CHAPTER xcii.
An
Act to confirm a Provisional Order under the
Private Legislation Procedure (Scotland) Act
1936 relating to Lanarkshire County Council.
[4th August 1939.]

HEREAS
the
Provisional Order
set
forth
in the
schedule hereunto annexed
has
been made
by the
Secretary
of
State under
the
provisions
of the
Private 26

Legislation Procedure (Scotland)
Act 1936 and it is x Edw-8-
requisite that
the
said Order should
be
confirmed
by c- 2-
Parliament:
Be
it
therefore enacted
by the
King's most
Excellent Majesty
by and
with
the
advice
and
consent
of
the
Lords Spiritual
and
Temporal
and
Commons
in
this present Parliament assembled
and by the
authority
of
the
same
as
follows
:

in the
schedule Conftmation
hereunto annexed
is
hereby confirmed. schedule.111

This Act may
be
cited
as the
Lanarkshire County Short title.

SCHEDULE.
LANARKSHIRE COUNTY COUNCIL.
Provisional Order to consolidate with amendments the Acts
and Orders of or relating to the county council of the
county of Lanark to confer further powers upon the
County Council and for other purposes.
WHEREAS the county council of the county of Lanark
(hereinafter referred to as " the County Council") are
the local authority for the county of Lanark (hereinafter
referred to as " the county ") exclusive of the burghs
therein :
And whereas the County Council are the owners of
and are vested in the water gas and electricity under-
takings of the county :
And whereas the Acts and Orders of or relating to
the County Council are numerous and many of their
provisions have been superseded by subsequent legislation
and ought to be repealed and it would be of public and
local advantage if such of the provisions of the said Acts
and Orders as it is deemed expedient to retain were
consolidated with certain additions and amendments into
one Order:
And whereas it is expedient at the same time to
extend as in this Order provided the powers of the
County Council relating to the matters comprised in
those enactments:
And whereas it is expedient that the other provisions
in this Order contained should be enacted :
And whereas the purposes aforesaid cannot be
effected without an Order confirmed by Parliament
under the provisions of the Private Legislation Procedure
(Scotland) Act 1936 :

Act, 1939.
Now therefore in pursuance of the powers contained
in the last-mentioned Act the Secretary of State orders
as follows:
PART I.
PRELIMINARY.
1.
This Order may be cited as the Lanarkshire Short title.
County Council Order 1939.
2.
This Order shall come into operation on the date Commence-
of the passing of the Act confirming this Order which ment of
date is in this Order referred to as " the commencement 0r-
of this Order."
3.
This Order is divided into Parts as follows : Order
