment of or in respect of any annuity rentcharge rent or other security representing or granted in lieu of consideration money for the time being existing under any Act of Parliament public or local passed or to be passed or under any Provisional Order confirmed by Act of Parliament passed or to be passed or under any order or sanction of any Government department made or given or to be made or given by authority of any Act of Parliament passed or to be passed; (tt) " Burial Acts " means the Burial Acts 1852 to 1906. paet n. Lands. Acquisition 5. Subject to the provisions of this Act the Cor- of lands. poration may enter upon take and use for and in connection with the purposes of this Act and (in the case of the making widening or improving of any street or road) for providing space for the erection of buildings adjoining or near to such street or road all or any part of the lands delineated on the deposited plans and described in the deposited book of reference: Provided that the Corporation shall not without the consent in writing of the London and North Eastern Railway Company enter upon take or interfere with any lands or property of that company. 6 [15 & 16 Geo. 5.] Leeds Corporation [Ch. lx.] Act, 1925. 6. The powers of the Corporation for the compulsory '? purchase of lands for the purposes of this Act shall cease perio^ f01, after the expiration of five years from the thirty-first compulsory day of December nineteen hundred and twenty-five. purchase of lands. 7. In addition to any other lands acquired by the Purchase ^ Corporation in pursuance of this Act they may by lands by agreement purchase take on lease or acquire and may agreement- hold for the purposes of this Act further lands not exceeding ten acres and they may on such lands erect or construct and hold depots yards wharves offices buildings sidings works and other conveniences. Part III. Street Improvements. 8. Subject to the provisions of this Act the Cor- Power to poration may make and maintain in the lines and makestre^ according to the levels shown on the deposited plans lmProve- and sections the new streets and street improvements hereinafter mentioned together with all necessary ap proaches junctions abutments embankments cuttings bridges girders retaining walls arches steps sewers drains culverts works and conveniences connected therewith or incidental thereto. The new streets and street improvements hereinbefore referred to and authorised by this section will be situate in the existing city and in the township of Temple Newsam in the Hunslet rural district and are :-i- In the city Street Work No. 1 A widening of (1) Park Lane on the northerly side (2) of Guildford Street on both sides (3) of Upperhead Row on the northerly side and (4) of Lowerhead Row on the northerly side commencing at the junction of Park Lane with Calverley Street and terminating at the junction of Lowerhead Row with Vicar Lane including an alteration of the level of Guildford Street: Street Work No. 2 A new street commencing at the junction of Vicar Lane with Lowerhead Row and terminating in Lady Lane: Street Work No. 3 A new street commencing by a junction with Street Work No. 2 on the east 7 [Ch. lx.] Leeds Corporation [15 & 16 Geo. 5.] Act, 1925.
