CHAPTER vi
An Act to confer further powers on the Kent County
Council and local authorities in the county of Kent in
relation to lands and highways and the local government
improvement health and finances of the county and
for other purposes. [18th December 1958.]
V17HEREAS
(1) It is expedient that further and better provision should be
made with reference to lands and highways and for the local
government improvement health and finances of the administra-
tive county of Kent and that the powers of the county council
of that administrative county (hereinafter referred to as " the
Council ") and of the local authorities within that administrative
county should be enlarged and extended as by this Act provided:
(2) It is expedient to make further provision with reference
to the court of quarter sessions of the county and the officers
of that court:
(3) It is expedient that the other provisions contained in this
Act be enacted:
(4) The purposes of this Act cannot be effected without the
authority of Parliament:
(5) In relation to the promotion of the Bill for this Act the
requirements of Part XIII of the Local Government Act 1933
have been observed: i

May it therefore please Your Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows:
PART
I
PRELIMINARY
1.
This Act may be cited as the Kent County Council Act
1958.
2.
This Act is divided into Parts as follows:
Part I.—Preliminary.
Part II.—Lands.
Part III.—Highways.
Part IV.—Public order and safety.
Part V.—Lectures cultural activities records etc.
Part VI.—County quarter sessions.
Part VII.—Finance.
Part VIII.—Miscellaneous.
Part IX.—Protective provisions.
Part X.—General.
3.
The Lands Clauses Acts except sections 127 to 132 and
150 and 151 of the Lands Clauses Consolidation Act 1845 (so
far as such Acts are applicable for the purposes of and are not
inconsistent with the provisions of this Act) are hereby
incorporated with and form part of this Act:
Provided that the bond required by section 85 of the Lands
Clauses Consolidation Act 1845 shall be sufficient without the
addition of the sureties mentioned in that section.
Interpretation. 4.—(1) In this Act the several words and expressions to which
meanings are assigned by section 343 of the Act of 1936 have
the same respective meanings unless there be something in the
subject or context repugnant to such construction.
(2) In this Act unless otherwise expressly enacted or unless
the subject or context otherwise requires the following expressions
have the meanings hereby respectively assigned to
them :
" Act of

" means the Local Government Act 1933;
" Act of 1936 " means the Public Health Act 1936;

" Act of 1947 " means the Town and Country Planning Act PART I
1947;
& -cent.
" Act of 1950 " means the Public Utilities Street Works Act
1950;
" appointed day" has the meaning assigned to it by
section 5 (The appointed day) of this Act;
" authorised security " means any mortgage stock bond or
other security which the Council or a local authority are
for the time being authorised to grant create or issue or
upon or by means of which the Council or a local
authority are for the time being authorised to raise
money;
" claimed road " means a county road in respect of which a
local authority exercise the functions of maintenance
and repair pursuant to a claim which has been made
or may hereafter be made under section 32 of the Local
Government Act 1929;
" coal industry activities" has the meaning assigned to it
by section 63 of the Coal Industry Nationalisation
Act 1946;
" commission " means the British Transport Commission;
" contravention" includes a failure to comply and
" contravene " shall be construed accordingly;
" Council " means the county council of the county;
" county " means the administrative county of Kent;
" county fund " means the county fund of the Council;
" county road " has the same meaning as in Part III of the
Local Government Act 1929;
" daily fine " means a fine for each day on which an offence
is continued after conviction
thereof;
" district" means a borough or an urban or rural district
in the county;
" enactment" includes an enactment in this Act or in any
general or local Act and any order byelaw or regulation
for the time being in force within the county or within
a district;
"financial year" means the period of twelve months
commencing on the first day of April in any year and
ending on the thirty-first day of March in the next
following year; 3
